Stakeholder Meetings Regarding the U.S.-Flag Great Lakes Fleet Revitalization Study
The purpose of this notice is to announce three public listening-session meetings that are being held to gather data and comments to inform the Maritime Administration's U.S.-Flag Great Lakes Fleet Revitalization Study. The three meetings will be identical in terms of agenda and purpose; they are being held in the different locations to maximize stakeholder participation. The U.S.-Flag Great Lakes Fleet Revitalization Study will examine the current and potential future role of Great Lakes shipping in supporting the region's economy and as an important component of the greater U.S. Marine Highway system serving the Nation at large. It will also be used to assess the impact of new environmental regulations on the U.S.-Flag Great Lakes Fleet. Of particular interest is the likely impact of the EPA's final emission standards for new marine diesel ``Category 3'' engines that goes into effect in January 2012. This study calls for the identification and evaluation of options to recapitalize U.S. vessels and port infrastructure on the Great Lakes, using private and public sector investments, to generate the greatest net benefits for the region and the Nation. This Maritime Administration study will be a two-phase effort to estimate the costs and options for complying with the new environmental regulations. The first phase will be a data gathering effort. An inventory of current vessel and port assets will be developed. That inventory will be used to determine if the Maritime Administration can assist the U.S. Flag Great Lakes vessel operators in complying with the new regulations. During the second phase of the study, the Maritime Administration will examine a mix of private and public sector financing options that could be used for vessel or port alterations necessitated by the new environmental regulations. This analysis will be used in developing strategies for how the Maritime Administration might assist the U.S.- Flag Great Lakes Fleet and ports in making those changes. The Maritime Administration will use the study's findings to develop strategies to promote the U.S.-Flag Great Lakes Fleet and Ports. Stakeholder input is an essential part of the strategy- development process, so the study plan includes three stakeholder listening-sessions where the important issues raised by the study will be discussed. Topics of discussion include the new EPA environmental regulations such as the Control of Emissions from Category 3 Marine Engines and their impact on Great Lakes vessel operators, the state of the Great Lakes shipping markets, and issues facing vessel operators and port operators.

California Green Trade Corridor Transportation Investment Generating Economic Recovery (TIGER)
Notice is hereby given that the Maritime Administration, of the Department of Transportation (DOT), has made available to interested parties the Finding of No Significant Impact (FONSI) for the California Green Trade Corridor Transportation Investment Generating Economic Recovery (TIGER) grant. An environmental assessment (EA) and FONSI have been prepared pursuant to the National Environmental Policy Act (NEPA) (42 U.S.C. 4231 et seq.) in accordance with the Council on Environmental Quality (CEQ) regulations for implementing the procedural provisions of NEPA (40 CFR parts 1500-1508). The purpose of the EA is to evaluate the potential environmental impacts from two separate marine highway projects running from the Ports of West Sacramento and Stockton to the Port of Oakland. The marine highway services consist of a tug and barge configuration and are scheduled to operate once a week.

Buy America Waiver Notification
This notice provides information regarding the Maritime Administration's (MarAd) finding that a Buy American waiver, stated in 23 U.S.C. 313, is appropriate for the purchase of foreign Mobile Harbor Cranes in the Federal-aid/American Recovery and Reinvestment Act of 2009 (ARRA) for the Port of Searsport, Port of Stockton, Port of West Sacramento and the Port of Davisville via the Quonset Development Corporation. The waivers for each of these projects involve specific items that are not produced in the United States and deemed necessary for the construction of the project. MarAd has reached out to the steel industry and solicited public comments on the domestic availability of these items. No domestic manufacturers have been located.

Determination of Foreign Reconstruction or Rebuilding of U.S.- Built Vessels That Participate in the Capital Construction Fund and Cargo Preference Programs
The Maritime Administration (MARAD) is withdrawing and terminating its notice published in the Federal Register on November 14, 2007, at 72 FR 64109, which requested comments on what standards MARAD should apply concerning determinations of foreign reconstruction of U.S.-built vessels that participate in the Capital Construction Fund (CCF) program and foreign rebuilding of U.S.-built vessels that participate in the cargo preference program. Initially, when the notice was published, it was considered useful to obtain public comment on whether MARAD should issue regulations on standards applicable to determination of rebuilding or reconstruction. At the time the notice was published, the Coast Guard's approach to rebuilding was an unsettled area of law and a particular issue had arisen with regard to MARAD's method of determination in a foreign rebuild context. That matter was resolved and in December 2009, the Coast Guard's method of carrying out rebuilding determinations was affirmed by the United States Court of Appeals for the Fourth Circuit. Likewise, MARAD's approach to such determinations had been affirmed by the United States Court of Appeals for the Second Circuit. Even though the standards are different as applied regarding the cargo preference program, the two approaches would only rarely produce a different result. Furthermore, because they are generally applied in different circumstances, they even more rarely produce inconsistent results regarding the same vessel. MARAD has been requested to make a determination only twice in the last fifteen years. Therefore, a new rule is not required.

Marine Transportation System National Advisory Council
The Maritime Administration seeks applications for membership on the Marine Transportation System National Advisory Council (MTSNAC). This Committee advises and makes recommendations on impediments that hinder the effective use and expansion of America's Marine Highways; waterways and ports, and their intermodal, road, rail, and marine high connections; and guidelines for the development of a national freight policy from a marine transportation perspective to the Secretary of Transportation via the Maritime Administrator.
Vessel Re-Designations
On September 4, 2009, the United States Department of Agriculture (USDA), the United States Department of Transportation's Maritime Administration (MARAD), and the United States Agency for International Development (USAID) entered into a Memorandum of Understanding (MOU) regarding the proper implementation of the Cargo Preference Act (CPA). The MOU was published in the Federal Register in 74 FR 47308 (Sept. 15, 2009). The MOU is also available at https:// www.marad.dot.gov/documents/MAR730.AG-2009-02.pdf. That MOU establishes procedures and standards by which owners and operators of oceangoing cargo ships may seek to designate each of their vessels as either a dry bulk carrier or a dry cargo liner, according to specified service-based criteria. This Notice both announces that MARAD has received an application to re-designate three vessels and invites comments there on from interested parties. MARAD will thereafter consider all the information submitted regarding the requested re- designation and other evidence in the record in reaching its decision on the appropriate vessel classification.
Determination of Availability of Coastwise-Qualified Vessels for the Transportation of Platform Jackets
The Maritime Administration (MARAD) is publishing this final rule to establish regulations governing administrative determinations of availability of coastwise-qualified vessels to be used in the transportation and, if needed, launch or installation of offshore oil drilling or production platform jackets in specified projects only. MARAD views this as a special, technical adjustment that does not indicate a change in MARAD's full support for other requirements of the coastwise laws. Specifically, this final rulemaking implements provisions of Public Law 108-293 (2004) (the Act) which requires the Secretary of Transportation, acting through the Maritime Administrator, to adopt procedures to maximize use of coastwise-qualified vessels, but would permit the use of non-coastwise-qualified (foreign) launch barges if it is determined that coastwise-qualified vessels are not available.
