On November 20, 2009, the Maritime Administration, in cooperation with the U.S. Coast Guard, published in the Federal Register a Notice of Availability of the Draft Supplemental Environmental Impact Statement (DSEIS) for the amended TORP Terminal LP Bienville Offshore Energy Terminal (BOET) Liquefied Natural Gas Deepwater Port license application. Comments on the DSEIS are due by January 4, 2010, 45 days from issuance of the DSEIS. Please note that the DSEIS contained two references to a 30 day comment period, which should be corrected as follows: (1) On the front signature page of the BOET DSEIS, the correct date by which comments must be received should be January 4, 2010; (2) on page 1-10, the correct duration of the comment period should be 45 days.

The Maritime Administration (MARAD) announces the cancellation of all actions related to the license to own, construct and operate a deepwater port issued to Port Pelican LLC on January 20, 2004. Pursuant to Section 1503(h) of the Deepwater Port Act of 1974, as amended, a deepwater port license may remain in effect until such time as it is either suspended or revoked by the Secretary of Transportation or surrendered by the licensee. The action is taken in response to the applicant's decision to relinquish its Deepwater Port License.

The Maritime Administration announces the availability of the Record of Decision for the Port Dolphin Energy LLC (Port Dolphin Energy) Deepwater Port License Application. On October 26, 2009, the Acting Maritime Administrator, David T. Matsuda, issued the Record of Decision ``approving with conditions'' Port Dolphin Energy's application to own, construct, and operate a liquefied natural gas (LNG) deepwater port 28 miles southwest of Tampa Bay, Florida. Issuance of this Record of Decision completes the application review and license approval process, mandated by the Deepwater Port Act of 1974, as amended (the Act).

On September 4, 2009, the United States Department of Agriculture (USDA), the United States Department of Transportation's Maritime Administration (MARAD), and the United States Agency for International Development (USAID) entered into a Memorandum of Understanding (MOU) regarding the proper implementation of the Cargo Preference Act (CPA). That MOU, inter alia, establishes procedures and standards by which owners and operators of oceangoing cargo ships may seek to designate each of their vessels as either a dry bulk carrier or a dry cargo liner, according to specified service-based criteria. This Notice both announces that MARAD has received such self-designation applications for particular vessels from their owners and operators, and invites comments thereon from interested parties. MARAD will thereafter consider all the information submitted in support of a requested self-designation and other evidence in the record in reaching its own decision on the appropriate vessel classification.

Pursuant to a Memorandum of Understanding Among the United States Department of Agriculture, the United States Department of Transportation, and the United States Agency for International Development Regarding Procedures for Determining Vessel Service Categories for Purposes of the Cargo Preference Act, dated September 4, 2009 (the MOU, a copy of which is attached hereto and posted at the Web site of the Maritime Administration (MARAD), https://www.marad.dot.gov), notice is hereby given by MARAD that procedures as set forth herein are established for vessel owners or operators to designate the service category of individual vessels for purposes of compliance with the Cargo Preference Act (CPA). Where the owner or operator designates the category of its vessel, such self-designations will be docketed in the public record, published, and an opportunity will be provided for comment by interested parties. Each self-designation and the record supporting it is subject to review by MARAD. If MARAD disagrees with a self-designation, the process for determination, appeal and further administrative review is set forth below. These procedures are intended to be interim procedures implementing the MOU entered into by MARAD, the United States Department of Agriculture (USDA), and the United States Agency for International Development (USAID) and a 2002 Department of Justice interpretation of the CPA, pending the formal promulgation of regulations by MARAD.
