Clarification of Personnel Access Authorization Requirements for Non-Immigrant Foreign Nationals Working at Nuclear Power Plants
The U.S. Nuclear Regulatory Commission (NRC) is seeking public comment on a draft regulatory issue summary (RIS) to reinforce the existing requirement that prior to granting or reinstating unescorted access (UA), or certifying unescorted access authorization (UAA) to non-immigrant foreign nationals for the purpose of performing work, licensees shall take reasonable steps to access reliable, independent sources of information, in addition to the information provided by the applicant, to verify the applicant's claimed non-immigration status.
Duke Energy Progress, LLC; Shearon Harris Nuclear Power Plant, Unit 1
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Facility Operating License No. NFP-63, issued to Duke Energy Progress, LLC, for operation of the Shearon Harris Nuclear Power Plant, Unit 1. The proposed amendment would revise the Technical Specifications (TSs) to include the NRC-approved topical report, ANP-10341P-A, ``The ORFEO-GAIA and ORFEO-NMGRID Critical Heat Flux Correlations,'' and add Appendix J to DPC-NE-2005-P, ``Thermal- Hydraulic Statistical Core Design Methodology.'' TSs would be revised to add the departure from nucleate boiling ratio safety limit for a fuel assembly design with characteristics similar to the GAIA fuel design using the ORFEO-GAIA correlation methodology. The TSs would also be revised with minor formatting editorial adjustments to the impacted pages. For this amendment request, the NRC proposes to determine that it involves no significant hazards consideration. Because this amendment request contains sensitive unclassified non-safeguards information (SUNSI), an order imposes procedures to obtain access to SUNSI for contention preparation.
Three Mile Island Nuclear Station, Unit No. 2; Consideration of Approval of Transfer of License and Conforming Amendment
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by GPU Nuclear, Inc., Metropolitan Edison Company, Jersey Central Power and Light Company, Pennsylvania Electric Company (collectively, the FirstEnergy Companies), and TMI-2 Solutions, LLC (together with the FirstEnergy Companies, the Applicants) on November 12, 2019. The application seeks NRC approval of the direct transfer of NRC Possession-Only License No. DPR-73 for Three Mile Island Nuclear Station, Unit No. 2 (TMI-2) from the current holders, the FirstEnergy Companies, to TMI-2 Solutions, LLC, which is an indirect wholly owned subsidiary of EnergySolutions. The NRC is also considering amending the possession-only license for administrative purposes to reflect the proposed transfer. The application contains sensitive unclassified non-safeguards information (SUNSI).

Pacific Gas and Electric Company; Humboldt Bay Power Plant, Unit 3
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to a January 13, 2020, request from Pacific Gas and Electric Company (PG&E or the licensee). The exemption permits PG&E to reduce the minimum coverage limit for onsite property damage insurance from $63.16 million to $50 million for Humboldt Bay Power Plant, Unit 3.
Biweekly Notice; Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all amendments issued, or proposed to be issued, from February 25, 2020, to March 9, 2020. The last biweekly notice was published on March 10, 2020.
Backfitting, Forward Fitting, and Issue Finality Guidance
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft NUREG-1409, ``Backfitting Guidelines,'' Revision 1. This draft NUREG provides guidance on the implementation of the backfitting and issue finality provisions of the NRC's regulations and the NRC's forward fitting policy in accordance with Management Directive and Handbook 8.4, ``Management of Backfitting, Forward Fitting, Issue Finality, and Information Requests.''
Advisory Committee on the Medical Uses of Isotopes: Meeting Notice
The U.S. Nuclear Regulatory Commission (NRC) will convene a meeting of the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on March 30, 2020. Information Collection: NRC Forms 366, 366A, and 366B, “Licensee Event Report”; Correction
The U.S. Nuclear Regulatory Commission (NRC) is correcting a notice that was published in the Federal Register (FR) on February 26, 2020, providing notice of submission to the Office of Management and Budget and requesting comment. This action is necessary to amend the annual responses and burden hours to include the burden and responses associated cyber security events. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. The public comment period was originally scheduled to close on March 27, 2020.
Southern Nuclear Operating Company, Inc., Vogtle Electric Generating Plant, Units 3 and 4 Inspections, Tests, Analyses, and Acceptance Criteria

