This action complies with the Fishery Management Plan for the Tilefish Fishery (FMP) and is intended to continue the rebuilding program in the FMP by taking into account previous overages of the tilefish quota.

The Assistant Administrator for Fisheries (AA), NOAA, announces temporary restrictions consistent with the requirements of the ALWTRP's implementing regulations. These regulations apply to lobster trap/pot and anchored gillnet fishermen in an area totaling approximately 2,404 nm\2\ (4,452 km\2\), southeast of Portland, ME, for 15 days. The purpose of this action is to provide protection to an aggregation of northern right whales (right whales).

NMFS proposes a rule to implement Amendment 19 to the Pacific Coast Groundfish Fishery Management Plan (FMP). Amendment 19 provides for a comprehensive program to describe and protect essential fish habitat (EFH) for Pacific Coast Groundfish. The proposed management measures are intended to minimize, to the extent practicable, adverse effects to EFH from fishing. The measures include fishing gear restrictions and prohibitions, areas that would be closed to bottom trawl, and areas that would be closed to all fishing that contacts the bottom.

NMFS issues a final rule to open the Cape Sarichef Research Restriction Area in the Bering Sea and Aleutian Islands Management Area (BSAI) to directed fishing for groundfish using trawl, pot, and hook- and-line gear from March 15, 2006, through March 31, 2006. Because NMFS' Alaska Fisheries Science Center (AFSC) will not conduct research in this area in 2006, closure of the Cape Sarichef Research Restriction Area is not needed. This action is intended to relieve an unnecessary restriction on groundfish fisheries and allow the optimum utilization of fishery resources, in accordance with the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act). This final rule also will remove the regulations for the Cape Sarichef Research Restriction Area, and regulations for the Chiniak Gully Research Area because both research projects have ended.

The Gulf of Mexico Fishery Management Council (Council) previously published a notice of intent in the Federal Register (70 FR 57859, October 5, 2005) to prepare a DSEIS for a joint Amendment 14 to the Fishery Management Plan (FMP) for the Shrimp Fishery of the Gulf of Mexico (Shrimp FMP) and Amendment 27 to the FMP for the Reef Fish Resources of the Gulf of Mexico (Reef Fish FMP). This notice supplements the previous notice and provides notice of the Council's intent to prepare a second DSEIS for a subsequent joint Amendment 15 to the Shrimp FMP and Amendment 28 to the Reef Fish FMP. The alternatives in the two joint amendments will consider measures to reduce red snapper fishing mortality and bycatch in the shrimp and reef fish fisheries, and to achieve optimum yield (OY) in the shrimp fishery. The purpose of this notice of intent is to solicit public comments on the scope of issues to be addressed in the DSEISs.

NMFS has determined that the Atlantic bluefin tuna (BFT) General category daily retention limit for five previously designated restricted fishing days (RFD) should be adjusted. These General category RFDs are being waived to provide reasonable opportunity for utilization of the coastwide General category BFT quota. Therefore, NMFS waives five RFDs scheduled for January 2006, and increases the daily retention limit from zero to two large medium or giant BFT on these previously designated RFDs.

Endangered and Threatened Species: Final Listing Determinations for 10 Distinct Population Segments of West Coast Steelhead

We, NOAA's National Marine Fisheries Service (NMFS), are issuing final determinations to list 10 Distinct Population Segments (DPSs) of West Coast steelhead (Oncorhynchus mykiss) under the Endangered Species Act (ESA) of 1973, as amended. We are listing one steelhead DPS in California as endangered (the Southern California steelhead DPS), and nine steelhead DPSs in California, Oregon, Washington, and Idaho as threatened (the South-Central California Coast, Central California Coast, California Central Valley, Northern California, Lower Columbia River, Upper Willamette River, Middle Columbia River, Upper Columbia River, and Snake River Basin steelhead DPSs). All 10 of these DPSs were previously listed as threatened or endangered species. The Upper Columbia River steelhead DPS, formerly listed as an endangered species, is now being listed as threatened.
Coastal Zone Management Act Federal Consistency Regulations

The National Oceanic and Atmospheric Administration (NOAA) revises the federal consistency regulations under the Coastal Zone Management Act of 1972 (CZMA). This final rule addresses the CZMA- related recommendations of the Report of the National Energy Policy Development Group, dated May 2001 (Energy Report) as described in NOAA's June 11, 2003, Notice of Proposed Rulemaking (68 FR 34851-34874) (proposed rule), and comments submitted to NOAA on the proposed rule. In addition, this final rule includes provisions complying with statutory amendments made in the Energy Policy Act of 2005 (Pub. L. 109-58) (Energy Policy Act) that concerned matters addressed in the proposed rule. This final rule continues to provide the balance between State-Federal-private interests embodied in the CZMA, while making improvements to the federal consistency regulations by clarifying some sections and providing greater transparency and predictability to the implementation of federal consistency. This final rule fully maintains the authority and ability of coastal States to review proposed federal actions that would have a reasonably foreseeable effect on any land or water use or natural resource of a State's coastal zone, as provided for in the CZMA and NOAA's regulations, as revised in 2000.

The National Marine Fisheries Service (NMFS) is publishing its final List of Fisheries (LOF) for 2005, as required by the Marine Mammal Protection Act (MMPA). The final LOF for 2005 reflects new information on interactions between commercial fisheries and marine mammals. NMFS must categorize each commercial fishery on the LOF into one of three categories under the MMPA based upon the level of serious injury and mortality of marine mammals that occurs incidental to each fishery. The categorization of a fishery in the LOF determines whether participants in that fishery are subject to certain provisions of the MMPA, such as registration, observer coverage, and take reduction plan (TRP) requirements.

NMFS publishes this final rule to clarify that the fee regulations for the Pacific Coast groundfish fishing capacity reduction program do not apply to any shrimp landed under Washington State fishing licenses for Puget Sound shrimp. The fee regulations remain otherwise unchanged. The purpose of this final rule is to clarify that the fee rules do not apply to the Puget Sound licenses.
