The Environmental Protection Agency (EPA) is proposing to approve a revision to New York's section 111(d) state plan (the ``State Plan'') for Municipal Solid Waste (MSW) landfills, pursuant to the Clean Air Act (``CAA'' or the ``Act''). The proposed State Plan revision consists of amendments to New York's ``Landfill Gas Collection and Control Systems for Certain Municipal Solid Waste Landfills,'' as well as attendant revisions to ``General Provisions.'' The primary goal of this regulation is to implement and enforce the Emission Guidelines (EG) promulgated by the EPA for MSW landfills on August 29, 2016. The goal of the revised federal EG is to reduce emissions of landfill gas containing Non-methane Organic Compounds (NMOC) and methane by lowering the emissions threshold at which an existing MSW landfill must install and operate a Gas Collection and Control System (GCCS). The emission threshold reduction will address air emissions from all affected MSW landfills, including NMOC and methane. The reduction of emissions will improve air quality and protect the public health from exposure to landfill gas emissions.

State Formula Allocations for Sewer Overflow and Stormwater Reuse Grants

The Environmental Protection Agency (EPA) is announcing the allocation formula for the Sewer Overflow and Stormwater Reuse Municipal Grants Program as required by the Clean Water Act (CWA). EPA is required to establish a formula to allocate proportional shares of the amount appropriated to state entities to fund actions that will help manage combined sewer overflows, sanitary sewer overflows, and stormwater. EPA was directed to develop a formula based on the relevant infrastructure needs submitted in the latest Clean Watersheds Needs Survey (CWNS) along with additional information considered appropriate by the EPA Administrator. A summary of the formula is included in this document. This document reflects EPA's consideration of public comments received in response to its August 4, 2020 Federal Register publication.

The Environmental Protection Agency (EPA) is approving and conditionally approving State Implementation Plan (SIP) revisions submitted by the State of Colorado on May 31, 2017, May 14, 2018 and May 8, 2019. The revisions are to Colorado Air Quality Control Commission (Commission or AQCC) Regulation Number 7 (Reg. 7). The revisions to Reg. 7 address Colorado's reasonably available control technology (RACT) SIP obligations for Moderate 2008 ozone nonattainment areas; add incorporation by reference dates to rules and reference methods; and make typographical, grammatical, and formatting corrections. Also, in this action the EPA is correcting a July 3, 2018 final rule pertaining to Colorado's SIP. In that action, we inadvertently omitted regulatory text corresponding to ``incorporation by reference'' (IBR) materials for graphic arts and printing revisions to Reg. 7, Section XIII (adopted November 17, 2016). The EPA is taking this action pursuant to the Clean Air Act (CAA).
Full Approval of Revised Clean Air Act Operating Permit Program; North Dakota

With this direct final rule, the Environmental Protection Agency (EPA or the ``Agency'') is promulgating full approval of the revised and recodified North Dakota operating permit program for stationary sources subject to title V of the Clean Air Act (CAA or the ``Act''). On August 6, 2018, North Dakota submitted a request for approval of its revisions to the North Dakota operating permit program (the ``title V program'') for stationary sources subject to title V of the CAA and recodification of the State's title V program under a new title of the North Dakota Administrative Code (NDAC). The EPA determined that the revised and recodified program substantially met the requirements of title V of the Act and Code of Federal Regulations (CFR) but was not fully approvable because the State law provisions for judicial review were not consistent with program requirements found in the CFR. Thus, EPA issued an interim approval of North Dakota's title V program. North Dakota has made the changes required for full program approval. Accordingly, the EPA is taking this action in accordance with the CAA and CFR title V program approval requirements. This is a direct final action because the action is deemed noncontroversial and we do not expect adverse comments.

The Environmental Protection Agency (EPA or the ``Agency'') is proposing full approval of the revised and recodified North Dakota operating permit program for stationary sources subject to title V of the Clean Air Act (CAA or the ``Act''). On August 6, 2018, North Dakota submitted a request for approval of its revisions to the North Dakota operating permit program (the ``title V program'') for stationary sources subject to title V of the CAA and recodification of the State's title V program under a new title of the North Dakota Administrative Code (NDAC). The EPA determined that the revised and recodified program substantially met the requirements of title V of the Act and Code of Federal Regulations (CFR) but was not fully approvable because the State law provisions for judicial review were not consistent with program requirements found in the CFR. Thus, EPA issued an interim approval of North Dakota's title V program. North Dakota has made the changes required for full program approval. Accordingly, the EPA is proposing this action in accordance with the CAA and CFR title V program approval requirements.

Pursuant to the Federal Clean Air Act (CAA or the Act), the Environmental Protection Agency (EPA) is notifying the public that we have received a CAA section 111(d)/129 negative declaration from Louisiana for existing incinerators subject to the Other Solid Waste Incineration units (OSWI) Emission Guidelines (EG). This negative declaration certifies that existing incinerators subject to the OSWI EG and the requirements of sections 111(d) and 129 of the CAA do not exist within Louisiana. The EPA is proposing to accept the negative declaration and amend the agency regulations in accordance with the requirements of the CAA.

This proposed revision updates the SIP with local SRCAA regulations that apply in lieu of, or in supplement to, Ecology's statewide general air quality regulations for SRCAA's jurisdiction. We are also proposing to approve SRCAA's adoption by reference of certain Ecology general air quality regulations, which do not have local agency replacement corollaries, to apply in SRCAA's jurisdiction.

