This document clarifies a term that appeared in the ``Declaration Under the Public Readiness and Emergency Preparedness Act for Medical Countermeasures Against COVID-19,'' including in the final notice published in the Federal Register on September 14, 2021, entitled ``Ninth Amendment to Declaration Under the Public Readiness and Emergency Preparedness Act for Medical Countermeasures Against COVID-19.'' Specifically, this document supplements the references to the Advisory Committee on Immunization Practices (ACIP) with references to the Centers for Disease Control and Prevention (CDC). This change is being made to clarify that what are commonly referred to as ``ACIP recommendations'' and ``ACIP standard immunization schedules'' are in fact recommendations and schedules made by the CDC after consultation with ACIP. The addition of ``CDC'' is also intended to recognize coverage of recommendations issued directly by the CDC. This clarification also applies to related guidance and opinions.

This final rule removes DoD's regulation concerning the Defense Logistics Agency Privacy Program. On April 11, 2019, the Department of Defense published a revised DoD-level Privacy Program rule, which contains the necessary information for an agency-wide privacy program regulation under the Privacy Act and now serves as the single Privacy Program rule for the Department. That revised Privacy Program rule also includes all DoD component exemption rules. Therefore, this part is now unnecessary and may be removed from the CFR.

On February 24, 2021, President Biden issued an Executive Order (E.O.) titled America's Supply Chains, which directs six Federal agencies to conduct a review of their respective industrial bases, with the objective to use this assessment to secure and strengthen America's supply chains. One of these directives is for the Secretary of Defense, in consultation with the heads of appropriate agencies, to submit a report on supply chains for the defense industrial base, including key vulnerabilities and potential courses of action to strengthen the defense industrial base. The effort will build on the E.O. report, Assessing and Strengthening the Manufacturing and Defense Industrial Base and Supply Chain Resiliency of the United States (released October 2018) and the Annual Industrial Capabilities Report, which is mandated by the Congress.

Clarification of Departmental Position on American Airlines-JetBlue Airways Northeast Alliance Joint Venture

By this notice, the U.S. Department of Transportation (DOT or Department) clarifies its position on the American Airlines (American) and JetBlue Airways (JetBlue) Northeast Alliance (NEA) joint venture agreements and the January 10, 2021 agreement between and among DOT, JetBlue and American (DOT Agreement) terminating the Department's review of the NEA, following the September 21, 2021 announcement of antitrust litigation by the U.S. Department of Justice (DOJ). The Department will work closely with DOJ should it seek data and documents that will help in the resolution of DOJ's action. The DOT Agreement remains in effect during the pendency of the DOJ litigation. The Department retains independent statutory authority to prohibit unfair methods of competition in air transportation to further its statutory objectives to prevent predatory or anticompetitive practices and to avoid unreasonable industry concentration.\1\ However, the Department intends to defer to DOJ, as the primary enforcer of Federal antitrust laws, to resolve the antitrust concerns that DOJ has identified with respect to the NEA. The Department also intends to stay the proceedings in a Spirit Airlines, Inc. (Spirit) formal complaint against the NEA's implementation while the DOJ action is pending. The Department will assess its next steps, if any, relating to the Spirit complaint and the NEA at the conclusion of the DOJ litigation.

The Department intends these revisions to provide greater clarity to entities seeking documents or testimony from current or former Department employees. Specifically, these revisions would clarify, update, and streamline the language of several provisions, provide greater transparency regarding the factors that the agency will consider when reviewing such requests, and more directly address issues that frequently arise in requests for documents or testimony based on the facts of the request, such as whether the testimony requested is that of a former employee, whether the United States is a party to the underlying legal proceedings, or whether the testimony or documents are requested from the Office of the Inspector General.

America's Supply Chains and the Transportation Industrial Base

On February 24, 2021, President Biden issued an Executive Order, ``America's Supply Chains,'' which directs several Federal agency actions to secure and strengthen America's supply chains. On June 8, 2021, the President also established a Supply Chain Disruptions Task Forceco-chaired by the Secretaries of Transportation, Agriculture, and Commerceto address near term supply chain challenges, with a focus on alleviating bottlenecks and supply constraints in the transportation sector, particularly for ports, rail, and trucking. The Executive Order requires the Secretary of Transportation to submit, within one year, a report to the President on supply chains for the transportation industrial base. DOT's one-year assessment will build off the work of the Supply Chains Disruption Task Force and focus on the freight and logistics sector, with the goal of strengthening resilience among transportation supply chains. This notice requests information from the public to assist the Department of Transportation in preparing the report required by the Executive Order and solicits practical solutions from a broad range of stakeholders to address current and future challenges to supply chain resilience in the freight and logistics sector.