The Order is effective on the date of issuance.
Southern Nuclear Operating Company, Inc., Vogtle Electric Generating Plant, Units 3 and 4; Automatic Depressurization System (ADS) and Core Makeup Tank (CMT) Design Parameters
The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and is issuing License Amendment Nos. 176 and 175 to Combined Licenses (COL), NPF-91 and NPF-92, respectively. The COLs were issued to Southern Nuclear Operating Company, Inc., and Georgia Power Company, Oglethorpe Power Corporation, MEAG Power SPVM, LLC, MEAG Power SPVJ, LLC, MEAG Power SPVP, LLC, and the City of Dalton, Georgia (collectively SNC); for construction and operation of the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, located in Burke County, Georgia. The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

In the Matter of Reed College, Reed Research Reactor, Portland, Oregon
The U.S. Nuclear Regulatory Commission (NRC) is issuing a Confirmatory Order (CO) to Reed College, Portland, Oregon as a result of a successful alternative dispute resolution (ADR) mediation session held on January 23, 2020. The CO confirms commitments agreed to during the ADR mediation and, based on the completion of the actions described in the CO, the NRC agrees to not pursue any further enforcement action for the apparent violations identified in the NRC's November 19, 2019, letter to Reed College, and will not issue a Notice of Violation or seek to impose civil penalties in connection with the apparent violations. The Order is effective on the date of issuance.
Volcanic Hazards Assessment for Proposed New and Advanced Nuclear Power Plants
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft regulatory guide (DG), DG-4028, ``Volcanic Hazards Assessment for Proposed Nuclear Power Reactor Sites.'' This DG proposes new guidance for facilitating NRC staff reviews of volcanic hazard assessments performed by applicants to support the siting and licensing of new nuclear power reactors. The DG also provides applicants with the methods and approaches the NRC staff considers acceptable for the assessment of volcanic hazards in license applications.

Holtec International HI-STORE Consolidated Interim Storage Facility Project
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft Environmental Impact Statement (EIS) for Holtec International's (Holtec's) application to construct and operate a consolidated interim storage facility (CISF) for spent nuclear fuel (SNF) and Greater-Than Class C (GTCC) waste, along with a small quantity of mixed oxide fuel. The proposed CISF would be located in southeast New Mexico at a site located approximately halfway between the cities of Carlsbad and Hobbs, New Mexico. The proposed action is the issuance of an NRC license authorizing the initial phase (Phase 1) of the project to store up to 8,680 metric tons of uranium [9,568 short tons] in 500 canisters for a license period of 40 years. Holtec plans to subsequently request amendments to the license to store an additional 500 canisters for each of 19 expansion phases of the proposed CISF (a total of 20 phases), to be completed over the course of 20 years, and to expand the proposed facility to eventually store up to 10,000 canisters of SNF.
Southern Nuclear Operating Company; Farley Nuclear Plant, Units 1 and 2; Hatch Nuclear Power Plant, Units 1 and 2; and Vogtle Electric Generating Plant, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) has issued exemptions in response to an October 31, 2019, request from Southern Nuclear Operating Company (SNC). The exemptions would allow SNC to submit changes to the Quality Assurance Topical Report that do not reduce commitments on a 24-month calendar schedule.
Pacific Gas and Electric Company; Diablo Canyon Nuclear Power Station, Units 1 and 2; Cancellation of Public Meeting
On February 21, 2020, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on the Post-Shutdown Decommissioning Activities Report (PSDAR) for the Diablo Canyon Nuclear Power Plant (Diablo Canyon), Units 1 and 2. The NRC had planned to hold a public meeting to discuss the PSDAR and receive comments. The public meeting was originally scheduled to be held on March 19, 2020. The NRC has decided to reschedule the public meeting at a later date due to concerns with the Coronavirus: COVID-19.
Individual Monitoring Devices
The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to authorize the use of modern individual monitoring devices in industrial radiographic, irradiator, and well logging operations. The proposed amendments would align personnel dosimetry requirements in these areas with the requirements for all other NRC licensees. This proposed rule addresses an issue raised in a petition for rulemaking and would affect NRC and Agreement State licensees. The NRC also is issuing supplemental guidance for use and comment.

