Section 485-X-7-.08 - Disciplinary Guidelines

The Board shall establish and approve disciplinary guidelines for each disciplinary action. The Board shall periodically review the disciplinary guidelines applicable to each ground for disciplinary action, which may be imposed by the Board. The guidelines shall specify a meaningful range of designated fines and penalties based upon the severity and repetition of specific offenses. The guidelines shall provide reasonable and meaningful notice to the public and to respondents of likely fines and penalties, which may be imposed by the Board for such conduct. The Board shall consistently apply the penalties. A specific finding of mitigating or aggravating circumstances shall allow the Board to impose a fine or penalty other than that provided for in the guidelines.
