The purpose of this document is to advise eligible state, local, territory and tribal governments, regional ocean partnerships, institutions of higher learning, and non-profit and for-profit organizations (requirements described in full announcement) that NOAA is soliciting proposals for competitive funding for Regional Ocean Partnerships that include or emphasize regional Coastal and Marine Spatial Planning (CMSP) efforts. This competition is focused on advancing effective coastal and ocean management through regional ocean governance and the goals for national ocean policy set out in the July 2010 Final Recommendations of the Interagency Ocean Policy Task Force, which includes a national CMSP Framework. The Regional Ocean Partnership Funding Program (ROPFP) will support two categories of activities: (1) Implementation of activities that contribute to achieving the priorities identified by Regional Ocean Partnerships (ROPs) while also advancing CMSP as envisioned in the national CMSP Framework; and (2) ROP Development and Governance Support for administration and operations of existing ROPs, and for start-up costs of those regions beginning ROPs. Eligible entities must submit to NOAA full proposals on or before December 10, 2010, in order to participate in this Fiscal Year (FY) 2011 funding opportunity. Total anticipated funding is approximately $20,000,000 and is subject to the availability of FY 2011 appropriations. Additional funds of approximately $10,000,000 from NOAA or other Federal agencies may be used for FY 2011 or multi-year awards from this competition. The start date on proposals should be the first day of July, August or September, but no later than October 1, of 2011. Statutory authority for this program is provided under Coastal Zone Management Act, 16 U.S.C. 1456c (Technical Assistance).

Final catch data for the 2009 fishing year (FY) (May 1, 2009- April 30, 2010) indicate that the total catch of Georges Bank (GB) yellowtail flounder was 1,770 mt, exceeding the 1,617 mt FY 2009 Total Allowable Catch (TAC) by 153 mt. The regulations require that any overage of the GB yellowtail flounder TAC specified for the common pool, individual sectors, or the scallop fishery in one FY be subtracted from the respective TACs in the following FY. Therefore, NMFS hereby announces deductions to the FY 2010 GB yellowtail flounder TAC, including how the deduction will be divided between the annual catch limit (ACL) for common pool vessels (common pool sub-ACL), and the ACL for sector vessels (sector sub-ACL).

NMFS seeks public comment on a provision of the regulations implemented by a November 2, 2009, final rule, as well as comments on proposed alternatives to replace this provision. The provision allows a midwater trawl vessel with an All Areas and/or Areas 2 and 3 Atlantic herring limited access permit fishing in Northeast (NE) multispecies Closed Area I (CA I) to release fish that cannot be pumped from the net and, thus, remain in the net at the end of pumping operations, without those fish being sampled by a NMFS at-sea observer. Based on comments that it receives, NMFS may keep the current provision unchanged, modify the provision, or remove the provision entirely. This action is part of a Court-approved joint motion to stay.

These revisions would ensure that the United States is satisfying its obligations under the Tuna Conventions Act while dismantling regulatory constraints preventing economic development of the U.S. industry.

That rule approved FY 2010 sector operations plans and contracts and allocations of Annual Catch Entitlements (ACE) for 17 sectors in the NE multispecies fishery. In addition to several universal exemptions approved in the final rule for Amendment 16 the NE Multispecies Fisheries Management Plan (FMP), the final sector rule also approved several additional exemptions from NE multispecies regulations for those sectors that requested them through their respective sector operations plans. The sectors requested several exemptions in the FY 2010 operations plans that NMFS subsequently disapproved for various reasons, including that they were not allowed

NMFS has designated the states of Alaska, Oregon, California, New York, Connecticut, Delaware, American Samoa and Commonwealth of the Northern Mariana Islands as exempted states for anglers, spear fishers and for-hire fishing vessels. NMFS has designated the states of Virginia and Massachusetts as exempted states for for-hire fishing vessels.

This action implements a differential Days-at-Sea (DAS) counting factor of 2.0 to Category A DAS for Northeast (NE) multispecies vessels fishing under common pool regulations for the 2010 fishing year (FY) when fishing in the Inshore Gulf of Maine (GOM) Differential DAS Area, the Offshore GOM Differential DAS Area, the Inshore Georges Bank (GB) Differential Area, and the Offshore GB Differential Area. Vessels may transit the GOM and GB Differential DAS Areas without being charged the differential DAS rate, provided their gear is properly stowed according to the regulations. This action also implements a zero possession limit for witch flounder. The purpose is to decrease the likelihood that catch (landings and discards) of white hake and GOM cod will exceed the subcomponent of the annual catch limit (ACL) allocated to the common pool during FY 2010 (May 1, 2010 through April 30, 2011). Because witch flounder has already exceeded its sub-ACL, this action attempts to minimize additional overharvest by reducing the possession limit to zero. This action is taken under the authority of the regulations implementing Amendment 16 and Framework Adjustment 44 (FW 44) to the NE Multispecies Fishery Management Plan (FMP) and authority of the Magnuson-Stevens Fishery Conservation and Management Act (MSA).

NMFS is prohibiting directed fishing for Pacific ocean perch for vessels participating in the rockfish entry level fishery in the Central Regulatory Area of the Gulf of Alaska (GOA). This action is necessary to prevent exceeding the 2010 total allowable catch (TAC) of Pacific ocean perch allocated to vessels participating in the rockfish entry level fishery in the Central Regulatory Area of the GOA.
