Public Protective Actions During a General Emergency
The U.S. Nuclear Regulatory Commission (NRC) has received a petition for rulemaking from Thomas McKenna, dated June 1, 2020. The petitioner requests that the NRC revise its regulations so that protective actions implemented during a General Emergency at a nuclear power plant will most likely do more good than harm when the possible physical health effects of radiation exposure and protective actions are taken into consideration. The petition was docketed by the NRC on June 24, 2020, and has been assigned Docket No. PRM-50-123. The NRC is examining the issues raised in PRM-50-123 to determine whether they should be considered in rulemaking. The NRC is requesting public comment on this petition at this time.
In the Matter of Joseph Shea, Tennessee Valley Authority, Chattanooga, TN
The U.S. Nuclear Regulatory Commission (NRC) is issuing an Order prohibiting involvement in NRC-licensed activities to Mr. Joseph Shea, Vice President Nuclear Technology Innovation at Tennessee Valley Authority (TVA), for 5 years. The NRC has determined that Mr. Joseph Shea engaged in deliberate misconduct when he played a significant role in the decisionmaking process to place a former employee on paid administrative leave on October 15, 2018 and terminate the former employee on January 14, 2019, in part, for engaging in protected activity. The Order is effective on the date of issuance.
Information Collection: NRC Form 446, “Request for Approval of Official Foreign Travel By Non-Government Personnel”
The U.S. Nuclear Regulatory Commission (NRC) invites public comment on this proposed collection of information. The information collection is entitled NRC Form 446, ``Request for Approval of Official Foreign Travel By Non-Government Personnel.'' The information will be collected from non-government personnel who are not travelling under the authority of an existing contract but are traveling to a foreign country on behalf of the NRC on official business. Providing the information will be voluntary but if not provided, the request for approval of foreign travel may be denied.

Criteria for Development of Evacuation Time Estimate Studies (NUREG/CR-7002, Revision 1)
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft NUREG, NUREG/CR-7002, ``Criteria for Development of Evacuation Time Estimate Studies,'' Revision 1. This draft NUREG provides guidance to meet NRC requirements for development of evacuation time estimates (ETEs) to support emergency planning. This revision reflects the importance of various ETE model parameters based on the results of an applied research study on ETEs. The format and criteria provided in this document will support consistent application of the ETE methodology and will facilitate consistent NRC review of ETE studies. The NRC is soliciting public comment on the contemplated action and invites stakeholders and interested persons to participate. The NRC plans to hold a public meeting to promote full understanding of the contemplated action and facilitate public comment.
Issuance of Multiple Exemptions in Response to COVID-19 Public Health Emergency
The U.S. Nuclear Regulatory Commission (NRC) issued 13 exemptions in response to requests from 12 licensees. The exemptions allow these licensees temporary relief from certain requirements under NRC regulations. The exemptions are in response to the coronavirus disease 2019 (COVID-19) public health emergency (PHE). The NRC is issuing a single notice to announce the issuance of the exemptions.
NextEra Energy Point Beach, LLC, Point Beach Nuclear Plant, Unit 1
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Renewed Facility Operating License No. DPR- 24, issued to NextEra Energy Point Beach, LLC, for operation of the Point Beach Nuclear Plant, Unit 1. The proposed amendment would modify renewed facility operating license condition 4.I, ``Containment Building Construction Truss,'' by extending elements of the license condition on a one-time basis for another 18 months to the spring of 2022. The one-time extension is requested due to unforeseen issues as a result of the Coronavirus Disease 2019 public health emergency.

Biweekly Notice; Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration (NSHC), notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all amendments issued, or proposed to be issued, from July 28, 2020, to August 10, 2020. The last biweekly notice was published on August 11, 2020.
Accident Source Term Methodologies and Corresponding Release Fractions
The U.S. Nuclear Regulatory Commission (NRC) has received a petition for rulemaking from Brian Magnuson dated May 31, 2020, requesting that the NRC revise its regulations to codify the source term methodologies and corresponding release fractions recommended in a report issued by Sandia National Laboratories. The petition was docketed by the NRC on June 18, 2020, and has been assigned Docket No. PRM-50-122. The NRC is examining the issues raised in PRM-50-122 to determine whether they should be considered in rulemaking. The NRC is requesting public comment on this petition at this time.
Duke Energy Carolinas, LLC; McGuire Nuclear Station, Units 1 and 2; Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption to Duke Energy Carolinas, LLC (Duke Energy) which would permit Duke Energy to maintain MAGNASTOR[supreg] Cask 0FCTKN045 at its McGuire Nuclear Station independent spent fuel storage installation (ISFSI) in a storage condition where the helium density is above the range specified in Certificate of Compliance (CoC) No. 1031, Amendment No. 7, Technical Specification (TS) 3.1.1.

