Section 480-1-2-.10 - Delivery Of Notice Of Hearing In Contested Cases

(1) The notice of hearing in contested cases, not elsewhere provided for by rule or statute, shall be delivered to all parties to the proceeding at their last known address or place of business.

(a) Delivery of the notice shall be by First Class Mail and shall be effective upon the deposit of the notice in the U.S. Mail, postage prepaid.
1. The Department shall make a record of the deposit of the notice in the U.S. Mail according to established procedures in the regular course of business.
a. Such record shall constitute prima facie evidence of delivery.

(2) Posting of the notice as specified above shall constitute the commencement of the contested case proceeding.
