In accordance with the Privacy Act of 1974, the Department of Homeland Security is giving notice that it will retire the following Privacy Act system of records notice, Department of Homeland Security/ Transportation Security Administration-012 Transportation Worker Identification Credentialing System (September 24, 2004, 69 FR 57348), which was written to cover the Prototype Phase of the Transportation Worker Identification Credentialing Program to authorize unescorted entry to secure transportation areas. These records were destroyed in accordance with the applicable records retention schedule, with the following exceptions: (1) Records for individuals who were an actual match to a government watchlist; and (2) records for individuals who were a close match but subsequently cleared as not posing a potential or actual threat to transportation. This notice reflects that these two categories of records from the Transportation Worker Identification Credentialing Prototype Phase must continue to be retained in accordance with the applicable records retention schedule, and will be maintained under the authority of the Department of Homeland Security/ Transportation Security Administration-002 Transportation Security Threat Assessment System System of Records (May 19, 2010, 75 FR 28046), which covers the Security Threat Assessment process associated with the Transportation Worker Identification Credentialing and other Transportation Security Administration vetting programs.

On October 1, 2012, the Department published a final rule requesting comment at 77 FR 59793 to clarify the priorities and allocation authorities exercised by the Secretary of Transportation (Secretary) under title I of the Defense Production Act of 1950 and to establish the administrative procedures by which the Secretary will exercise this authority. In the final rule, the Department requested comment on certain revised definitions found in 49 CFR 33.20. No comments were received by the comment closing date of October 31, 2012. As a result, this document confirms that the October 1 final rule will not be changed and its effective date is November 30, 2012.

Notice is hereby given that the Office of Research Integrity (ORI) has taken final action in the following case: Eric J. Smart, Ph.D., University of Kentucky: Based on the report of an investigation conducted by the University of Kentucky (UK) and additional analysis conducted by ORI in its oversight review, ORI found that Dr. Eric J. Smart, former Professor of Pediatrics and Physiology, Department of Pediatrics and Physiology, UK, engaged in research misconduct in research supported by National Heart, Lung, and Blood Institute (NHLBI), National Institutes of Health (NIH), grants R01 HL062844, R01 HL058475, R01 HL064056, R01 HL068059, and R01 HL073693, National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK), NIH, grant R56 DK063025, and National Center for Research Resources (NCRR), NIH, grant P20 RR105592. ORI found that the Respondent engaged in research misconduct by falsifying and/or fabricating data that were included in ten (10) published papers, one (1) submitted manuscript, seven (7) grant applications, and three (3) progress reports over a period of ten (10) years. Respondent reported experimental data for knockout mice that did not exist in five (5) grant applications and three (3) progress reports and also falsified and/or fabricated images in 45 figures included in the following:

Under the provisions of section 724 of the National Defense Authorization Act for Fiscal Year 2010 (Pub. L. 111-84), the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.50(a), the Department of Defense gives notice that it is renewing the charter for the Department of Defense Task Force on the Care, Management, and Transition of Recovering Wounded, Ill, and Injured Members of the Armed Forces (hereafter referred to as ``the Task Force''). The Task Force is a non-discretionary federal advisory committee that shall (a) assess the effectiveness of the policies and programs developed and implemented by the Department of Defense (DoD), and by each of the Military Departments, to assist and support the care, management, and transition of recovering wounded, ill, and injured members of the Armed Forces; and (b) make recommendations for the continuous improvements of such policies and programs. Pursuant to section 724(c) of Public Law 111-84, the Task Force shall, no later than 12 months after the date on which all Task Force members have been appointed and each year thereafter for the life of the Task Force, submit an annual report to the Secretary of Defense on the activities of the Task Force and on the activities of the DoD, to include the Military Departments, to assist and support the care, management, and transition of recovering wounded, ill, and injured members of the Armed Forces. At a minimum, the Task Force's report shall include the following: a. The Task Force's findings and conclusions as a result of its assessment of the effectiveness of developed and implemented DoD policies and programs, to include those of the Military Departments, to assist and support the care, management and transition of recovering wounded, ill, and injured members of the Armed Forces. b. A description of best practices and various ways in which the DoD, to include the Military Departments, could more effectively address matters relating to the care, management, and transition of recovering wounded, ill, and injured members of the Armed Forces, including members of both the Regular and the Reserve Components, and support for their families. c. A plan listing and describing the Task Force's activities for the upcoming year covered by its annual report. d. Such recommendations for other legislative or administrative action as the Task Force considers appropriate for measures to improve DoD-wide policies and programs in (a) above.

