Oxathiapiprolin; Pesticide Tolerances
This regulation establishes tolerances for residues of oxathiapiprolin in or on multiple commodities which are identified and discussed later in this document. The Interregional Project Number 4 (IR-4) and the registrant, Syngenta Crop Protection requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
National Emission Standards for Hazardous Air Pollutants: Generic Maximum Achievable Control Technology Standards Residual Risk and Technology Review for Ethylene Production
This action finalizes the residual risk and technology review (RTR) conducted for the Ethylene Production source category regulated under National Emission Standards for Hazardous Air Pollutants (NESHAP). In addition, the U.S. Environmental Protection Agency (EPA) is taking final action to correct and clarify regulatory provisions related to emissions during periods of startup, shutdown, and malfunction (SSM), including removing general exemptions for periods of SSM, adding work practice standards for periods of SSM where appropriate, and clarifying regulatory provisions for certain vent control bypasses. The EPA is also taking final action to revise requirements for heat exchange systems; add monitoring and operational requirements for flares; add provisions for electronic reporting of performance test results and other reports; and include other technical corrections to improve consistency and clarity. We estimate that these final amendments will reduce hazardous air pollutants (HAP) emissions from this source category by 29 tons per year (tpy) and reduce excess emissions of HAP from flares by an additional 1,430 tpy.
Public Hearing for Vehicle Test Procedure Adjustments for Tier 3 Certification Test Fuel
The Environmental Protection Agency (EPA) is announcing a virtual public hearing to be held July 13, 2020, on its proposed Vehicle Test Procedure Adjustments for Tier 3 Certification Test Fuel rule, which was published on May 13, 2020. EPA is proposing adjustment factors to apply to vehicle GHG and fuel economy test results for the GHG and CAFE programs and the Fuel Economy and Environment Label as EPA separately implements changes in light-duty vehicle gasoline test fuel properties.
Approval and Promulgation of Implementation Plans; Designation of Areas for Air Quality Planning Purposes; California; South Coast Moderate Area Plan and Reclassification as Serious Nonattainment for the 2012 PM2.5
The Environmental Protection Agency (EPA) is proposing to approve or conditionally approve portions of a state implementation plan (SIP) revision submitted by California to address Clean Air Act (CAA or ``Act'') requirements for the 2006 and 2012 fine particulate matter (PM2.5) national ambient air quality standards (NAAQS or ``standards'') in the Los Angeles-South Coast Air Basin (``South Coast'') PM2.5 nonattainment area. Specifically, the EPA is proposing to approve all but the contingency measure element of the submitted SIP revision as meeting all applicable Moderate area requirements for the 2012 annual PM2.5 NAAQS, and to conditionally approve the contingency measure element as meeting both the Moderate area contingency measure requirement for the 2012 annual PM2.5 NAAQS and the Serious area contingency measure requirement for the 2006 24-hour PM2.5 NAAQS. In addition, the EPA is proposing to approve 2019 and 2022 motor vehicle emissions budgets for use in transportation conformity analyses for the 2012 annual PM2.5 NAAQS. The EPA is also proposing to reclassify the South Coast PM2.5 nonattainment area, including reservation areas of Indian country and any other area of Indian country within it where the EPA or a tribe has demonstrated that the tribe has jurisdiction, as a Serious nonattainment area for the 2012 annual PM2.5 NAAQS based on the EPA's determination that the area cannot practicably attain the standard by the applicable Moderate area attainment date of December 31, 2021. Upon final reclassification of the South Coast as a Serious area for this NAAQS, California will be required to submit a Serious area plan for the area that includes a demonstration of attainment by the applicable Serious area attainment date, which is no later than December 31, 2025, or by the most expeditious alternative date practicable, in accordance with the requirements of part D of title I of the CAA.
National Emission Standards for Hazardous Air Pollutants: Cellulose Products Manufacturing Residual Risk and Technology Review
This action finalizes the residual risk and technology review (RTR) conducted for the Miscellaneous Viscose Processes and Cellulose Ether Production source categories regulated under the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Cellulose Products Manufacturing. The EPA is finalizing the proposed determination that the risks from both source categories are acceptable and that the current NESHAP provides an ample margin of safety to protect public health. The EPA identified no new cost-effective controls under the technology review to achieve further emissions reductions. These final amendments address emissions during startup, shutdown, and malfunction (SSM) events; add electronic reporting requirements; add provisions for periodic emissions performance testing for facilities using non-recovery control devices; add a provision allowing more flexibility for monitoring of biofilter control devices; and make technical and editorial changes. Although these amendments are not expected to reduce emissions of hazardous air pollutants (HAP), they will improve monitoring, compliance, and implementation of the rule.
Determinations of Light-Duty Vehicle Alternative Greenhouse Gas Emissions Standards for Small Volume Manufacturers
The Environmental Protection Agency (EPA) is finalizing determinations of light-duty vehicle greenhouse gas emissions alternative standards for four small volume manufacturers: Aston Martin, Ferrari, Lotus and McLaren. The alternative standards in these determinations cover model years 2017-2021 and are established pursuant to small volume manufacturer provisions in EPA's light-duty vehicle greenhouse gas regulations.
Commonwealth of Kentucky: Tentative Approval of State Underground Storage Tank Program
The Commonwealth of Kentucky (Commonwealth or State) has applied for final approval of its Underground Storage Tank (UST) Program under Subtitle I of the Resource Conservation and Recovery Act (RCRA or Act). The Environmental Protection Agency (EPA) has reviewed the Commonwealth's application and made the tentative decision that the State's UST Program application satisfies all the requirements necessary to qualify for final approval. The State's UST Program application is available for public review and comment. A public hearing will be held to solicit comments on the application if sufficient public interest is expressed. This Federal Register notice solicits requests for a public hearing and comments on the State's application.
Air Plan Approval; West Virginia; Redesignation of the Marshall Sulfur Dioxide Nonattainment Area to Attainment and Approval of the Area's Maintenance Plan
The Environmental Protection Agency (EPA) is proposing to approve a redesignation request and state implementation plan (SIP) revisions submitted by the State of West Virginia related to the national ambient air quality standard (NAAQS or Standard) for the 2010 1-hour sulfur dioxide (SO2) NAAQS (2010 SO2 NAAQS). On March 18, 2020, West Virginia, through the West Virginia Department of Environmental Protection (WVDEP), submitted a redesignation request for the Marshall, West Virginia SO2 Nonattainment Area (Marshall Area or Area). In conjunction with its request, WVDEP submitted SIP revisions comprised of a maintenance plan providing for continued attainment of the SO2 NAAQS for a period of ten years following redesignation of the Area, SO2 emissions limits for the Mitchell Power Plant (Mitchell), and a modeling analysis demonstrating that the Mitchell limits provide for attainment in the Area. The effect of this proposal, if finalized, would change the designation of the Marshall Area from nonattainment to attainment of the 2010 SO2 NAAQS. This action is being taken under the Clean Air Act (CAA).

Air Plan Approval; New Hampshire; Single Source Order for PSI Molded Plastics
The Environmental Protection Agency (EPA) is approving a State Implementation Plan (SIP) revision submitted by the State of New Hampshire. The revision consists of a single source Order that New Hampshire issued to PSI Molded Plastics defining reasonably available control technology (RACT) requirements for the facility. This action is being taken under the Clean Air Act.
