Hours of Service (HOS) of Drivers; American Pyrotechnics Association (APA) Application for an Exemption From the 14-Hour Rule During Independence Day Celebrations
The Federal Motor Carrier Safety Administration (FMCSA) grants the American Pyrotechnics Association's (APA) application for an exemption from the prohibition against driving a commercial motor vehicle (CMV) after the 14th hour of coming on duty. The exemption is applicable for a period beginning 7 days prior to, and 2 days immediately following Independence Day in 2007 and 2008. Fireworks personnel who operate CMVs for the nine companies listed in this notice, in conjunction with fireworks shows celebrating Independence Day, are allowed to exclude off-duty and sleeper-berth time of any length in the calculation of the 14 hours. However, drivers are not allowed to drive after accumulating a total of 14 hours of on-duty time, following 10 consecutive hours off duty, and continue to be subject to the 11-hour driving time limit and the 60- and 70-hour weekly limits. No substantive comments were received in response to the Agency's May 30, 2007 notice requesting public comment on the APA application. The FMCSA has determined that the granting of the exemption would achieve a level of safety that is equivalent to, or greater than, the level that would be achieved absent such exemption.
Notice of Request for Information (RFI): Training Certification for Drivers of Longer Combination Vehicles (LCVs)
In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for review and approval and invites public comment on its proposal. Specifically, the FMCSA requests OMB's approval to revise an ICR entitled, ``Training Certification for Drivers of Longer Combination Vehicles (LCVs).'' This ICR is necessary due to the paperwork requirement to complete and maintain training certificates that drivers must present to prospective employers. These certificates serve as proof the drivers have successfully completed sufficient training to operate LCVs safely on our Nation's highways. Motor carriers are required to maintain a copy of the training certification in each LCV driver's qualification (DQ) file, which may be reviewed by Federal or State enforcement officials.
Commercial Driver's License Advisory Committee
This notice sets forth the schedule for an additional meeting of the Commercial Driver's License (CDL) Advisory Committee. Pursuant to section 4135 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), the Secretary of Transportation established this advisory committee to study and address current impediments and foreseeable challenges to the commercial driver's license program's effectiveness and measures needed to realize the full safety potential of the commercial driver's license program. Members of the advisory committee include State motor vehicle administrators, organizations representing government agencies or officials, members of the Judicial Conference, representatives of the trucking industry, representatives of labor organizations, and safety advocates.
Medical Review Board Public Meeting
FMCSA announces that the MRB will hold its next meeting on July 26, 2007. The meeting will provide the public an opportunity to observe and participate in MRB deliberations about the revision and development of Federal Motor Carrier Safety Regulation (FMCSR) medical standards, in accordance with the Federal Advisory Committee Act (FACA).

Parts and Accessories Necessary for Safe Operation; Lamps and Reflective Devices
FMCSA amends its regulations concerning parts and accessories necessary for safe operation in response to a petition for reconsideration filed by the Truck Manufacturers Association. As requested by a petitioner, this amendment resolves an inconsistency between FMCSA's Federal Motor Carrier Safety Regulations and the National Highway Traffic Safety Administration's Federal Motor Vehicle Safety Standards.

FMCSA announces its decision to exempt seventy-three individuals from its rule prohibiting persons with insulin-treated diabetes mellitus (ITDM) from operating commercial motor vehicles (CMVs) in interstate commerce. The exemptions will enable these individuals to operate CMVs in interstate commerce.
Demonstration Project on NAFTA Trucking Provisions
The FMCSA announces additional details about the initiation of a project to demonstrate the ability of Mexico-domiciled motor carriers to operate safely in the United States beyond the commercial zones along the U.S.-Mexico border. On May 1, 2007, FMCSA published a notice in the Federal Register announcing its plans to initiate the project as part of the Agency's implementation of the North American Free Trade Agreement (NAFTA) cross-border trucking provisions. In response to section 6901(b)(2)(B) of the ``U.S. Troop Readiness, Veterans'' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007,'' FMCSA provides for public comment certain additional details concerning the demonstration project. The FMCSA will carefully consider all comments received in response to the May 1, 2007, notice and this supplemental notice before further decisions are made concerning the implementation of the NAFTA trucking demonstration/pilot project.
Fees for Unified Carrier Registration Plan and Agreement; Correction
On May 29, 2007, (72 FR 29472), FMCSA published a proposed rule in the Federal Register that would establish annual fees and a fee bracket structure for the Unified Carrier Registration Agreement. This action is required under the Unified Carrier Registration Act of 2005, enacted as Subtitle C of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users. This document corrects some errors in that proposed rule.