Under the provisions of 5 CFR 532, Federal Wage System (Pub. L. 92-392), the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.50(c), the Department of Defense (DoD) gives notice that it is reestablishing the charter for the Department of Defense Wage Committee (hereafter referred to as ``the Committee''). The Committee is a discretionary federal advisory committee that shall provide the Secretary and the Deputy Secretary of Defense, through the Under Secretary of Defense for Personnel and Readiness (USD(P&R)), independent advice and recommendations on all matters relating to the conduct of wage surveys and the establishment of wage schedules for all appropriated fund and non-appropriated fund wage areas of blue-collar employees within the DoD. The Committee shall report to the Secretary and Deputy Secretary of Defense, through the USD(P&R). The USD(P&R) may act upon the Committee's advice and recommendations. The Committee, consistent with 5 CFR 532.227, shall be comprised of seven membersa chairperson and six additional members. Committee members shall be appointed by the Secretary of Defense and their appointments will be renewed on an annual basis. Those members, who are not full-time or permanent part-time Federal officers or employees, shall be appointed to serve as experts and consultants under the authority of 5 U.S.C. Sec. 3109 and serve as special government employees. Each Committee member is appointed to provide advice on behalf of the government on the basis of his or her best judgment without representing any particular point of view and in a manner that is free from conflict of interest. With the exception of travel and per diem for official Committee related travel, Committee members shall serve without compensation, unless authorized by the Secretary of Defense. The Secretary of Defense may approve the appointment of Committee members for one-to-two year terms of service, with annual renewals; however, no member, unless authorized, by the Secretary of Defense, may serve more than two consecutive terms of service. The Department, when necessary, and consistent with the Committee's mission and DoD policies/procedures, may establish subcommittees to support the Committee. Establishment of subcommittees will be based upon a written determination, to include terms of reference, by the Secretary of Defense, or the Committee's sponsor. These Subcommittees shall not work independently of the chartered Committee, and shall report all their recommendations and advice to the Committee for full deliberation and discussion. Subcommittees have no authority to make decisions on behalf of the chartered Committee; nor can any subcommittee or its members update or report directly to the DoD or any Federal officers or employees. All subcommittee members shall be appointed in the same manner as the Committee members; that is, the Secretary of Defense shall appoint subcommittee members even if the member in question is already a Committee member. Subcommittee members, with the approval of the Secretary of Defense, may serve a term of service on the Subcommittee of one to four years; however, no member shall serve more than two consecutive terms of service on the Subcommittee, unless authorized by the Secretary of Defense. Subcommittee members, if not full-time or part-time government employees, shall be appointed to serve as experts and consultants under the authority of 5 U.S.C. Sec. 3109, and shall serve as special government employees, whose appointments must be renewed by the Secretary of Defense on an annual basis. With the exception of travel and per diem for official Committee-related travel, Subcommittee members shall serve without compensation. All subcommittees operate under the provisions of FACA, the Government in the Sunshine Act, governing Federal statutes and regulations, and governing DoD policies/procedures.

The Office of the Secretary is announcing that the Secretarial Commission on Indian Trust Administration and Reform (the Commission) will hold a public meeting on December 6 and 7, 2012. During the public meeting, the Commission will hear from invited speakers about: management and administration of probate and real estate services administered through compacts and contracts; management and administration of natural resources held in trust; and trust reform, including other trust models and the trust relationship. The meeting will allow the Commission to gain insights and perspectives from members of the public. The Commission will also be hosting a youth outreach session on the evening of December 6, 2012, on the University of Washington campus to meet with young adults and college students on their ideas and recommendations to improve performance and services to trust beneficiaries.

Pursuant to the provisions of the Privacy Act of 1974, as amended, the Department of the Interior is issuing a public notice of its intent to create the Department of the Interior system of records titled, ``Donations Program Files.'' This system will assist the Department of the Interior in managing the Donations Program and facilitating the acceptance and solicitation of donations of money, real property, personal property, services, or other gifts by members of the public and organizations. This newly established system will be included in the Department of the Interior's inventory of Privacy Act records systems.
