Notice of Application for Special Permits
In accordance with the procedures governing the application for, and the processing of, special permits from the Department of Transportation's Hazardous Material Regulations (49 CFR Part 107, Subpart B), notice is hereby given that the Office of Hazardous Materials Safety has received the application described herein. Each mode of transportation for which a particular special permit is requested is indicated by a number in the ``Nature of Application'' portion of the table below as follows: 1Motor vehicle, 2Rail freight, 3Cargo vessel, 4Cargo aircraft only, 5Passenger-carrying aircraft.
Notice of Applications for Modification of Special Permit
In accordance with the procedures governing the application for, and the processing of, special permits from the Department of Transportation's Hazardous Material Regulations (49 CFR part 107, Subpart B), notice is hereby given that the Office of Hazardous Materials Safety has received the applications described herein. This notice is abbreviated to expedite docketing and public notice. Because the sections affected, modes of transportation, and the nature of application have been shown in earlier Federal Register publications, they are not repeated here. Requests for modification of special permits (e.g. to provide for additional hazardous materials, packaging design changes, additional mode of transportation, etc.) are described in footnotes to the application number. Application numbers with the suffix ``M'' denote a modification request. These applications have been separated from the new application for special permits to facilitate processing.
Special Permit Applications Actions
In accordance with the procedures governing the application for, and the processing of, special permits from the Department of Transportation's Hazardous Material Regulations (49 CFR part 107, subpart B), notice is hereby given of the actions on special permits applications in (February to February 2013). The mode of transportation involved are identified by a number in the ``Nature of Application'' portion of the table below as follows: 1Motor vehicle, 2Rail freight, 3Cargo vessel, 4Cargo aircraft only, 5Passenger-carrying aircraft. Application numbers prefixed by the letters EE represent applications for Emergency Special Permits. It should be noted that some of the sections cited were those in effect at the time certain special permits were issued.
Office of Hazardous Materials Safety; Delayed Applications
In accordance with the requirements of 49 U.S.C. 5117(c), PHMSA is publishing the following list of special permit applications that have been in process for 180 days or more. The reason(s) for delay and the expected completion date for action on each application is provided in association with each identified application.
Pipeline Safety: Information Collection Activities
In compliance with the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.), this notice announces that the information collection under Office of Management and Budget (OMB) Control No. 2137-0605, titled ``Integrity Management in High Consequence Areas for Operators of Hazardous Liquid Pipelines'' is being forwarded to OMB for review and comments. A Federal Register notice with a 60-day comment period soliciting comments on this information collection was published on December 13, 2012, (77 FR 74276) under docket number PHMSA-2012- 0302. No comments were received. The purpose of this notice is to allow the public an additional 30 days to send comments to OMB on the information collection as described below.
Safety Advisory: Unauthorized Marking of Compressed Gas Cylinders
This notice advises the public that PHMSA has confirmed the marking, service and/or sale of certain high pressure DOT specification cylinders marked with a requalification identification number (RIN) without performing a valid hydrostatic requalification test. Kraus Fire Equipment Co. marked DOT cylinders as tested without approval from the Associate Administrator to requalify DOT cylinders and without calibrating its required systems. This advisory addresses cylinders serviced or purchased from Flint Welding Supply Co, Flint, MI from approximately June 2010 to December 2012 and marked with an ``A978'' or a partial ``A978'' or just the Month/Year, without a RIN mark in the middle.
Hazardous Materials Packaging-Composite Cylinder Standards; Public Meeting
This notice is to advise interested persons that PHMSA will conduct a public meeting to provide further clarification regarding PHMSA's intent to modify certain special permits in accordance with 49 CFR 107.121. These special permits authorize the manufacture, marking, sale and use of non-DOT specification composite cylinders. The non-DOT specification cylinders authorized by PHMSA's special permits conform to the basic requirements for fiber reinforced plastic (DOT-FRP) or fully wrapped carbon-fiber reinforced aluminum lined cylinders (DOT- CFFC) standards. PHMSA believes that these special permits should be modified to reflect the appropriate International Standards Organization (ISO) standards for composite cylinders ISO 11119 Parts - 1, -2, -3 incorporated by reference into the Hazardous Materials Regulations (HMR).
Hazardous Materials; Miscellaneous Amendments (RRR)
PHMSA is amending the Hazardous Materials Regulations (HMR) to make miscellaneous amendments to update and clarify certain regulatory requirements. These amendments promote safer transportation practices, eliminate unnecessary regulatory requirements, address a petition for rulemaking, incorporate a special permit into the HMR, facilitate international commerce, and simplify the regulations. These amendments also update various entries in the Hazardous Materials Table (HMT) and corresponding special provisions, clarify the lab pack requirements for temperature-controlled materials, and require hazmat employers to make hazmat employee training records available upon request to an authorized official of the Department of Transportation (DOT) or an entity explicitly granted authority to enforce the HMR.
Pipeline Safety: Incident and Accident Reports
In December 2012, PHMSA revised forms PHMSA F 7100.2Incident ReportNatural and Other Gas Transmission and Gathering Pipeline Systems and PHMSA F 7000-1Accident ReportHazardous Liquid Pipeline Systems. These revised forms are now available for electronic submittal in the PHMSA Portal. As described in this notice, PHMSA requests supplemental reports to improve the quality of the incident and accident data.
Hazardous Materials: Miscellaneous Petitions for Rulemaking (RRR)
PHMSA is amending the Hazardous Materials Regulations in response to petitions for rulemaking submitted by the regulated community to update, clarify, or provide relief from miscellaneous regulatory requirements. Specifically, PHMSA is amending the recordkeeping and package marking requirements for third-party labs and manufacturers to assure the traceability of packaging; removing the listing for ``NA1203, Gasohol, gasoline mixed with ethyl alcohol, with not more than 10% alcohol''; harmonizing internationally and providing a limited quantity exception for Division 4.1, Self-reactive solids and Self-reactive liquids Types B through F; allowing smokeless powder classified as a Division 1.4C material to be reclassified as a Division 4.1 material; and providing greater flexibility by allowing the Dangerous Cargo Manifest to be in locations designated by the master of the vessel besides ``on or near the vessel's bridge'' while the vessel is in a United States port.
