TRICARE; Revision of Participating Providers Reimbursement Rate; TRICARE Dental Program (TDP)

The Department is publishing this proposed rule to revise the requirements and procedures for the reimbursement of TRICARE Dental Program participating providers. Participating providers will no longer be reimbursed at the equivalent of a percentile of prevailing charges sufficiently above the 50th percentile of prevailing charges made for similar services in the same locality (region) or state, or the provider's actual charge, whichever is lower, less any cost-share amount due for authorized services. Specifically, the revision will require TRICARE Dental Program participating providers to be reimbursed in accordance with the contractor's network agreements, less any cost- share amount due for authorized services. Public comments are invited and will be considered for possible revisions to the final rule.

Final Decisions Regarding Self-Determination and Self-Governance Funding Agreement Language on Fiduciary Trust Records Management

This notice announces the final decision regarding Self- Determination and Self-Governance language to be negotiated into funding agreements for 2006 regarding fiduciary trust records management. The Federal Register notice published on February 2, 2005 (70 FR 5457) presented a proposed policy on fiduciary trust records management for Self-Determination (Title I) and Self-Governance (Title IV) Tribes/Consortia and language to be negotiated into 2006 Title I and Title IV funding agreements. The February 2, 2005, notice also announced three consultation meetings and an invitation to submit written comments on the proposed policy and funding agreement language. Final Decision: After reviewing numerous comments and suggestions, both written and oral, the Department decided not to institute the proposed policy on fiduciary trust records management for Title I and Title IV Tribes/Consortia; rather, the Department will negotiate with each Tribe/Consortium a specific section in the funding agreement that addresses Tribe's/Consortium's and the Secretary's respective responsibilities regarding the management of fiduciary trust records. This specific section will include the definition of ``fiduciary trust records,'' ``Indian trust assets,'' and ``management.'' The language to be negotiated into the 2006 Title I and Title IV funding agreements regarding fiduciary trust records management is the following and will replace the three options used in the past. The Tribe/Consortium and Secretary agree to the following: The Tribe/Consortium agrees to: (a) Preserve, protect and manage all fiduciary trust records, created and/or maintained by the Tribes/Consortia during their management of trust programs in their Title IV agreements. (A fiduciary trust record is any document that reflects the existence of an Indian trust asset and was used in the management of an Indian trust asset. An Indian trust asset refers to lands, natural resources, monies or other assets held in trust at a particular time by the Federal Government for a Tribe, Alaska natives or that are or were at a particular time restricted against alienation, for individual Indians. Management includes actions that influence, affect, govern, or control an Indian trust asset. The following are examples not considered to be fiduciary trust records: General administrative, personnel or travel records; education records; law enforcement records; health records; law making unrelated to Indian trust assets; tribal council resolutions and laws unrelated to Indian trust assets; and tribal elections.) (b) Make available to the Secretary all fiduciary trust records maintained by the Tribe/Consortium, provided that the Secretary gives reasonable oral or written advance request to the Tribe/Consortium. Access shall include visual inspection and, at the expense of the Secretary, the production of copies (as agreed upon between the parties), and shall not include the removal of the records without tribal approval; and (c) Store and permanently retain all inactive fiduciary trust records at the Tribe/Consortium or allow such records to be removed and stored at the American Indian Records Repository (AIRR) in Lenexa, Kansas, at no cost to the Tribe/Consortium. The Secretary agrees to: (a) Allow the Tribe/Consortium to determine what records it creates to implement the trust programs assumed under its Title IV agreement, except that the Tribe/Consortium must create and maintain the information required by statute and regulation. No additional record keeping requirements are required by this agreement. (b) Store all inactive fiduciary trust records at the American Indian Records Repository (AIRR) at no cost to the Tribe/Consortium when the Tribe/Consortium no longer wishes to keep the records. Further, the Tribe/Consortium will retain legal custody and determine access to these records. Such records shall not be treated as Federal records for purposes of chapter 5 of Title 5 of the United States Code unless expressly agreed to by the Tribe; (c) Create and manage a single tribal storage and retrieval system for all fiduciary trust records stored at AIRR (No records will be accepted at AIRR until such a retrieval system exists); and (d) Provide filing equipment and technical assistance for Tribes/ Consortia in preserving, protecting and managing their fiduciary trust records from available funds appropriated for this purpose. Summary of Comments: The final decision above is the result of a nearly 2-year consultation process by the Department with some Title I and IV Tribes/Consortia. This process included: Conducting pre-scoping telephone conversations with tribal leaders, staff and consultants; holding a scoping meeting as part of a 2-day conference on Indian trust records management at Haskell Indian Nations University; forming a Tribal Fiduciary Trust Records Management Workgroup; conducting four workgroup meetings; transmitting a tribal leader letter soliciting comments on the proposed policy language to be presented for consultation; and engaging in discussions with Tribal leaders and staff at the Fall 2004, Self-Governance Conference. This process culminated with three consultation meetings held in Nashville, Tennessee; Portland, Oregon; and Phoenix, Arizona that were attended by approximately 60 tribal leaders, staff and consultants. In addition, written comments were received from 14 tribes, tribal organizations or tribal consultants some of whom attended the consultation meetings. The comments received can be grouped into the following four major categories: Category 1: New funding agreement language is not needed because existing compact and funding agreement language sufficiently provides for the maintenance of records of trust programs managed by the Tribes/ Consortia, and Tribes/Consortia should not be required to implement a Federal policy on fiduciary trust records management through their funding agreements. The Department respectfully disagrees. The Department believed that the three options available to Tribes/ Consortia in the past are too vague and do not specifically address the Secretary's primary concerns that fiduciary trust records not be destroyed and that the Secretary have the right to access those records if needed in her capacity as trustee delegate. The Department does agree with the comments that a Federal policy does not need to be instituted through the Departmental Manual. Instead the Department has chosen to negotiate language with each Tribe/Consortium into its funding agreement to address fiduciary trust records management. Category 2: The definition of ``fiduciary trust records'' is too broad and vague and the Department should produce a specific list of what fiduciary trust records should be maintained and preserved by the Tribe/Consortium. The definition is purposely broad in recognition of tribal sovereignty. It allows Tribes/Consortia the flexibility to create those records they believe are necessary to properly manage their trust assets through their Title I or Title IV funding agreements. For the Department to create a list of fiduciary trust records would have been both overly restrictive for some Tribes/ Consortia and overly expansive for others. A Department-generated list to be used by all Tribes/Consortia would have been restrictive in that it could deter tribes from creating certain records they feel were appropriate and at the same time it could be expansive by ``requiring'' Tribes/Consortia to create fiduciary trust records they did not believe were necessary for effective management of their trust assets. The Department's concern is that whatever trust records are created be properly protected and available to the Secretary. Category 3: The funding agreement language creates an unfunded mandate because no funding is being provided, and the language requires Tribes/Consortia to maintain record facilities and administer and monitor a records policy. The Department believes that the language proposed for negotiation does not require Tribes/Consortia to create and keep any additional records beyond those they now keep; namely, those that are required by statute or regulation or those records the Tribe/Consortium chooses to create in the management of its own trust resources. The language does not require a tribe to have any other kind of record keeping system other than the ones they currently operate. Before becoming a Title I or Title IV Tribe/Consortium, a Tribe/ Consortium had to demonstrate that it had a functional record keeping system and this language does not expand that requirement. Further, while the language does indicate that Tribes/Consortia are to preserve, protect and manage all fiduciary trust records and that all fiduciary trust records are to be kept permanently, once the Tribe/Consortium chooses that it no longer wants to house their inactive fiduciary trust records at their facility, the Secretary has offered to store those records, at the Secretary's expense, at the American Indian Records Repository. Finally, the Secretary is willing to provide to the Tribes/ Consortia equipment, training and technical assistance, subject to availability of appropriated funds for that purpose. Category 4: A potential problem exists for Tribes/Consortia in storing records at AIRR in that outside interests might gain access to Tribal/Consortium trust records through the Freedom of Information Act because the Tribal/Consortium trust records are held on the Tribe's/ Consortium's behalf by the Department in a Federal facility. To accommodate this concern, language was inserted stating that the Tribe/ Consortium retains legal custody and determines access to those records. Further, language was inserted stating that such records shall not be treated as Federal records for purposes of chapter 5 of Title 5 of the United States Code, unless expressly agreed to by the Tribe.

