Section 420-3-5-.08 - Unauthorized Dumps

The creation, contribution to, or operation of an unauthorized dump is a public health nuisance and shall be abated as provided by law.

Persons who create, contribute to, or operate an unauthorized dump or who own the property upon which an unauthorized dump is located shall be held responsible for any abatement action deemed necessary by the LHD, including, but not limited to, the removal of the solid waste to an approved handling or disposal facility.

Previous Rule .09 was renumbered .08 per certification published September 30, 2021; effective November 14, 2021.
