Section 265-X-3-.10 - Allegations Of Excessive Force Reporting

(1) The ALEA SBI Criminal Justice Information Services Division (SBI CJIS) shall provide a uniform reporting form to all state, county, and municipal law enforcement agencies for the reporting of allegations of excessive force.

(2) Upon an allegation of excessive force by the public, the agency shall provide this form to complainant. SBI CJIS shall also make this form available on its public website (or the AJIC website when established).

(3) The report will be submitted by the complainant directly to SBI CJIS.

(4) SBI CJIS will notify the agency employing the officer named in the complaint within 5 business days of receipt of the complaint.

(5) SBI CJIS will attempt to determine whether the alleged incident was litigated, and if so, the disposition of the court action. SBI CJIS will also contact the agency for determination, if any, of any local review of the incident.

(6) By March 1 of each year, SBI CJIS will create a report of all incidents occurring in the previous calendar year, including the race of the officer and the victim or victims, specific facts relating to the incident as provided by the complainant, whether the incident was subject to court action and final disposition of the court action, and the final determination of any local review of the incident and present such compilation to the House Public Safety and Homeland Security Committee and the Senate Judiciary Committee.