On June 1, 2020, the Environmental Protection Agency (EPA) published a rulemaking proposing to approve multiple elements of the infrastructure SIP requirements for the 2015 ozone NAAQS for the State of Utah, while taking no action on three infrastructure elements (85 FR 33052). On September 16, 2020, we published a rulemaking taking final action on the proposal. The final rulemaking incorrectly stated that there were no comments received during the public comment period for the proposed rulemaking (85 FR 57731). One comment, submitted electronically on July 1, 2020, had been received but was inadvertently overlooked in the preparation of the September 16 final rule. In this correction document we will respond to the comment received.

This action responds to a petition for amendment to exclude (or ``delist'') up to 1,450 cubic yards per year of K006 chromic oxide solids from the list of federal hazardous wastes when disposed of in an on-site surface impoundment in lieu of disposal in a Subtitle D Landfill. The Agency is proposing to grant the petition based on an evaluation of waste-specific information provided by the petitioner.

All 10 of the Environmental Protection Agency's (EPA) Regions are finalizing the 2021 National Pollutant Discharge Elimination System (NPDES) general permit for stormwater discharges associated with industrial activity, also referred to as the ``2021 Multi-Sector General Permit (MSGP)'' or the ``final permit.'' This final permit replaces EPA's administratively continued 2015 MSGP that expired on June 3, 2020. EPA is issuing this permit for five (5) years to provide permit coverage to eligible operators in all areas of the country where EPA is the NPDES permitting authority, including Idaho (until July 1, 2021), Massachusetts, New Hampshire, New Mexico, Indian country lands, Puerto Rico, the District of Columbia, and most U.S. territories and protectorates. The Environmental Protection Agency (EPA) is announcing the availability of and soliciting public comment on a manufacturer request for a risk evaluation under the Toxic Substances Control Act (TSCA) of ethanone, 1-(1,2,3,4,5,6,7,8-octahydro-2,3,5,5-tetramethyl-2- naphthalenyl), ethanone, 1-(1,2,3,4,5,6,7,8-octahydro-2,3,8,8- tetramethyl-2-naphthalenyl), ethanone, 1-(1,2,3,4,6,7,8,8a-octahydro- 2,3,8,8-tetramethyl-2-naphthalenyl), and ethanone, 1-(1,2,3,5,6,7,8,8a- octahydro-2,3,8,8-tetramethyl-2-naphthalenyl) (collectively, ``OTNE''). The request was made by International Flavors and Fragrances, Inc. (IFF), Privi Organics USA Corporation (Privi), and DRT America, Inc. (DRT) through the OTNE Consortium. EPA conducts risk evaluations to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment without consideration of costs or other non-risk factors, including an unreasonable risk to potentially exposed or susceptible subpopulations, under the conditions of use. In the docket associated with this request is the manufacturer request for an EPA-conducted risk evaluation and possible additional conditions of use EPA has identified for inclusion within the scope of a risk evaluation of OTNE. EPA specifically invites public comment on the inclusion of any additional conditions of use and potentially exposed or susceptible subpopulations. The Agency is in the process of broadly re-examining how it intends to implement these and other provisions of amended TSCA including determining how new executive orders and other direction provided by the Biden-Harris Administration will be addressed. This process would benefit greatly from stakeholder feedback. After considering comments received in response to this solicitation, EPA will determine whether to grant or deny the manufacturer request. On January 15, 2021, EPA issued a Federal Register notice of public hearing and supplemental information regarding a recommendation submitted by the Ozone Transport Commission (OTC) to address ongoing ozone pollution in the northeastern United States. The OTC has recommended that EPA require Pennsylvania to revise its state implementation plan (SIP) to include additional control measures that would establish daily limits on emissions of nitrogen oxides (NOX) from coal-fired electricity generating units (EGUs) with already-installed selective catalytic reduction (SCR) or selective noncatalytic reduction (SNCR) controls. This regulation amends the existing tolerance exemption for residues of Complex Polymeric Polyhydroxy Acids (CPPA) in or on all food commodities as a plant growth regulator to add use as a nematicide in pesticide formulations. FBSciences, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA) requesting this amendment. This regulation adds use as a nematicide to the existing tolerance exemption of CPPA under FFDCA.

On October 22, 2012, the EPA published a final rule in the Federal Register promulgating a Federal Implementation Plan (FIP) intended to address regional haze obligations for the Territory of the United States Virgin Islands. However, at that time EPA erroneously failed to incorporate into the Code of Federal Regulations (CFR) certain emission limits that had been determined to be necessary to satisfy those obligations and that had been proposed and included in the docket for the action. EPA is proposing to correct this inadvertent error by incorporating the previously noticed limits into the CFR. EPA is not reopening any of its previous determinations here.

This notice announces EPA's final order for the amendment to terminate uses, voluntarily requested by the registrant and accepted by the Agency, of the uses listed in Table 1 of Unit II., pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This termination order follows an August 6, 2020 Federal Register Notice of Receipt of Request from the registrant listed in Table 2 of Unit II. to voluntarily amend Chem-Tech, Ltd (Chem-Tech) dust formulations to terminate TCVP use on dogs, cats and in kennels and dog houses. In the August 6, 2020 notice, EPA indicated that it would issue an order implementing the use deletions, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrant withdrew their request. The Agency did not receive any comments on the notice nor did the registrant withdraw their request. Accordingly, EPA hereby issues in this notice a termination order granting the requested amendments to terminate TCVP use on dogs, cats and in kennels and dog houses. Any distribution, sale, or use of the products subject to this use deletion order is permitted only in accordance with the terms of this order, including any existing stocks provisions.

This notice announces EPA's rescission of two previously issued cancellation orders for seven triadimefon product registrations that have not yet become effective. Specifically, this notice rescinds cancellation orders announced in two previously issued Federal Register Notices from January 12, 2021, 2020 (FRL-10017-33) and August 25, 2020 (FRL-10013-65). These cancellation orders are being rescinded to the extent they are applicable to Bayer's triadimefon products.
