The Environmental Protection Agency (EPA) is proposing to approve the 2006 24-hour fine particulate matter (PM2.5) 2008 base year emissions inventory portion of the State Implementation Plan (SIP) revision submitted by the State of Tennessee through the Tennessee Department of Environment and Conservation on October 18, 2013. The emissions inventory is part of Tennessee's October 18, 2013, attainment demonstration SIP revision that was submitted to meet Clean Air Act requirements related to the Knoxville nonattainment area for the 2006 24-hour PM2.5 national ambient air quality standards, hereafter referred to as ``the Knoxville Area'' or ``Area.'' The Knoxville nonattainment area is comprised of Anderson, Blount, Knox and Loudon Counties in their entireties and a portion of Roane County that includes the Tennessee Valley Authority's Kingston Fossil Plant.
Greenhouse Gas Reporting Program: Publication of Aggregated Greenhouse Gas Data

The Environmental Protection Agency (EPA) intends to publish aggregated versions of certain data collected under the Greenhouse Gas Reporting Program, including totals, averages, and other aggregated versions of data submitted by individual reporters. The data that we intend to aggregate were determined in previous rulemakings to be confidential business information in their original, non-aggregated form. This notice describes the criteria we plan to use to determine whether confidential data are sufficiently aggregated such that publishing them would provide useful information while protecting the data that are entitled to confidentiality. In a memorandum to the docket for this notice, we also provide a list of data elements that we have identified for possible future publication in aggregated form if they meet the final version of these criteria.

Essential use exemptions are exceptions to the phaseout of production and import of controlled class I ozone- depleting substances (ODS). Essential use exemptions must be authorized by the Parties to the Montreal Protocol on Substances That Deplete the Ozone Layer and must be in accordance with the Clean Air Act. Applications received in accordance with this notice will be considered as the basis for submitting potential nominations for essential use exemptions to future Meetings of the Parties to the Montreal Protocol.

In accordance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is issuing a notice of receipt of requests by the registrant to voluntarily amend PCNB registrations for one manufacturing-use product and two end-use products to terminate or delete a number of uses. The requests would delete the use of Technical Grade PCNB (EPA Registration 5481-197) for formulation into products for use as seed treatments (except for the treatment of cloves of garlic) and products for use on certain non-residential terrestrial non-food crops. The requests also would terminate the use of the PCNB product with EPA Registration 5481-8988 on bedding plants, flowering plants, foliage plants, and bulb crops, and the use of the PCNB product with EPA Registration 5481-8992 on bedding plants, flowering plants, foliage plants, azaleas, camellias, gladiolus (broadcast), and cut flowers. These use deletion requests are detailed in Table 1 in Unit III. The requests would not terminate the last PCNB products registered for use in the United States. EPA intends to grant these requests at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the requests, or unless the registrant withdraws its request(s). If these requests are granted, any sale, distribution, or use of products listed in this notice will be permitted after the uses are deleted only if such sale, distribution, or use is consistent with the terms as described in the final order.

Sodium Bisulfate; Exemption From the Requirement of a Tolerance

This regulation establishes an exemption from the requirement of a tolerance for residues of sodium bisulfate when used as an inert ingredient in antimicrobial formulations on food contact surfaces in public eating places, dairy processing equipment and food processing equipment and utensils at no more than 2,000 ppm in final formulation. Exponent on behalf of Ecolab, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of sodium bisulfate.

Request for Public Comment on Proposed Stipulated Injunction Involving Five Pesticides and Pacific Salmonid Species Listed as Threatened or Endangered Under the Endangered Species Act; Notice of Availability

EPA is requesting comments on a proposed stipulated injunction that, among other things, would reinstitute streamside no-spray buffer zones to protect endangered or threatened Pacific salmon and steelhead in California, Oregon, and Washington. The stipulated injunction would settle litigation brought against EPA by the Northwest Center for Alternatives to Pesticides (NCAP) and others in U.S. District Court in Washington State. These buffers were originally established by the same court in prior litigation brought against EPA by the Washington Toxics Coalition (WTC) and others. Like the original buffer zones, the limitations in this proposed stipulated injunction would be part of a court order but would not be enforceable as labeling requirements under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). The no- spray buffer zones will apply to the pesticides carbaryl, chlorpyrifos, diazinon, malathion, and methomyl. These buffers would remain in place until EPA implements any necessary protections for Pacific salmon and steelhead based on reinitiated consultations with the National Marine Fisheries Service (NMFS). EPA is reevaluating these pesticides in connection with its current FIFRA registration review process and the proposed stipulated injunction would reinstitute the buffers in the interim. EPA will evaluate all comments received during the 30-day public comment period to determine whether all or part of the proposed stipulated injunction warrants reconsideration or revision.

