The Department of Commerce (Commerce) is issuing this final rule to discontinue use of Form CD-492, Justification for Other Than Full and Open Competition, and to make an editorial change to the associated regulations. The purpose of the administrative rulemaking is to cease the requirement for acquisition teams to use a prescribed form to document justifications for other than full and open competition under the Federal Acquisition Regulation (FAR) and to make an editorial change to the regulatory text to correct a reference to Department legal review procedures by replacing the word "concurrence" with the word "review." Contracting Officers will be required to comply with the content requirements set forth in the FAR when documenting their determinations.

DoD is proposing revisions to implement requirements of section 1257 of the National Defense Authorization Act for Fiscal Year 2023. This statute prohibits assistance to entertainment projects such as feature motion pictures, episodic television programs, documentaries, and computer-based games that have complied or are likely to comply with a demand from the Government of the People's Republic of China (PRC), the Chinese Communist Party (CCP), or an entity under the direction of the PRC or the CCP, to censor the content of the project in a material manner to advance the national interest of the PRC. This proposed rule informs producers and production companies that request DoD assistance about the procedures needed to implement the restrictions imposed by section 1257. It includes a discussion of the information the Department will use to determine whether to assist or continue to assist an entertainment project. It also describes the DoD proposed certification process and includes two updated sample Production Assistance Agreements (PAA) implementing section 1257 provisions.

21st Century Cures Act: Establishment of Disincentives for Health Care Providers That Have Committed Information Blocking

This final rule implements the provision of the 21st Century Cures Act specifying that a health care provider determined by the HHS Inspector General to have committed information blocking shall be referred to the appropriate agency to be subject to appropriate disincentives set forth through notice and comment rulemaking. This rulemaking establishes, for certain health care providers, a set of appropriate disincentives using authorities under applicable Federal law.