Sacramento Municipal Utility District; Rancho Seco Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC) has issued a renewed license to the Sacramento Municipal Utility District for Special Nuclear Materials (SNM) License No. SNM-2510 for the receipt, possession, transfer, and storage of radioactive material from the Rancho Seco Nuclear Generating Station in the Rancho Seco independent spent fuel storage installation (ISFSI). The Rancho Seco ISFSI is located on the Rancho Seco site, in Sacramento County, California. The renewed license authorizes operation of the Rancho Seco ISFSI in accordance with the provisions of the renewed license and its technical specifications. The renewed license expires on June 30, 2060.

The U.S. Nuclear Regulatory Commission (NRC) issued a confirmatory order (Order) to Duke Energy Progress, LLC (the licensee), confirming the agreement reached in an Alternative Dispute Resolution mediation session held on December 16, 2019. This Order will ensure the licensee restores compliance with NRC regulations. The Order is effective upon issuance.

Approval of American Society of Mechanical Engineers' Code Cases
The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to incorporate by reference the latest revisions of three regulatory guides approving new, revised, and reaffirmed Code Cases published by the American Society of Mechanical Engineers. This action allows licensees and applicants to use the Code Cases listed in these regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components. These engineering standards are set forth in the American Society of Mechanical Engineers' Boiler and Pressure Vessel Codes and American Society of Mechanical Engineers' Operation and Maintenance Codes, which are currently incorporated by reference into the NRC's regulations. Further, this final rule announces the availability of a related regulatory guide, not incorporated by reference into the NRC's regulations, that lists Code Cases that the NRC has not approved for use.
Exelon Generation Company, LLC and PSEG Nuclear, LLC Peach Bottom Atomic Power Station, Units 2 and 3
The U.S. Nuclear Regulatory Commission (NRC) has issued Subsequent Renewed Facility Operating Licenses Nos. DPR-44 and DPR-56 to Exelon Generation Company, LLC and PSEG Nuclear, LLC (Exelon, PSEG, or the licensees), for Peach Bottom Atomic Power Station, Units 2 and 3, respectively. In addition, the NRC has prepared a record of decision (ROD) that supports the NRC's decision to issue Subsequent Renewed Facility Operating License Nos. DPR-44 and DPR-56.
In the Matter of Arizona Public Service Company; El Paso Electric Company; Palo Verde Nuclear Generating Station, Units 1, 2, and 3, and Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC) is issuing an Order approving the application filed by El Paso Electric Company (EPE) on August 13, 2019. The application seeks an NRC order consenting to the indirect transfer of EPE's possession-only non-operating interests in Renewed Facility Operating License Nos. NPF-41, NPF-51, and NPF-74 for the Palo Verde Nuclear Generating Station (Palo Verde), Units 1, 2, and 3, respectively, and the general license for the Palo Verde Independent Spent Fuel Storage Installation (ISFSI) (together, the Facility). No physical changes to the Facility or operational changes were proposed in the application.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to a July 6, 2018, request, as supplemented by letters dated October 18, 2018; March 1, 2019; May 17, 2019; October 4, 2019; November 26, 2019; and December 19, 2019, from Arizona Public Service Company (the licensee) in order to use Framatome M5[supreg] alloy as a fuel rod cladding material at Palo Verde Nuclear Generating Station, Units 1, 2, and 3.
Entergy Nuclear Operations, Inc.; Indian Point Nuclear Generating Unit Nos. 2 and 3
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an April 15, 2019 request from Entergy Nuclear Operations, Inc. (Entergy, the licensee). The exemption allows a certified fuel handler, in addition to a licensed senior operator, to suspend security measures in an emergency or during severe weather for Indian Point Nuclear Generating Unit Nos. 2 and 3 (Indian Point 2 and 3) after both the ``Certification of Permanent Cessation of Operations'' and the ``Certification of Permanent Fuel Removal'' have been docketed for that respective unit.
Rancho Seco Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC) is considering the renewal of Special Nuclear Materials (SNM) License SNM-2510 for the Rancho Seco Nuclear Plant Independent Spent Fuel Storage Installation (ISFSI) (Rancho Seco ISFSI) located in Sacramento County, California. The NRC has prepared an environmental assessment (EA) for this proposed license renewal in accordance with its regulations. Based on the EA, the NRC has concluded that a finding of no significant impact (FONSI) is appropriate. The NRC also is conducting a safety evaluation of the proposed license renewal.
Transfer of Very Low-Level Waste to Exempt Persons for Disposal
The U.S. Nuclear Regulatory Commission (NRC) is issuing a proposed interpretation of its low-level radioactive waste disposal regulations that would permit licensees to dispose of waste by transfer to persons who hold specific exemptions for the purpose of disposal. The NRC will consider approval of requests for specific exemptions for the purpose of disposal if they are for the disposal of very low-level radioactive waste by land burial. Therefore, the NRC's intent is that this interpretive rule will allow licensees to transfer very low-level radioactive waste to exempt persons for the purpose of disposal by land burial. The NRC is requesting comment on this proposed interpretive rule.

