Kairos Power, LLC; Hermes 2; Environmental Assessment, Finding of No Significant Impact, and Exemptions
The U.S. Nuclear Regulatory Commission (NRC) is issuing an environmental assessment (EA) and finding of no significant impact (FONSI) regarding the NRC's consideration of issuance of a construction permit (CP) to Kairos Power, LLC (Kairos, the applicant) for the proposed Hermes 2 test reactor facility located in Oak Ridge, Tennessee. If approved, the CP would authorize the construction of two fluoride-salt cooled, high- temperature reactors that use solid tri-structural isotropic fuel in pebble form, intermediate liquid-sodium loops, and a common power conversion unit. In addition, the NRC is issuing exemptions from certain NRC requirements which state that the NRC staff shall prepare and issue an environmental impact statement (EIS) to support the issuance of a CP for a testing facility. The NRC is granting the exemptions and issuing the EA and FONSI concurrently to satisfy its obligations under the National Environmental Policy Act of 1969 (NEPA) and requirements under NRC regulations, related to the proposed action.

Special Local Regulation; Galveston Channel, Galveston, TX
The Coast Guard is establishing a special local regulation for navigable waters within the Galveston Ship Channel. The special local regulation is needed to safely align and navigate vessels for the Texian Navy Day Parade. Entry of non-participants into the pre-staging and parade transit zones is prohibited unless specifically authorized by the Captain of the Port, Sector Houston-Galveston (COTP). Those in the regulated area must comply with all lawful orders or directions given to them by the COTP or the designated representative.
Release of Achieving Health and Environmental Protection Through EPA's Meaningful Engagement Policy
The Environmental Protection Agency (EPA) is issuing the final "Achieving Health and environmental Protection Through EPA's Meaningful Engagement Policy." The final Policy supersedes the EPA's 2003 Public Involvement Policy and highlights three steps for planning and providing opportunities for meaningful engagement and public participation that will enhance decision-making, while recognizing that meaningful engagement processes will need to be tailored to meet different program or decision contexts. The accompanying "Resources and Best Practices" reflect experience gained since the 2003 Public Involvement Policy. The Policy will help EPA staff build and strengthen capabilities necessary to reach and hear from members of the public on actions they are interested in or affected by, while accounting for Agency time and resource constraints. This policy does not have the force and effect of law and it does not bind the agency or the public in any way. The EPA solicited public comments on the draft policy for sixty days beginning on November 16, 2023.
Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Data Reporting and Recordkeeping Under the Toxic Substances Control Act (TSCA); Change to Submission Period and Technical Correction
The Environmental Protection Agency (EPA or Agency) is taking direct final action to amend the Toxic Substances Control Act (TSCA) regulation with reporting and recordkeeping requirements for perfluoroalkyl and polyfluoroalkyl substances (PFAS). As promulgated in October 2023, the regulation requires manufacturers (including importers) of PFAS in any year between 2011-2022 to report certain data to EPA related to exposure and environmental and health effects. EPA is making a one-time modification to change the beginning of the data submission period from November 12, 2024, to July 11, 2025, with a corresponding change to the end of the submission period. EPA is also making a technical correction to address an error in the regulatory text. There are no other changes to the reporting and recordkeeping requirements in the existing rule under TSCA.
Membership of the National Oceanic and Atmospheric Administration Performance Review Board
NOAA announces the appointment of members who will serve on the 2024 NOAA Performance Review Board (PRB). The NOAA PRB is responsible for reviewing performance appraisals and ratings of Senior Executive Service, Senior Level, and Scientific and Professional members and making written recommendations to the appointing authority on retention and compensation matters, including performance-based pay adjustments, awarding of bonuses, and reviewing recommendations for potential Presidential Rank Award nominees. The appointment of members to the NOAA PRB will be for a period of 2 years.
Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Data Reporting and Recordkeeping Under the Toxic Substances Control Act (TSCA); Change to Submission Period and Technical Correction
The Environmental Protection Agency (EPA or Agency) is proposing to amend the Toxic Substances Control Act (TSCA) regulation with reporting and recordkeeping requirements for perfluoroalkyl and polyfluoroalkyl substances (PFAS) that was finalized on October 11, 2023. The final rule requires manufacturers (including importers) of PFAS in any year between 2011-2022 to report certain information to EPA beginning November 12, 2024. EPA is proposing a one-time modification of the data submission period and a technical correction to amend a typographical error in the regulatory text. EPA is not proposing any changes to the scope of reporting under TSCA. EPA has concluded that a change to the submission period is necessary and in the public interest as the reporting application being developed to collect this data will not be fully functional by November 2024. The proposed revision of the submission period would facilitate compliance with the rule and help ensure that the collection includes accurate data on manufactured PFAS in the United States. EPA thus believes the proposed amendments are necessary and does not expect to receive any adverse comments. Therefore, in addition to this notice of proposed rulemaking, in the "Rules and Regulations" section of this issue of the Federal Register, EPA is promulgating the submission period modification and technical correction as a direct final rule. Endangered and Threatened Species; Notice of Initiation of a 5-Year Review for the Tanzanian Distinct Population Segment of African Coelacanth
NMFS announces the initiation of a 5-year review for the Tanzanian distinct population segment (DPS) of African coelacanth (Latimeria chalumnae). NMFS is required by the Endangered Species Act (ESA) to conduct 5-year reviews to ensure that the listing classifications of species are accurate. The 5-year review must be based on the best scientific and commercial data available at the time of the review. We request submission of any such information on the Tanzanian DPS of African coelacanth, particularly information on the status, threats, and recovery of the species that has become available since it was listed in 2016.

The Coast Guard is updating the location and description of a safety zone, and adding two annually recurring dates, for events at the Kemah Boardwalk Fireworks Display, in the Upper Galveston Bay in Kemah, Texas. The safety zone is needed to protect personnel vessels, and the marine environment from potential hazards created by the fireworks show. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Captain of the Port, Sector Houston- Galveston, or a designated representative.
