The Program shall be administered by the Secretary or his or her designee. These rules shall be interpreted by the Secretary and his decision as to any interpretations shall be final. The Secretary may grant waivers and/or make exceptions from this chapter for particular situations where the purposes of the Act would be served by any such waiver or interpretation. The Department may make expenditures as it deems reasonable for which the Program was created. In addition, the Department may retain a sufficient amount of the Application fees collected to offset its internal expenses and overhead in administering the Program.
