Notice of Proposed Rulemaking: Mortgage Acts and Practices - Advertising Rule
Pursuant to the 2009 Omnibus Appropriations Act (Omnibus Appropriations Act), as clarified by the Credit Card Accountability, Responsibility and Disclosure Act of 2009 (Credit CARD Act), the Commission issues a Notice of Proposed Rulemaking (NPRM) relating to unfair or deceptive acts and practices that may occur with regard to mortgage advertising, the Mortgage Acts and Practices (MAP) - Advertising Rule (proposed rule). The proposed rule published for comment, among other things, would prohibit any misrepresentation in any commercial communication regarding any term of any mortgage credit product; and impose recordkeeping requirements.
Privacy Act of 1974; System of Records Notices; Correction
The Federal Trade Commission published a document in the Federal Rgister of August 27, 2010, revising several of the notices that it is required to publish under the Privacy Act of 1974 to describe its systems of records about individuals. The document contained an incorrect change to one of the notices, FTC-I-1, System Name: Nonpublic Investigational and Other Nonpublic Legal Program Records. The heading under routine uses was improperly identified and this notice corrects that paragraphing error. We have also clarified that the records subject to this routine usage involve only the specific types of debt-related records as set out in the correction below.

Rescission of Regulations Under the Comprehensive Smokeless Tobacco Health Education Act of 1986
The Federal Trade Commission (``FTC'' or ``Commission'') is rescinding its smokeless tobacco regulations. Recent legislation transferred the FTC's authority for those regulations to the Secretary of the Department of Health and Human Services (``DHHS''). DHHS will now review and approve rotational warning plans for these products.
Agency Information Collection Activities;Submission for OMB Review; Comment Request
The information collection requirements described below will be submitted to the Office of Management and Budget (``OMB'') for review, as required by the Paperwork Reduction Act (``PRA''). The FTC seeks public comments on its proposal to extend through December 31, 2013 the current OMB clearance for information collection requirements contained in its Prescreen Opt-Out Disclosure Rule. That clearance expires on December 31, 2010.

Medicare Program; Workshop Regarding Accountable Care Organizations, and Implications Regarding Antitrust, Physician Self-Referral, Anti-Kickback, and Civil Monetary Penalty (CMP) Laws
This notice announces a public workshop hosted by the Federal Trade Commission (FTC), the Centers for Medicare & Medicaid Services (CMS), and the Office of the Inspector General (OIG) of the Department of Health and Human Services (DHHS). This workshop will include panel discussions and a listening session on certain legal issues related to Accountable Care Organizations (ACOs). Physicians, physician associations, hospitals, health systems, consumers, and all others interested in ACOs are invited to participate, in person or by calling into the teleconference. The meeting is open to the public, but attendance is limited to space and teleconference lines available. An agenda will be posted on the CMS Web site at https://www.cms.gov/center/ physician.asp prior to the session.
Premerger Notification; Reporting and Waiting Period Requirements
The Commission is proposing amendments to the Hart-Scott- Rodino (``HSR'') Premerger Notification Rules (the ``Rules''), the Premerger Notification and Report Form (the ``Form'') and associated Instructions in order to streamline the Form and capture new information that will help the Federal Trade Commission (the ``Commission'' or ``FTC'') and the Antitrust Division of the Department of Justice (the ``Assistant Attorney General'' or the ``Antitrust Division'') (together the ``Antitrust Agencies'' or ``Agencies'') conduct their initial review of a proposed transaction's competitive impact. Section 7A of the Clayton Act (the ``Act'') requires the parties to certain mergers or acquisitions to file with the Agencies and to wait a specified period of time before consummating such transactions. The reporting requirement and the waiting period that it triggers are intended to enable the Antitrust Agencies to determine whether a proposed merger or acquisition may violate the antitrust laws if consummated and, when appropriate, to seek a preliminary injunction in federal court to prevent consummation, pursuant to section 7 of the Act.

Agency Information Collection Activities; Proposed Collection; Comment Request
The FTC intends to conduct a survey of consumers to advance its understanding of the prevalence of consumer fraud and to allow the FTC to better serve people who experience fraud. The survey is a follow-up to two previous surveys - the first was conducted in May and June of 2003 and the second in November and December of 2005. Before gathering this information, the FTC is seeking public comments on its proposed consumer research. Comments will be considered before the FTC submits a request for Office of Management and Budget (``OMB'') review under the Paperwork Reduction Act.