The purpose of this Advance Notice of Proposed Rulemaking (ANPR) is to solicit broad feedback on the most effective and efficient means of implementing the Environmental Protection Agency's (EPA) Indian Country Minor New Source Review program for sources in the oil and natural gas production segment of the oil and natural gas sector. In particular, this ANPR discusses potential new source permitting approaches to address emissions from proposed new and modified oil and natural gas production activities. One approach is a general permit, which could serve as a streamlined permitting approach for addressing emissions from new and modified minor sources and minor modifications at major sources under the Indian Country Minor NSR rule. Another approach is a Federal Implementation Plan, which could address emissions from new and modified minor sources and minor modifications at major sources. Other possible approaches include a permit by rule, which is another streamlined permitting approach. The EPA is requesting comments on all available new source permitting approaches and will take this feedback into consideration in developing a notice of proposed rulemaking for this sector under the Indian Country Minor NSR program. In addition, while the focus of this ANPR is on permitting approaches for proposed new oil and natural gas production activities, the EPA believes that managing emissions from existing oil and natural gas sources in Indian country would result in greater consistency with surrounding state requirements. Addressing existing sources may be particularly important given the significant activity associated with the sector in Indian country and the resultant need to protect public health, balanced with tribes' inherent sovereignty and interest in promoting economic development. If the EPA decides to address existing oil and natural gas production sources, then we will be interested in considering comments regarding whether a FIP should be the mechanism used to establish permitting requirements for new and existing sources, especially in areas where surrounding states regulate existing sources.

This notice announces the availability of EPA's proposed registration review decisions and opens a public comment period on the proposed and proposed interim decisions. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, that the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment. This document also announces the registration review case closure for the pesticide amitrole (case 0095) and the availability of the amitrole case closure document. The cancellation of all amitrole product registrations became effective on April 11, 2014. This case closure for amitrole is being announced herein with no comment period.

EPA has received specific exemption requests from the Oregon Department of Agriculture to use the pesticide Fipronil (CAS No. 120068-37-3) to treat up to 600 acres of rutabaga and turnips to control the cabbage maggot. In accordance with section 113(g) of the Clean Air Act, as amended (``CAA'' or the ``Act''), notice is hereby given of a proposed consent decree to address a lawsuit filed by the Sierra Club and the Natural Resources Defense Council in the United States District Court for the Northern District of California, in which several states have intervened as plaintiff-interveners: Sierra Club et al. v. McCarthy, Civil Action No. 3:13-cv-3953-SI (N.D. Cal.). On August 26, 2013, Plaintiffs filed a complaint alleging that Gina McCarthy, in her official capacity as Administrator of the United States Environmental Protection Agency (``EPA''), failed to take timely nondiscretionary action to promulgate and publish the remaining area designations for the 2010 revised primary national ambient air quality standard (``NAAQS'') for sulfur dioxide (``SO2''). The proposed consent decree would establish deadlines for EPA to take such action.

On January 4, 2013, in Natural Resources Defense Council (NRDC) v. EPA, the D.C. Circuit Court remanded to the Environmental Protection Agency (EPA) the ``Final Clean Air Fine Particle Implementation Rule'' (April 25, 2007) (the ``2007 PM2.5 Implementation Rule'') and the ``Implementation of the New Source Review (NSR) Program for Particulate Matter Less than 2.5 Micrometers (PM2.5)'' final rule (May 16, 2008) (the ``2008 PM2.5 NSR Rule''). The Court found that the EPA erred in implementing the 1997 PM2.5 National Ambient Air Quality Standards (NAAQS) pursuant solely to the general implementation provisions of subpart 1 of Part D of Title I of the Clean Air Act (CAA or Act), without also considering the particulate matter-specific provisions of subpart 4 of Part D. The Court's ruling remanded the rules to the EPA to address implementation of the 1997 PM2.5 NAAQS under subpart 4. This final rulemaking identifies the classification under subpart 4 for areas currently designated nonattainment for the 1997 and/or 2006 PM2.5 standards, the deadlines for states to submit attainment-related and nonattainment new source review (NNSR) state implementation plan (SIP) elements required for these areas pursuant to subpart 4, and the EPA guidance that is currently available regarding subpart 4 requirements. The final deadlines for 1997 and 2006 PM2.5 NAAQS attainment-related SIP submissions and NNSR requirements for nonattainment areas would replace previous deadlines that were set solely pursuant to subpart 1. Specifically, the EPA is identifying the initial classification of current 1997 and/or 2006 PM2.5 NAAQS nonattainment areas as ``Moderate,'' and the EPA is setting a deadline of December 31, 2014, for submission of remaining required SIP submissions for these areas, pursuant to and considering the application of subpart 4. This rulemaking affects 1997 and 2006 PM2.5 NAAQS nonattainment areas. After the careful consideration of the comments received on the proposal, the EPA is planning to finalize the rule as it was proposed. As part of the final rulemaking, the EPA is also updating 40 CFR part 81, ``Designation of Areas for Air Quality Planning Purposes'' for the 1997 and 2006 PM2.5 NAAQS nonattainment areas.