Exelon Generation Company, LLC; Braidwood Station, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Renewed Facility Operating License Nos. NPF-72 and NPF-77, issued to Exelon Generation Company, LLC, for operation of the Braidwood Station, Units 1 and 2. The proposed amendment is contained in the licensee's letter dated July 15, 2020, and would change Technical Specifications (TS) Surveillance Requirement (SR) 3.7.9.2 to allow an ultimate heat sink (UHS) temperature of less than or equal to 102.8 degrees Fahrenheit ([deg]F) through September 30, 2020. The proposed amendment would also permanently extend the completion time for the Required Action of both Braidwood Station, Units 1 and 2, to be placed in Mode 3 within 12 hours when the UHS is inoperable due to average water temperature.
Exelon Generation Company, LLC; Byron Station, Unit Nos. 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is considering the issuance of amendments to Renewed Facility Operating License Nos. NPF-37 and NPF-66, issued to Exelon Generation Company, LLC (Exelon, or the licensee) for operation of Byron Station, Unit Nos. 1 and 2. The proposed amendments would revise technical specification requirements to provide a one-time extension for Byron Station, Unit No. 2 steam generator (SG) tube inspections. The amendments are necessary to avoid conflicts with the Centers for Disease Control and Prevention (CDC) recommendations regarding social distancing to prevent the spread of the Coronavirus Disease 2019 (COVID-19) virus. For this amendment request, the NRC proposes to determine that it involves no significant hazards consideration. Because this amendment request contains sensitive unclassified non-safeguards information (SUNSI), an order imposes procedures to obtain access to SUNSI for contention preparation.
NextEra Energy Duane Arnold, LLC; Duane Arnold Energy Center
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to a February 25, 2020, as supplemented by letter dated May 29, 2020, request from NextEra Energy Duane Arnold, LLC (NEDA, the licensee). The issuance of the exemption would permit NEDA to use funds from the Duane Arnold Energy Center (DAEC) decommissioning trust fund (DTF) for spent fuel management and site restoration activities and without prior notification of the NRC.

DPR-57 and NPF-5, issued to Southern Nuclear Operating Company, for operation of the Edwin I. Hatch Nuclear Plant (Hatch), Units 1 and 2, respectively. The proposed amendment would revise technical specification (TS) 3.8.1, ``AC SourcesOperating,'' for Hatch, Units 1 and 2, to provide for a one-time extension of the completion time for the Hatch, Unit 1, emergency diesel generators.
Setpoints for Safety-Related Instrumentation
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft regulatory guide (DG), DG-1363, ``Setpoints for Safety-Related Instrumentation.'' This DG is proposed Revision 4 of Regulatory Guide (RG) 1.105. The proposed revision describes an approach that is acceptable to the staff of the NRC to meet regulatory requirements ensuring that setpoints for safety related instrumentation are established and maintained within the technical specification limits. This proposed guide has been revised to incorporate additional information regarding American National Standards Institute (ANSI)/ International Society of Automation (ISA) Standard 67.04.01-2018, ``Setpoints for Nuclear Safety Related Instrumentation,'' since revision 3 of RG 1.105 was issued.
Holtec International HI-STORE Consolidated Interim Storage Facility Project
On March 20, 2020, the U.S. Nuclear Regulatory Commission (NRC) published in the Federal Register a notice issuing the draft Environmental Impact Statement (EIS) for Holtec International's (Holtec's) application to construct and operate a consolidated interim storage facility (CISF) for spent nuclear fuel and Greater-Than Class C waste, along with a small quantity of mixed oxide fuel. The NRC is announcing four public comment webinars to receive comments on the draft report. The meetings will allow interested members of the public to submit their comments.
Information Collection: International Atomic Energy Agency Design Information Questionnaire
The U.S. Nuclear Regulatory Commission (NRC) invites public comment on our intention to request the Office of Management and Budget's (OMB) approval for renewal of an existing information collection in order for the United States to fulfill its responsibilities as a participant in the U.S./International Atomic Energy Agency (IAEA) Safeguards Agreement. The information collection is entitled, ``IAEA Design Information Questionnaire.''
Exelon Generation Company, LLC; James A. FitzPatrick Nuclear Power Plant
The U.S. Nuclear Regulatory Commission (NRC) has granted the request of Exelon Generation Company, LLC (the licensee) to withdraw its application dated September 5, 2019, as supplemented by letters dated November 6, 2019; February 21, 2020; and March 31, 2020, for a proposed amendment to Renewed Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant. The proposed amendment would have revised the allowable value for reactor water cleanup system primary containment isolation.
Fire Protection Program for Nuclear Power Plants During Decommissioning
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft regulatory guide (DG), DG-1370, ``Fire Protection Program for Nuclear Power Plants During Decommissioning.'' This proposed revision of the guide (Revision 1) addresses new information identified since Revision 0 of this guide was issued. The guidance in Revision 0 of the regulatory guide (RG) does not include guidance for plants that have transitioned to the National Fire Protection Association (NFPA) Standard 805, ``Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants,'' 2001 Edition. This guide is being revised to include guidance for plants that have transitioned to NFPA 805, 2001 Edition.

