The American Association of State Highway and Transportation Officials (AASHTO) Manual for Condition Evaluation of Bridges, 1994, second edition (also referred to as ``the Manual''), together with the 2001 and 2003 Interim Revisions, is incorporated by reference in FHWA regulations, approved by the Federal Highway Administration, and recognized as a national standard for bridge inspections and load rating. The purpose of this final rule is to update the incorporation by reference language to incorporate the most recent version of the AASHTO Manual, now known as The Manual for Bridge Evaluation, First Edition, 2008.

The FHWA is issuing this notice to advise the public that the Notice of Intent to prepare an Environmental Impact Statement (EIS) for the proposed San Ysidro port of Entry located in the city of San Diego in San Diego County (Federal Register Vol. 68, No 127; FR Doc 03- 16784), California will be rescinded.

The Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD) (also referred to as ``the Manual'') is incorporated by reference within our regulations, approved by the Federal Highway Administration, and recognized as the national standard for traffic control devices used on all public roads. The purpose of this final rule is to revise standards, guidance, options, and supporting information relating to the traffic control devices in all parts of the MUTCD to expedite traffic, promote uniformity, improve safety, and incorporate technology advances in traffic control device application. The MUTCD, with these changes incorporated, is being designated as the 2009 Edition of the MUTCD.

The FHWA, on behalf of Caltrans, is issuing this notice to announce actions taken by Caltrans, and applicable Federal agencies that are final within the meaning of 23 U.S.C. 139(l)(1). The actions relate to a proposed highway project, State Route 152, Los Banos Bypass Project postmiles 16.0 to 24.8 in Merced County, State of California. This notice announces the availability of the Final Environmental Impact Statement (FEIS) and Section 4(f) Evaluation for the DIFT. The actions relate to a proposed highway project, the State Route 160 Antioch Bridge Seismic Retrofit Project, with end points in the city of Antioch in Contra Costa County, and on Sherman Island in Sacramento County, State of California. The FHWA is issuing this notice to advise the public that the Notice of Intent to prepare an Environmental Impact Statement (EIS) for the proposed Interstate I-805 Managed Lanes South Project located in the cities of San Diego and Chula Vista in San Diego County (Federal Register Vol. 72, No 176; FR Doc E7-17912), California will be withdrawn, and an Environmental Assessment (EA) in lieu of an EIS is being prepared for this proposed highway project.

This notice provides information regarding the FHWA's finding that a Buy America waiver is appropriate for the purchase of foreign roof tiles made of 40/45 KSI 2, 24 gauge (0.0276) galvanized steel with Kynar PPG 5LR82411 on a Federal-aid/American Recovery and Reinvestment Act project no. X-STP-5900 (180) in Portland, Oregon.

The FHWA is issuing this notice to advise the public that a Supplemental Draft Environmental Impact Statement (SDEIS) is being prepared for transportation improvements to the USH 18 & 151 (Verona Rd) corridor from CTH PD to USH 12 & 14 in the Madison Urban Area, Dane County, Wisconsin, WisDOT Project 1206-07-03. The SDEIS is being prepared in conformance with 40 CFR 1500 and FHWA regulations.

Section 1604(b)(7) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Pub. L. 109-59; Aug. 10, 2005), authorizes the Secretary of Transportation (Secretary) to develop and publish performance goals for each express lane project accepted under the Express Lanes Demonstration Program. This notice lists the Performance Goals, Monitoring and Reporting Program requirements for the IH-30 (the Tom Landry Freeway) Express Lanes project and IH-35E Express Lanes project in Dallas in the State of Texas.

The FHWA is adding a new part to the Code of Federal Regulations, to add regulations specifying the interoperability requirements for automated toll collection systems for the facilities that are tolled under any of the tolling programs contained in section 1604 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). Specifically, this rulemaking requires facilities operating with authority under section 1604 of SAFETEA-LU to use electronic toll collection (ETC) systems and to maximize their system's interoperability with other toll facilities. Although a nationwide interoperability standard has not yet been established, this rule seeks to accelerate progress toward achieving nationwide interoperability by requiring these facilities to upgrade their ETC systems to the national standards whenever adopted.

The FHWA invites public comment regarding our intention to request the Office of Management and Budget (OMB) to approve a renewed information collection. The information we collect is provided by each State Department of Transportation (State) in its right-of-way operations manuals. The right-of-way manuals contain detailed descriptions of procedures the State will follow to show compliance with Federal regulations found in 23 CFR Part 710 and 49 CFR Part 24. 23 CFR 710.201(c) sets out the requirement for the right-of-way operations manual. Specifically, each manual shall describe functions and procedures for all phases of the real estate program, including appraisal and appraisal review, negotiation and eminent domain, property management, and relocation assistance. The State shall update the manual periodically to reflect changes in operations and submit the updated manual for approval by the FHWA. The Paperwork Reduction Act of 1995 required the FHWA to publish notice for this information collection in the Federal Register.