Pursuant to the provisions of the Federal Advisory Committee Act, notice is hereby given of meetings of the Invasive Species Advisory Committee. The purpose of the Advisory Committee is to provide advice to the National Invasive Species Council, as authorized by Executive Order 13112, on a broad array of issues related to preventing the introduction of invasive species and providing for their control and minimizing the economic, ecological, and human health impacts that invasive species cause. The Council is Co-chaired by the Secretary of the Interior, the Secretary of Agriculture, and the Secretary of Commerce. The duty of the Council is to provide national leadership regarding invasive species issues. The purpose of a meeting on October 11-13, 2005 is to convene the full Advisory Committee; and to discuss implementation of action items outlined in the National Invasive Species Management Plan, which was finalized on January 18, 2001.

Additionally, those who wish to make oral comments or deliver written comments should also request to be scheduled, and submit a written text of the comments by August 26, 2005, to allow time for distribution to Task Force members prior to the meeting. Individual oral comments will be limited to five minutes, with the total oral comment period not exceeding 15 minutes. Due to critical mission requirements and the short timeframe to accomplish this review, there was insufficient time to provide timely notice required by section 10(a)(2) of the Federal Advisory Committee Act and subsection 102-3.150(b) of the GSA Final Rule on Federal Advisory Committee Management, 41 CFR 102-3.150(b), which further requires publication at least 15 calendar days prior to the meeting.

