The U.S. Nuclear Regulatory Commission (NRC) is announcing the placement of the Georgia Agreement State Program (Georgia Program) for the regulation of certain Atomic Energy Act materials on probation and a further increase in the NRC oversight of the Georgia Program, including overseeing implementation of a ``Program Improvement Plan'' developed by the staff of the Georgia Program. Once the Georgia Program has met the commitments made in the ``Program Improvement Plan,'' and has demonstrated significant and sustainable improvements, the probationary status could be lifted. There will be further announcements of such action.

This revision incorporates guidance and recommendations from Regulatory Guide (RG) 1.221, ``Design-Basis Hurricane and Hurricane Missiles for Nuclear Power Plants,'' and Interim Staff Guidance DC/COL- ISG-024, ``Implementation of Regulatory Guide 1.221 on Design-Basis Hurricane and Hurricane Missiles.'' In addition, this revision provides clarification on areas of review and acceptance criteria for assessment of design-basis missiles generated by extreme winds. The revision also incorporates guidance on regulatory treatment of nonsafety systems.

The U.S. Nuclear Regulatory Commission (NRC) invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: Suspicious Activity Reporting Using the Protected Web Server (PWS). 2. Current OMB approval number: 3150-XXXX. 3. How often the collection is required: On occasion. Reporting is done on a voluntary basis, as suspicious incidents occur. 4. Who is required or asked to report: Nuclear power reactor licensees provide the majority of reports, but other entities that may voluntarily send reports include fuel facilities, independent spent fuel storage installations, decommissioned power reactors, power reactors under construction, research and test reactors, agreement states, non-agreement states, as well as departments of health, medical centers, steel mills, and radiographers. 5. The number of annual respondents: 50. 6. The number of hours needed annually to complete the requirement or request: 678 hours. 7. Abstract: The NRC licensees voluntarily report information on suspicious incidents on an ad-hoc basis, as these incidents occur. This information is shared with authorized nuclear industry officials and Federal, State, and local government agencies using PWS. Information provided by licensees is considered OFFICIAL USE ONLY and is not made public. Submit, by October 7, 2013, comments that address the following questions: 1. The U.S. Nuclear Regulatory Commission (NRC) is providing notice that the NRC staff will conduct a meeting to discuss and accept public comments on the Humboldt Bay Power Plant (HBPP), Unit 3 License Termination Plan (LTP) on Tuesday, August 20, 2013, at 6:00 p.m. in the Great Room at the Warfinger Building, Eureka Public Marina, 1 Marina Way, Eureka, California. The HBPP is located about four miles southwest of the city of Eureka, Humboldt County, California and consists of 143 acres of land. Unit 3, which is the NRC licensed reactor, is currently being decommissioned with the spent fuel now stored in the onsite Independent Spent Fuel Storage Installation. Unit 3 decommissioning commenced in May 2009. Following the start of a new power generation facility in 2010, the licensee commenced with the permanent shutdown of the fossil Units 1 and 2. Units 1 and 2 are being decommissioned in conjunction with Unit 3 decommissioning. In accordance with the NRC regulations at Sec. 50.82(a)(9) of Title 10 of the Code of Federal Regulations (10 CFR), all power reactor licensees must submit an application for termination of their license. The application for termination of license must be accompanied or preceded by an LTP to be submitted for NRC approval. Pacific Gas and Electric submitted the proposed LTP for HBPP with a license amendment application dated May 3, 2013. The LTP would be approved by license amendment if found acceptable by the NRC staff. The amendment would be subject to such conditions and limitations as the NRC staff deems appropriate and necessary. In accordance with 10 CFR 20.1405 and 10 CFR 50.82(a)(9)(iii), the NRC is providing notice to individuals in the vicinity of the site that the NRC: (1) Is in receipt of the HBPP LTP; (2) will hold a public meeting: and (3) will accept comments from affected parties. The HBPP LTP is available for public viewing at the NRC's Public Document Room (PDR) or electronically through the NRC Agencywide Documents Access and Management System (ADAMS) at accession numbers ML131300009 and ML131300160. Documents may be examined, and/or copied for a fee, at the PDR, located at One White Flint North, 11555 Rockville Pike (first floor), Rockville, Maryland. IEEE Std. 829-2008 describes methods that the NRC considers acceptable for use in complying with NRC regulations for developing test documentation and design quality in the software used in safety systems of nuclear power plants.

The U.S. Nuclear Regulatory Commission (NRC) is granting both an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and License Amendment No. 6 to Combined Licenses (COL), NPF-93 and NPF-94. The COLs were issued to South Carolina Electric and Gas (SCE&G) and South Carolina Public Service Authority (Santee Cooper) (the licensee), for construction and operation of the Virgil C. Summer Nuclear Station (VCSNS), Units 2 and 3 located in Fairfield County, South Carolina. The amendment changes requested adding four electrical penetration assemblies to the containment vessel and shield building in order to support the current electrical loads required within containment. This request includes changes to Tier 1 information located in Tables 2.2.1- 1 and 2.2.3-6 as well as Figure 2.2.1-1 of the Updated Final Safety Analysis Report (UFSAR), as well as the corresponding information in Appendix C of the COL. The granting of the exemption allows the Tier 1 changes asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The title of the information collection: NRC Form 327, ``Special Nuclear Material (SNM) and Source Material Physical Inventory Summary Report'' and NUREG/BR-0096, ``Instructions and Guidance for Completing Physical Inventory Summary Reports.'' 2. Current OMB approval number: 3150-0139. 3. How often the collection is required: Certain licensees possessing strategic SNM are required to report inventories every six months. Licensees possessing SNM of moderate strategic significance must report every nine months. Licensees possessing SNM of low strategic significance must report annually, except two licensees must report their dynamic inventories every two months and a static inventory on an annual basis. 4. Who is required or asked to report: Fuel facility licensees possessing special nuclear material, i.e., enriched uranium, plutonium or U-233. 5. The number of annual respondents: 7. 6. The number of hours needed annually to complete the requirement or request: 140 hours (4 hours per response x 35 responses). 7. Abstract: NRC Form 327 is submitted by fuel facility licensees to account for special nuclear material. The data is used by NRC to assess licensee material control and accounting programs and to confirm the absence of (or detect the occurrence of) SNM theft or diversion. NUREG/BR-0096 provides specific guidance and instructions for completing the form in accordance with the requirements appropriate for a particular licensee. The final rule amended the NRC's environmental protection regulations by updating the Commission's 1996 findings on the environmental effect of renewing the operating license of a nuclear power plant. Compliance with the provisions of the rule is required by June 20, 2014. This correcting amendment is necessary to clarify and correct the revisions made to the statutory authority that is cited in the authority citation of the final rule.

The draft NUREG provided guidance to NRC staff on how to determine whether a submittal for a Corrective Action Program (CAP), voluntarily submitted by fuel cycle facility licensees, was acceptable. The NRC staff has reviewed public comments received on draft NUREG-2154 and has decided to withdraw the draft NUREG and to proceed with the development and issuance of a draft Regulatory Guide (RG) to describe elements of an acceptable CAP for fuel cycle facilities.

The NRC is considering an application for the renewal of operating licenses NPF-37, NPF-66, NPF- 72, and NPF-77, which authorize Exelon Generation Company, LLC (Exelon), to operate Byron, Units 1 and 2, at 3586.6 megawatts thermal each, and Braidwood, Units 1 and 2, at 3586.6 megawatts thermal each. The renewed licenses would authorize the applicant to operate both Byron and Braidwood for an additional 20 years beyond the period specified in each of the respective current licenses.
