Section 480-1-3-.03 - Decision Of The Board Of Appeals Appeal Board On Application For Leave To Appeal

(1) Within 30 days after the application for Leave to Appeal shall have been received by the Board of Appeals, the Board of Appeals shall either grant or deny the application solely on the basis of the application and the record.

(2) Disallowance of Application. If an application for leave to appeal is disallowed by order of the Board notice of the decision shall be mailed to the last known address or place of business of each interested party and shall include a statement of statutory appeal rights.

(3) Allowance of Application. If the further appeal is allowed by the Board or if the Board removes an appeal from the hearing officer to the Board and on its own motion assumes jurisdiction of the appeal notification shall be mailed to the last known address or place of business of each interested party.