The Department of Defense (DoD) is revising the DoD Grant and Agreement Regulations (DoDGARs) to implement four Office of Management and Budget (OMB) policy directives, to conform the DoDGARs with several statutory and regulatory revisions, and to make other administrative changes. The four OMB directives that are being implemented: require Federal agencies to use a new standard format for announcements of funding opportunities; require Federal agencies to electronically post synopses of those announcements at a Governmentwide Internet site; require Governmentwide use of the Data Universal Numbering System (DUNS) number as the universal identifier for recipient organizations; and amend OMB Circular A-B3 to raise the threshold of Federal funding at which recipients must obtain single audits. The statutory and regulatory changes with which the DoDGARs are being conformed concern matters such as nonprocurement debarment and suspension, drug-free workplace requirements for grants, and campus access for military recruiters and Reserve Officer Training Corps.

The General Assembly and Governor of the State of Indiana have asked the Department of Transportation (DOT) to initiate proceedings to hold hearings in the appropriate locations in Indiana on the issue of the location of the boundary between the Eastern and Central Time Zones in Indiana. The General Assembly and Governor did not, however, take a position on where the boundary should be. This notice initiates those proceedings and invites local officials in Indiana that wish to change their current time zone in accordance with Indiana Senate Enrolled Act 127 (the Act) to notify DOT of their request for a change. Provided that the submitted petition(s) affirmatively ask for a specific change and provide adequate supporting data, DOT will issue a notice of proposed rulemaking (NPRM), which will solicit public comment, and schedule public hearings on the proposed time zone boundary change. The notice also announces the opening of an internet-accessible, public docket to receive any petitions and other relevant documents concerning the appropriate placement of the time zone boundary in the State of Indiana. The Department recognizes the importance of the time zone boundaries to residents of the State of Indiana and will consider the information it receives in a timely manner.
Combating Exploitive Child Labor Through Education in Indonesia and Nepal

