11 AAC 40.285 - Sampling and harvesting of industrial hemp within delta-9-THC limitations

(a) If pre-harvest testing confirms delta-9-THC levels in the harvest lot of not more than 0.3 percent, the registered grower may harvest each tested lot from which the sample was derived and further store or transport the industrial hemp for compensation or processing in compliance with 11 AAC 40.710. A harvest is subject to the following requirements:

(1) a registered grower shall harvest a tested lot not later than 15 calendar days after the division's sample collection date;

(2) if conditions do not allow the registrant to harvest not later than 15 calendar days after the sample collection, the division may order additional testing of the lot or provide written authorization to harvest the crop by a specific date, with or without further testing being required.

(b) If post-harvest sampling and testing confirms delta-9-THC levels in the harvest lot of not more than 0.3 percent, the registrant is authorized to receive compensation for the raw industrial hemp from the harvest lot in compliance with 11 AAC 40.205.