Standard Format and Content of License Applications for Receipt and Storage of Unirradiated Power Reactor Fuel and Associated Radioactive Material at a Nuclear Power Plant
The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 2 to Regulatory Guide (RG) 3.15, ``Standard Format and Content of License Applications for Receipt and Storage of Unirradiated Power Reactor Fuel and Associated Radioactive Material at a Nuclear Power Plant.'' RG 3.15 describes the standard format and content that the NRC staff considers acceptable for license applications to authorize the receipt, possession, and storage of unirradiated fuel assemblies and associated radioactive materials at a nuclear power plant.
Notice of Intent To Review and Update the Generic Environmental Impact Statement for License Renewal of Nuclear Plants
The U.S. Nuclear Regulatory Commission (NRC) intends to gather information through the public scoping process to support the review to determine whether to update NUREG-1437, ``Generic Environmental Impact Statement for License Renewal of Nuclear PlantsFinal Report'' (LR GEIS). The NRC is seeking public input on the proposed action and has scheduled public scoping meetings.
NextEra Energy Duane Arnold, LLC; Duane Arnold Energy Center
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an exemption in response to a February 25, 2020, as supplemented by letter dated May 29, 2020, request from NextEra Energy Duane Arnold, LLC (NEDA, the licensee) for Duane Arnold Energy Center (DAEC). The exemption would permit the licensee to use funds from the DAEC decommissioning trust fund (DTF, the Trust) for spent fuel management activities and site restoration. The exemption would also allow such withdrawals without prior notification to the NRC. The NRC staff is issuing a final Environmental Assessment (EA) and final Finding of No Significant Impact (FONSI) associated with the proposed exemption.
In the Matter of Dr. Melinda P. Krahenbuhl, Reed Research Reactor, Portland, Oregon
The U.S. Nuclear Regulatory Commission (NRC) is issuing Confirmatory Order (CO) IA-20-040 to Dr. Melinda Krahenbuhl, former Director of the Reed College, Reed Research Reactor, Portland, Oregon, as a result of a successful alternative dispute resolution (ADR) mediation session held on June 22, 2020. The CO confirms commitments agreed to during the ADR mediation, and the NRC is satisfied that the concerns discussed in Order IA-19-035 issued to Dr. Krahenbuhl on March 16, 2020, will be addressed with the issuance of this CO. Accordingly, the NRC is withdrawing the March 16, 2020, Order prohibiting Dr. Krahenbuhl's involvement in NRC-licensed activities for three years and, subject to the satisfactory completion of the additional corrective actions described in Order IA-20-040, the NRC will take no further action concerning the violations discussed in Order IA-19-035. The Order is effective on the date of issuance.
Development of an Ex Situ Performance Testing Protocol for Nuclear Power Plant Flood Penetration Seals
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft NUREG, NUREG-2240, ``Development of an Ex Situ Performance Testing Protocol for Nuclear Power Plant Flood Penetration Seals.'' This draft NUREG summarizes a research project that developed a test protocol for evaluating flood penetration seals using simulated flooding conditions in a laboratory setting.
Changes to Subsequent License Renewal Guidance Documents Regarding Reactor Vessel Internal Components in Pressurized Water Reactors
The U.S. Nuclear Regulatory Commission (NRC) is soliciting public comment on draft interim staff guidance (ISG) that proposes changes to the NRC's subsequent license renewal guidance documents. Specifically, this ISG revises guidance contained in NUREG-2191, ``Generic Aging Lessons Learned for Subsequent License Renewal (GALL- SLR) Report,'' and NUREG-2192, ``Standard Review Plan for Review of Subsequent License Renewal Applications for Nuclear Power Plants.'' NUREG-2191 and NUREG-2192 were published in July 2017 and are not scheduled to be updated for several years. The proposed changes to these documents are contained in a draft ISG entitled, ``Draft SLR-ISG- PWRVI-2020-XX; Updated Aging Management Criteria for Reactor Vessel Internal Components in Pressurized Water Reactors.''
