Section 482-1-146-.12 - Referral For Criminal Prosecution Or Civil Penalty

The Commissioner or another authorized representative of the Department may at any time refer any circumstances suggesting a willful violation of 18 U.S.C. § 1033(e) by any individual or entity to the appropriate law enforcement agencies or prosecutorial authorities for further investigation, possible criminal prosecution, and/or proceedings to assess the civil penalty provided for in 18 U.S.C. § 1034 in addition to any administrative or other action that the Commissioner or Department may take in light of the circumstances.
