(a) Schedule I shall consist of the drugs and other substances, by whatever official name, common or usual name, or brand name designated, listed in this section. Each drug or substance has been assigned the DEA Controlled Substances Code Number set forth opposite it.

(b) Opiates. (h) A synthetic controlled substance or analogue in subdivision

(g) or this subdivision does not include any of the following:

1.

Any substance for which there is an approved new drug application under the Federal Food, Drug, and Cosmetic Act.

2.

With respect to a particular person, any substance, if an exemption is in effect for investigational use, for that person, as provided by 21 U.S.C. § 355, and the person is registered as a controlled substance researcher as required under section 152.12, subdivision 3, to the extent conduct with respect to the substance is pursuant to the exemption and registration.

(i) A controlled substance analogue is treated as a controlled substance in Schedule I.

(j) After the Alabama Department of Forensic Sciences has determined a substance to be a synthetic controlled substance analogue under this section, the department shall notify the Alabama Department of Public Health with information relevant to scheduling as provided by Section 20-2-20.
