Section 800-2-2-.05 - Continuance And Resumption Of Service

(1) An active member who becomes the director of a department of state government shall continue participation in the Employees' Retirement System. Participation status as a regular employee or as a state policeman shall be determined based upon the director's position and not upon the prior employment position. For example, a state policeman who became the director of the state highway department would participate as a regular employee rather than as a state policeman while serving as director.

(2) A retired state employee who accepts reemployment with any department of the state may request resumption of participation in the Retirement System upon completion of the statutorily required period of continuous active service. The Board of Control will grant such request only if such employee makes the payments required by statute and only if the Board finds that the employee is otherwise eligible for the resumption of participation.
