Section 420-3-29-.12 - Renovation Project Notification

(1) No firm or renovator shall engage in a renovation project on target housing or a child occupied facility that is subject to Ala. Admin. Code, Chapter 420-3-27 prior to notifying the Department of such activities. All notifications shall be made in writing by mail, e-mail, or fax on a form provided by the Department. Notification must be received at least 7 working days prior to commencement of the project. Online notification may be completed by clicking on the appropriate website address which can be found on the renovation project notification form.

(2) For emergency renovation projects where a 7 day notice is not feasible, the firm or supervisor shall notify the Department within 3 calendar days after commencement of such emergency projects.

(3) The notification shall state:

(a) The physical address and vicinity map of the location of the project;

(b) The building owners' and managers' names, addresses, and phone numbers;

(c) The dates when the project will begin and end;

(d) The name of the accredited renovator for each project; and

(e) Any other information required by the Department.

(4) Notification revisions shall be made by the applicant in writing by mail, e-mail, online, or fax on a form provided by the Department and shall be received by the program in accordance with the following:

(a) Revisions to a start date for a project shall be received at least 7 working days before the new start date; on or before the previously stated or previously revised start date

(b) Revision to a completion date other than the completion date stated in the approved project notification or subsequent revision shall be received by the new completion date; and

(c) For long term intermittent projects, notification shall be made by phone, e-mail, online, or fax to the Department at least 72 hours prior to start and completion of each phase.

(d) All revisions shall be submitted to the Department prior to initiating the activities or changes that the revision addresses.

(5) The following shall be maintained on the site during renovation activities and shall be available for review by the Department:

(a) A copy of the renovation notification where applicable and all revisions.

(b) Safe State-issued photo identification cards for all accredited (registered) personnel performing lead renovation activities.

(c) The occupant protection plan; and

(d) Any applicable renovation design and specifications, risk assessment and inspection reports.

(6) Failure to submit a timely project notification application is a violation of these rules.