The U.S. Department of Labor (USDOL), Bureau of International Labor Affairs (ILAB), intends to award USD 2.5 million through a sole source cooperative agreement to Save the Children Federation Inc. (STC), a U.S.-based non-profit organization. This funding will be used over a four-year period to support the current STC project in Indonesia, ``Enabling Communities to Combat Child Trafficking through Education,'' by extending project activities in the earthquake and tsunami stricken region of Aceh and to bring USDOL funded child labor activities in Indonesia to a successful completion. USDOL also intends to award USD 3.5 million through a sole source cooperative agreement to World Education, Inc., a U.S.-based non-profit organization. This funding will support a four-year second phase of World Education's ``Brighter Futures Program: Combating Child Labor in Nepal through Education,'' because the activity to be funded is essential to the satisfactory completion of this project. ILAB is authorized to award and administer this program by the Consolidated Appropriations Act, 2005, Pub. L. 108-447, 118 Stat. 2809 (2004), which provided funding for USDOL to improve access to basic education in international areas with a high rate of abusive and exploitative child labor through the Child Labor Education Initiative (EI) grant program. Since 1995, USDOL has awarded grants to commercial, international, and non-governmental organizations working to eliminate the worst forms of child labor through the provision of basic education. The cooperative agreements awarded under this initiative will be managed by ILAB's International Child Labor Program to assure achievement of the awards' stated goals. Indonesia: ILAB finds STC uniquely qualified to implement a major program to rapidly restore the educational sector in Aceh and thereby reduce children's vulnerability to trafficking and other forms of exploitation. STC has worked in Indonesia for over 30 years and was one of the leaders of the tsunami emergency response effort in Aceh due to its long-standing presence in the region. The target groups of children in Aceh include children being exploited through work in the worst forms of child labor and those at-risk of entering such work, including conscription into fighting in the civil conflict, and working in the agriculture and fishing sectors in the reconstruction effort. STC is uniquely qualified by virtue of its institutional and contextual knowledge of Indonesia; its familiarity and strong networks with local officials, organizations, and support groups; its pre- existing presence in Aceh and unparalleled experience providing assistance to the region; its extensive working relationships with the targeted communities; its readily available personnel and facilities; and its experience with USDOL reporting and administrative requirements. Additionally, through their previous work and tsunami relief in Aceh, STC has already laid the groundwork for an expansion of the ENABLE project activities and have identified sources of counterpart funding that will multiply the impact of the USDOL investment. The range of services provided by STC includes innovative methods to increase access to formal and non-formal education; generate public awareness; return, rehabilitate, and reintegrate trafficked children; and build capacity at all levels. USDOL's experience working with STC began in the summer of 2004, when STC submitted proposals to USDOL in response to solicitations for grant applications under the EI. As a result of the competitive processes, USDOL entered into two cooperative agreements with STC to implement EI projects, including one in Indonesia. Activities completed as part of the current Indonesian project include securing the support and involvement of the government at the national, provincial and district levels; laying the ground work for the return, recovery and reintegration aspect of the program; and signing of a Memorandum of Understanding with the Police hospital to establish the Medical Recovery Center for victims of trafficking. However, Aceh was not included as one of the initial target areas in the original cooperative agreement due to the civil conflict and restrictions placed by the government on foreign assistance in the region. The government has since removed the restrictions, in part due to concerns about trafficking in the post-tsunami environment. Timely provision of services in Aceh is crucial due to the fragile environment created by the trauma and displacement of the tsunami and the ongoing civil conflict. Given STC's longstanding presence and quality work in the region, strong existing on-the-ground relationships, existing solid foundation and counterpart funding for additional activities, and innovative education delivery methods, USDOL finds STC uniquely qualified for this sole-source award and deems it highly capable of providing timely and effective services in Aceh. The awarding of further USDOL support to STC will allow the program to expand its geographic coverage into Aceh and build on existing activities to rebuild and strengthen the education system in Aceh as a means of reducing children's vulnerability to the worst forms of child labor and trafficking. Nepal: ILAB finds World Education uniquely qualified to perform the program activities in Nepal on a national scale. As a direct educational service provider in Nepal, World Education has a high level of technical expertise in education and administrative oversight capabilities required to work with local implementing partners in targeted districts throughout Nepal. With an extensive network of working relationships with the government, donors, local partners and communities, and district education authorities in Nepal, World Education possesses a unique ability to implement a comprehensive program of direct services to the intended target group of children. This group is comprised of children working in the worst forms of child labor and those at-risk of entering such work, including domestic service, rag picking (recycling), portering, mining and quarrying, brick manufacturing, bus transportation, bonded labor, as well as those children trafficked for labor and sexual exploitation. The range of services of World Education's Brighter Futures Program includes development of a flexible, modular non-formal education curriculum and schooling program for child laborers; accelerated learning and transition to formal school; practical skills training programs and apprenticeships; psychosocial and career counseling; improved access and quality of the formal education system through parent-teacher association and community/school management committee development; training of teacher trainers; ongoing collection of baseline data to design well-targeted interventions and track the performance of program beneficiaries; and advocacy for the inclusion of child labor issues in national education programs. USDOL's experience working with World Education in Nepal began in 2002, when World Education submitted a proposal to USDOL in response to a solicitation for grant application under the EI. As a result of that competitive procurement process, USDOL entered into a cooperative agreement with World Education to implement the current EI project in Nepal called the Brighter Futures Program. World Education's innovative approach in working with communities to provide quality education and increase access to schooling through capacity building and strengthening of parent-teacher associations and community/school management committees has proven effective. As of early 2005, World Education has provided, or was in the process of providing, educational services to 21,857 children removed from the worst forms of child labor, exceeding its original program target of 17,000 children. Over 14,000 children at-risk of entering exploitative labor have also received one or more services through the program. Given World Education's demonstrable ability to deliver quality services in a complex implementing environment, its extensive local partnerships throughout many districts of Nepal, and its ability to work with communities to address the problem of child labor, USDOL finds World Education to be uniquely qualified for this sole source award. Further USDOL support to World Education will allow the Brighter Futures Program time to strengthen and expand activities undertaken through the current project to ensure sustainability of the project's objectives after it is completed. We are amending the administrative regulations of the Office of the Secretary of Agriculture to provide that the rules of practice contained in those administrative regulations shall be applicable to adjudicatory proceedings under the Animal and Plant Health Inspection Service's regulations pertaining to the commercial transportation of equines to slaughtering facilities. This final rule is necessary to clarify the rules of practice that will apply to the adjudication of a violation of regulations pertaining to the commercial transportation of equines to slaughtering facilities.

By Order 2005-7-15, served on July 20, 2005, the Department tentatively concluded that Executive Jet Management, Inc. is fit, willing, and able to provide scheduled passenger operations as a commuter air carrier under 49 U.S.C. 41738, and should be issued commuter air carrier authority, subject to conditions. At that time, we directed interested parties to file objections no later than 14 days after the service date of the order (i.e., August 3, 2005). Subsequently, the Department published a Notice in the Federal Register on July 21, 2005, inadvertently directing all interested parties wishing to file objections to do so by August 29, 2005. In order to correct this administrative error, while, at the same time, providing interested parties with a suitable period of time to file comments, we find it appropriate to direct persons wishing to file objections to our tentative decision to so by August 15, 2005.
