Chapter 482-1-101 - STANDARDS FOR DETERMINING HAZARDOUS FINANCIAL CONDITION
Section 482-1-101-.04 - Commissioner's Authority

(1) For the purposes of making a determination of an insurer's financial condition under this chapter, the commissioner may:

(3) Any insurer subject to an order under Rule 482-1-101-.04(2) may request a hearing to review that order. The notice of hearing shall be served upon the insurer pursuant to Section 27-2-18, Alabama Insurance Code, and Insurance Regulation Chapter 482-1-065. The notice of hearing shall state the time and place of hearing, and the conduct, condition or ground upon which the Commissioner based the order. Unless mutually agreed between the commissioner and the insurer, the hearing shall occur not less than 10 days nor more than 30 days after notice is served and shall be either at the Department in Montgomery, Alabama, or in some other place of convenience to the parties to be designated by the commissioner. He shall hold all hearings under this rule privately, unless the insurer requests a public hearing, in which case the hearing shall be public.
