Chapter 420-3-23 - BODY ART PRACTICE AND FACILITIES
Section 420-3-23-.15 - Prohibitions

(1) Prohibited acts include, but are not limited to, the following:
(a) Performing body art on any body part of a
minor without the informed written consent of the parent or legal guardian of
such minor. This consent is to be given in person to the operator or
responsible person at the facility by the parent or legal guardian at the time
the tattooing or piercing is to commence.
(b) Performing body art on a person who, in
the opinion of the operator is inebriated or appears to be under the influence
of alcohol or drugs.
(c) Owning,
operating or soliciting business as a body art facility or operator without
first obtaining all necessary permits and approvals from the Department, unless
specifically exempted by these rules.
(d) Obtaining or attempting to obtain any
body art facility license or operator permit by means of fraud,
misrepresentation or concealment.
(e) Mobile body art facilities are
prohibited.