List of Approved Spent Fuel Storage Casks: NAC International MAGNASTOR® System, Certificate of Compliance No. 1031, Amendment No. 8
The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of March 24, 2020, for the direct final rule that was published in the Federal Register on January 9, 2020. This direct final rule amended the NRC's spent fuel storage regulations by revising the ``List of approved spent fuel storage casks'' to include Amendment No. 8 to Certificate of Compliance No. 1031 for the NAC International, Inc. MAGNASTOR[supreg] System.
Advisory Committee on the Medical Uses of Isotopes Charter Renewal
The U.S. Nuclear Regulatory Commission (NRC) has determined that renewal of the charter for the Advisory Committee on the Medical Uses of Isotopes (ACMUI) until February 28, 2022, is in the public interest in connection with duties imposed on the Commission by law. This action is being taken in accordance with the Federal Advisory Committee Act, after consultation with the Committee Management Secretariat, General Services Administration. The purpose of the ACMUI is to provide advice to the NRC on policy and technical issues that arise in regulating the medical use of byproduct material for diagnosis and therapy. Responsibilities include providing guidance and comments on current and proposed NRC regulations and regulatory guidance concerning medical use; evaluating certain non- routine uses of byproduct material for medical use; and evaluating training and experience of proposed authorized users. The members are involved in preliminary discussions of major issues in determining the need for changes in NRC policy and regulation to ensure the continued safe use of byproduct material. Each member provides technical assistance in his/her specific area(s) of expertise, particularly with respect to emerging technologies. Members also provide guidance as to NRC's role in relation to the responsibilities of other Federal agencies as well as of various professional organizations and boards. Members of this Committee have demonstrated professional qualifications and expertise in both scientific and non-scientific disciplines including nuclear medicine; nuclear cardiology; radiation therapy; medical physics; nuclear pharmacy; State medical regulation; patient's rights and care; health care administration; and Food and Drug Administration regulation.
Power Reactors in Extended Shutdowns
The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking dated September 1, 2016, submitted by Mr. David Lochbaum on behalf of the Union of Concerned Scientists and two co- petitioners (the petitioners). The petition was docketed by the NRC on September 14, 2016, and was assigned Docket No. PRM-50-114. The petitioners requested that the NRC amend its regulations to ``promulgate regulations applicable to nuclear power reactors with operating licenses issued by the NRC but in an extended outage.'' The NRC is denying the petition because the NRC already has regulatory processes in place to address the issues identified in the petition.

The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of one amendment request. The amendment request is for Watts Bar Nuclear Plant (WBN), Unit 2. For this amendment request, the NRC proposes to determine that it involves no significant hazards consideration. Because this amendment request contains sensitive unclassified non-safeguards information (SUNSI) an order imposes procedures to obtain access to SUNSI for contention preparation.
Exelon Generation Company, LLC; R. E. Ginna Nuclear Power Plant; Add One-Time Note for Use of Alternative Residual Heat Removal Methods
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Renewed Facility Operating License No. DPR- 18, issued to Exelon Generation Company, LLC, for operation of the R. E. Ginna Nuclear Power Plant (Ginna). The amendment would revise Technical Specifications (TSs) 3.4.7, ``RCS [reactor coolant system] LoopsMODE 5, Loops Filled''; 3.4.8, ``RCS LoopsMODE 5, Loops Not Filled''; 3.9.4, ``Residual Heat Removal (RHR) and Coolant CirculationWater Level >= 23 Ft''; and 3.9.5, ``Residual Heat Removal (RHR) and Coolant CirculationWater Level < 23 Ft,'' to add a one-time note for use of alternative residual heat removal methods.