FMCSA announces its decision to renew the American Pyrotechnics Association (APA) exemption from FMCSA's regulation that drivers of commercial motor vehicles (CMVs) may not drive after the 14th hour of coming on duty. The exemption for 70 motor carriers and approximately 3,000 drivers is applicable for a period beginning 7 days prior to and 2 days immediately following Independence Day in 2007 and 2008. Drivers who operate CMVs in conjunction with staging fireworks shows celebrating Independence Day will be allowed to exclude off-duty and sleeper-berth time of any length from the calculation of the 14 hours. These drivers will not be allowed to drive after accumulating a total of 14 hours of on-duty time, following 10 consecutive hours off duty, and will continue to be subject to the 11- hour driving time limit, and the 60- and 70-hour on-duty limits. The terms and conditions of the current exemption will remain in place for a second two-year period. FMCSA believes that with the terms and conditions in place, APA will maintain a level of safety that is equivalent to, or greater than, the level of safety that would be obtained by complying with the regulation.

Demonstration Project on NAFTA Trucking Provisions
FMCSA announces the initiation of a project to demonstrate the ability of Mexico-based motor carriers to operate safely in the United States beyond the commercial zones along the U.S.-Mexico border. The project is part of FMCSA's implementation of the North American Free Trade Agreement (NAFTA) cross-border trucking provisions. The demonstration project will allow up to 100 Mexico-domiciled motor carriers to operate throughout the United States for one year. Up to 100 U.S.-domiciled motor carriers will be granted reciprocal rights to operate in Mexico for the same period. Participating Mexican carriers and drivers will be required to comply with all applicable U.S. laws and regulations, including those concerned with motor carrier safety, customs, immigration, vehicle registration and taxation, and fuel taxation. The safety of the participating carriers will be tracked closely by FMCSA and its State partners, a joint U.S.-Mexico monitoring group, and an evaluation panel independent of the Department of Transportation (DOT). The resulting data will be considered carefully before further decisions are made concerning the implementation of the NAFTA trucking provisions.

Volvo had requested that the exemption cover three Swedish engineers and technicians who will test drive CMVs for Volvo within the U.S. They stated the exemption is needed to support a Volvo field test to meet future air quality standards, and to test- drive Volvo prototype vehicles to verify results in ``real world'' environments. Each of these drivers holds a valid CDL issued in Sweden, but lacks the U.S. residency necessary to obtain a CDL issued by one of the States in the U.S. The FMCSA believes the knowledge and skills testing and training program that drivers must undergo to obtain a Swedish CDL ensures that these drivers will achieve a level of safety that is equivalent to, or greater than, the level of safety achieved without the exemption.

Agency Information Collection Activities; Revision of Approved Information Collections: OMB Control Numbers 2126-0010 (Motor Carrier Safety Assistance Program) and 2126-0025 (Transportation of Household Goods; Consumer Protection)
The FMCSA invites public comment on its intent to request approval from the Office of Management and Budget (OMB) to revise two (2) information collections (ICs) entitled, ``Motor Carrier Safety Assistance Program'' (2126-0010) and ``Transportation of Household Goods; Consumer Protection'' (2126-0025). These revised ICs are necessary to ensure that motor carriers and the States comply with changes made by various provisions of the Safe Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), that will be implemented in a separate final rule. On November 20, 2006, the agency published a Federal Register notice with a 60-day comment period to solicit the public's views on three information collections. The agency received one comment, which contained no substantive remarks pertaining to any of the information collections, and consequently was not incorporated into our supporting statement. We are required to publish this notice in the Federal Register by the Paperwork Reduction Act of 1995 and implementing regulations.
Notice of Request for Information (RFI): Accident Recordkeeping Requirements
In accordance with the Paperwork Reduction Act of 1995, FMCSA invites public comment on its intent to request approval from the Office of Management and Budget (OMB) to revise the information collection (IC) entitled, ``Accident Recordkeeping Requirements,'' covered by OMB Control Number 2126-0009. This information collection is necessary for FMCSA to assess the effectiveness of the safety management controls of motor carriers. The IC is currently due to expire on June 30, 2007.
Notice of Request for Comments on Renewal of a Currently Approved Information Collection: FMCSA COMPASS Portal Customer Satisfaction Assessment
In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the new Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for review and approval. This information collection involves the assessment of FMCSA's strategic decision to integrate its Information Technology (IT) with its business processes using portal technology to consolidate its systems and databases and launch a modernization initiative to create the FMCSA COMPASS Portal. The information to be collected will be used to assess the satisfaction of Federal, State and industry customers with the FMCSA COMPASS Portal. The Agency published a Federal Register notice allowing for a 60-day comment period on the ICR in October 2006 (71 FR 61824, Oct. 19, 2006). The Agency did not receive any comments from the public that were responsive to this notice.

