The Office of the Secretary of the Department of Agriculture is providing notice of the establishment of the fiscal year (FY) 2011 in-quota aggregate quantity of the raw, as well as, refined and specialty sugar Tariff-Rate Quotas (TRQ) as required under the U.S. World Trade Organization (WTO) commitments. The FY 2011 raw cane sugar TRQ is established at 1,117,195 metric tons raw value (MTRV) that may be entered under subheading 1701.11.10 of the U.S. Harmonized Tariff Schedule (HTS) during FY 2011 (October 1, 2010-September 30, 2011). In addition, the in-quota aggregate quantity of the refined and specialty sugar TRQ is established at 99,111 MTRV for certain sugars, syrups, and molasses (collectively referred to as refined sugar) that may be entered under subheadings 1701.12.10, 1701.91.10, 1701.99.10, 1702.90.10, and 2106.90.44 of the HTS during FY 2011.

HHS is issuing this delayed update due to recent legislation that prohibited the Secretary of HHS from publishing 2010 poverty guidelines before May 31, 2010, and required that the 2009 poverty guidelines remain in effect until the Secretary of HHS published updated guidelines.

The Department of Health and Human Services (HHS) is issuing this final rule to complete the adoption of an initial set of standards, implementation specifications, and certification criteria, and to more closely align such standards, implementation specifications, and certification criteria with final meaningful use Stage 1 objectives and measures. Adopted certification criteria establish the required capabilities and specify the related standards and implementation specifications that certified electronic health record (EHR) technology will need to include to, at a minimum, support the achievement of meaningful use Stage 1 by eligible professionals, eligible hospitals, and/or critical access hospitals (hereafter, references to ``eligible hospitals'' in this final rule shall mean ``eligible hospitals and/or critical access hospitals'') under the Medicare and Medicaid EHR Incentive Programs. Complete EHRs and EHR Modules will be tested and certified according to adopted certification criteria to ensure that they have properly implemented adopted standards and implementation specifications and otherwise comply with the adopted certification criteria.

The U.S. Department of Transportation requires U.S. air carriers to submit their recurrent financial, traffic, operational and consumer data reports electronically via the Internet using the comma separated value (CSV) file format or a PDF file for reports that are not entered into a database such as signed certifications, transmittal letters, and annual reports. This rule will enhance security of the data submissions, eliminate air carriers' fax and mailing costs, eliminate the need for the Department to manually enter hardcopy data submissions, and provide reporting air carriers with immediate notification and a receipt from the Department that the report was received. This action is taken on the Department's initiative.

Notice is hereby given that the Office of Research Integrity (ORI) and the Assistant Secretary for Health have taken final action in the following case: Gerardo L. Paez, PhD, University of Pennsylvania: Based on the reports of an inquiry and an investigation conducted by the University of Pennsylvania (UP) and analysis conducted by the ORI Division of Investigative Oversight (DIO), ORI found that Gerardo L. Paez, PhD, former postdoctoral fellow, Section of Medical Genetics, UP School of Veterinary Medicine, engaged in research misconduct in research supported by National Eye Institute (NEI), National Institutes of Health (NIH), awards R01 EY06855 and R01 EY13132. ORI found that the Respondent engaged in research misconduct by falsifying and fabricating retinal gene profile data that he purportedly obtained from three-week old normal dogs and dogs with X- linked progressive retinal atrophy. Specifically, ORI found that: 1. Respondent committed research misconduct by falsifying/ fabricating data for gene expression profiles in retinal tissue from three-week old normal dogs and dogs with X-linked progressive retinal atrophy in abstracts and poster presentations for the 2006 \1\ and 2007 \2\ Association for Research in Vision and Ophthalmology (ARVO) meetings and in an unsubmitted manuscript draft.\3\

The Department of Homeland Security is giving concurrent notice of an updated and reissued system of records pursuant to the Privacy Act of 1974 for the Department of Homeland Security/ALL029 Civil Rights and Civil Liberties Records System of Records and this proposed rulemaking. In this proposed rulemaking, the Department proposes to exempt portions of the system of records from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements.
