(a) A person subject to zoning restrictions adopted by reference in 11 AAC 20.365 may not conduct the following activities within the boundary of Wood-Tikchik State Park, except as authorized by the director under 11 AAC 18.010:
(1) except for lawful hunting and trapping,
the use or discharge of a firearm on private property in a developed shooting
range facility not in existence on June 25, 1976;
(2) the placement of a fuel storage tank,
unless it is attached and anchored solidly to a structure or to the ground; the
tank must be installed within an impervious containment basin of a size to
contain 110 percent of the storage capacity plus 12 inches of
freeboard;
(3) the installation or
construction of a wastewater septic system or latrine within 100 feet of the
ordinary high water mark of any water body within the boundary of the
park;
(4) the placement of waste or
refuse in a manner capable of contaminating land or water within the boundary
of the park;
(5) the installation
or construction of a utility or communication tower, antenna, or satellite
dish, that exceeds 40 feet in height;
(6) the construction or erection of
advertising signage;
(7) the
construction of a structure or dwelling that exceeds two stories or a total of
24 feet in building height;
(8) the
use of colors other than neutral tones for painting, siding, or roofing
material on structures built on the land, subject to approval by the
division;
(9) the discharge,
application, or release of chemicals, toxic materials, fuels, pesticides, or
petroleum-based fuel on or into land or water within the boundary of the
park.
(b) In this section,
(1) "building height" means the
vertical distance above the average existing grade measured to the highest
point of the building; the building height of a stepped or terraced building is
the maximum height of any segment of the building;
(2) "fuel storage tank" means a vessel
(A) used for the storage of petroleum-based
fuels, including gasoline, diesel, kerosene, and heating oil; and
(B) having a liquid volume of 200 gallons or
more;
(3) "shooting
range facility"
(A) means a public or private
facility or area designed and improved to encompass, for the purpose of
discharging firearms at moving or stationary targets,
(i) shooting stations or firing
lines;
(ii) target areas;
and
(iii) other related
components;
(B) does not
include incidental target practice areas on private property;
(4) "story" means
(A) for floors other than the topmost floor,
that portion of a building included between the upper surface of any floor and
the upper surface of the floor next above; "story" includes a basement or
cellar in which the finished floor level directly above the basement or cellar
averages more than four feet above grade;
(B) for the topmost floor, that portion of a
building included between the upper surface of the topmost floor and the
ceiling or roof above;
(5) "structure" means anything constructed or
erected that requires location on the ground or attachment to something having
location on the ground; "structure" includes buildings, towers, sheds, and
signs; "structure" does not include fences less than six feet in height,
retaining walls less than three feet in height, rockeries, or similar
improvements of a minor character.
