The Postal Service published in the Federal Register of February 24, 2009 (74 FR 8434), in accordance with 39 U.S.C. 3632(b)(2), a Notice document providing the February 3, 2009 Decision of the Governors of the United States Postal Service on Changes in Rates and Classes of General Applicability for Certain Competitive Products (Governors Decision No. 09-01), and a record of the proceedings in connection with the Decision. The Decision did not include planned increases to pickup on demand fees for Express Mail[supreg], Priority Mail[supreg], GXG, Express Mail International (EMI), and Priority Mail International (PMI) services to conform to the change in the Pickup on Demand TM service fee for Parcel Post[supreg] Single-Piece, which was raised in Postal Regulatory Commission Docket No. R2009-2 from $14.75 to $15.30. This document accordingly sets forth a correction to the prior notice to give effect to the planned change in Pickup on Demand fees for competitive services, to include Express Mail, Priority Mail, GXG, EMI, and PMI services.

The Board was re-established by the National Defense Authorization Act for Fiscal Year 2006, to hear and decide contract disputes relative to a contract entered into by the United States Postal Service or the Postal Regulatory Commission. In addition the Board has jurisdiction over other matters assigned to it by the Postmaster General, and over matters otherwise authorized by applicable law. The Board intends to issue final, revised rules after considering all comments on the proposed rules.

On January 29, 2009, the Postal Service published a proposed rule to provide mailing standards that would accompany new prices for mailing services in 2009 and 2010. Upon further review, the Postal Service has determined that it is appropriate to make certain changes in its initial proposal. In particular, language has been inserted to clarify that proposed new standards relating to static charge and coefficient of friction standards for automation and machinable letters would be recommended, not mandatory, and a proposal to revise the standards for window envelopes on letter-size envelopes has been removed. For purposes of clarity and convenience, the entire revised version of the proposed rule is being published for comment.

Rules of Practice in Proceedings Relative to Mailing Hazardous Materials

The Postal Accountability and Enhancement Act requires the Postal Service to prescribe regulations for the safe transportation of hazardous materials in the mail, and to prescribe regulations for the conduct of proceedings to determine the implementation of civil penalties, clean-up costs and damages for violations of these hazardous materials regulations. Accordingly, the Postal Service proposes to adopt new rules of practice for its Office of the Judicial Officer.

New Automation Requirements for Detached Addressed Labels

To make Detached Address Labels (DALs) accompanying saturation mailings of Periodicals or Standard Mail[reg] flats more compatible with our processing equipment, they must be automation-compatible and have a correct delivery point POSTNET(tm) barcode or Intelligent Mail[reg] barcode with an 11-digit routing code. This requirement does not apply to DALs with simplified addresses. Also, for consistency, we are requiring return addresses on DALs.