Requirements for Intermodal Equipment Providers and Motor Carriers and Drivers Operating Intermodal Equipment; Reopening of Comment Period
The Federal Motor Carrier Safety Administration (FMCSA) is reopening until May 21, 2007, the comment period on its December 21, 2006 notice of proposed rulemaking (NPRM) concerning inspection, repair and maintenance responsibilities for intermodal equipment providers and motor carriers operating container chassis. The FMCSA is also announcing a series of public listening sessions to obtain additional feedback on the Agency's NPRM from motor carriers, representatives of the intermodal transportation industry, and interested parties. The listening sessions are intended to provide all interested parties an opportunity to respond to the issues associated with this rulemaking. All oral comments will be transcribed and placed in the public docket identified at the beginning of this notice.

In accordance with the Paperwork Reduction Act of 1995, FMCSA announces that its Information Collection Request (ICR) described below has been sent to the Office of Management and Budget (OMB) for review and approval. The ICR describes a proposed collection activity involving all motor carriers who operate small passenger-carrying commercial motor vehicles (CMVs) and its expected cost and burden. A Federal Register notice allowing for a 60-day comment period on the ICR was published on December 8, 2006. FMCSA received four comments to this docket, but only one of those comments addressed the information collection process set forth in this notice. This comment was considered during the development of the survey for this information collection.

FMCSA announces its decision to approve Isuzu Motors America, Inc.'s (Isuzu) application for an exemption for 76 of its drivers to enable them to test-drive commercial motor vehicles (CMVs) in the United States without a commercial driver's license (CDL) issued by one of the States. The Isuzu CMVs are prototypes that require testing under U.S. climatic conditions prior to being placed on the U.S. market. Each of these drivers holds a CDL issued in Japan, but lacks the U.S. residency necessary to obtain a CDL issued by one of the States of the United States. FMCSA believes the knowledge and skills testing and training program that drivers must undergo to obtain a Japanese CDL ensures that these drivers will achieve a level of safety that is equivalent to, or greater than, the level of safety achieved without the exemption.

FMCSA previously announced its decision to renew Isuzu Motors America, Inc.'s (Isuzu) exemption for 19 of its drivers to enable them to test-drive commercial motor vehicles (CMVs) in the United States without a commercial driver's license (CDL) issued by one of the States. Following the renewal one comment to the public docket was received. The Agency has considered the comment and continues to believe the knowledge and skills testing and training program that drivers must undergo to obtain a Japanese CDL ensures that each of these 19 drivers will achieve a level of safety that is equivalent to, or greater than, the level of safety achieved without the exemption. The Agency therefore declines to rescind or change the terms of the exemption.
Notice of Request To Revise a Currently-Approved Information Collection: Request for Revocation of Authority Granted
In accordance with the Paperwork Reduction Act of 1995 (PRA), FMCSA announces its plan to submit to the Office of Management and Budget (OMB) its request to revise a currently-approved information collection (IC) entitled, ``Request for Revocation of Authority Granted,'' docketed as OMB Control Number 2126-0018. This information collection notifies the FMCSA of a voluntary request by a motor carrier, freight forwarder, or property broker to amend or revoke its registration of authority granted. FMCSA will seek OMB's review and approval of this revised IC and invites public comment on this request. The Paperwork Reduction Act requires the publication of this notice.
Notice of Request for Comments on New Information Collection: Survey of Medical Examiners Who Certify the Physical Qualifications of Commercial Motor Vehicle (CMV) Drivers
In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for review and approval. The ICR describes a proposed collection activity and its expected cost and burden. The Federal Register notice allowing for a 60-day comment period on the ICR was published on June 19, 2006 (71 FR 35324). Four comments were received in response to the notice. Two individuals supported the proposed information collection and two commented on matters outside of the scope of the proposed information collection. These comments are addressed in the ICR that will be submitted to OMB.
Agency Information Collection Activities; Request for Comments on a New Information Collection: Commercial Motor Vehicle Driver Risk Factor Study
The FMCSA invites comments on its plan to request the Office of Management and Budget's (OMB) approval of a new information collection (IC) associated with the agency's study to investigate commercial motor vehicle (CMV) driver risk factors. The study will be conducted by a research contractor. This IC will aid FMCSA in developing future safety initiatives by examining a wide array of driver and situational factors to determine if they are associated with increased or decreased crash involvement. FMCSA announces receipt of applications from 74 individuals for exemptions from the prohibition against persons with insulin- treated diabetes mellitus (ITDM) operating commercial motor vehicles (CMVs) in interstate commerce. If granted, the exemptions would enable these individuals with ITDM to operate CMVs in interstate commerce.
