Approval and Promulgation of Air Quality Implementation Plans; Wisconsin; NSR Reform Regulations, Rule AM-06-04
Document Number: E7-7541
Type: Proposed Rule
Date: 2007-04-20
Agency: Environmental Protection Agency
EPA is proposing to approve certain revisions to Wisconsin's prevention of significant deterioration (PSD) and non-attainment new source review (NSR) construction permit programs submitted on May 25, 2006. On December 31, 2002, EPA published revisions to the federal PSD and non-attainment NSR regulations. These revisions are commonly referred to as ``NSR Reform'' regulations, which became effective on March 3, 2003. These regulatory revisions include provisions for determining baseline actual emissions, provisions for promulgating actual-to-future actual methodology, provisions for establishing Plantwide Applicability Limits (PALs), provisions for using the Clean Unit test, and, provisions for using Pollution Control Projects (PCP). On June 24, 2005, the United States Court of Appeals for the District of Columbia Circuit (DC Circuit Court) issued its ruling on challenges to the December 2002 NSR reform revisions. Although the Court upheld most of EPA's rules, it vacated both the Clean Unit and the PCP provisions. In addition, the Court remanded to EPA the provision that requires recordkeeping and reporting for sources that elect to use the actual-to-projected actual emission test only where there is a reasonable possibility that a project may result in a significant net emissions increase. EPA is currently working on promulgating a rule that will clarify the reasonable possibility provision. EPA's final decision with regard to the remand may require Wisconsin to revise this portion of its rules to be consistent with EPA's definition of reasonable possibility. The Wisconsin Department of Natural Resources (WDNR) is seeking approval of rule AM-06-04 to implement the NSR Reform provisions that have not been vacated by the June 24, 2005, DC Circuit Court decision. This action affects major stationary sources in Wisconsin that are subject to or potentially subject to the PSD, and non-attainment NSR construction permit programs.

Adequacy Status of the Youngstown, OH, Submitted 8-Hour Ozone Redesignation and Maintenance Plan for Transportation Conformity Purposes
Document Number: E7-7367
Type: Notice
Date: 2007-04-18
Agency: Environmental Protection Agency
In this notice, EPA is notifying the public that we have found that the motor vehicle emissions budgets (MVEBs) for volatile organic compounds (VOC) and oxides of nitrogen (NOX) in the Youngstown, Ohio area (Columbiana, Mahoning, and Trumbull Counties) are adequate for use in transportation conformity determinations. Ohio submitted these budgets with an 8-hour ozone redesignation request and maintenance plan on December 4, 2006, and February 20, 2007. As a result of our finding, Youngstown, Ohio must use the MVEBs from the submitted 8-hour ozone redesignation and maintenance plan for future conformity determinations.

Proposed Approval of the Central Characterization Project's Transuranic Waste Characterization Program at Los Alamos National Laboratory
Document Number: E7-7349
Type: Notice
Date: 2007-04-18
Agency: Environmental Protection Agency
The Environmental Protection Agency (EPA or we) is announcing the availability of, and soliciting public comments for 30 days on, the proposed approval of the radioactive, transuranic (TRU) waste characterization program implemented by the Central Characterization Project (CCP) at Los Alamos National Laboratory (LANL). This waste is intended for disposal at the Waste Isolation Pilot Plant (WIPP) in New Mexico. In accordance with the WIPP Compliance Criteria, EPA evaluated LANL-CCP's characterization of contact-handled TRU debris and solid waste during an inspection conducted May 23-25, 2006, as well as during follow-up inspections on August 22, 2006, and March 6, 2007. Using the systems and processes developed as part of the Department of Energy's (DOE's) Carlsbad Field Office (CBFO), EPA verified whether DOE could adequately characterize TRU waste consistent with the Compliance Criteria. The results of EPA's evaluation of the LANL-CCP program and the proposed approval are described in EPA's inspection report, which is available for review in the public dockets listed in ADDRESSES. We will consider public comments received on or before the due date mentioned in DATES. This notice summarizes the waste characterization processes evaluated by EPA and EPA's proposed approval. As required by the 40 CFR 194.8, at the end of a 30-day comment period EPA will evaluate public comments received, finalize the report responding to the relevant public comments, and issue the final report and an approval letter to DOE's CBFO. Based on previous EPA inspections and approvals, LANL-CCP is currently approved to dispose of debris and solid waste at WIPP. LANL-CCP is permitted to continue waste characterization and disposal in accordance with prior site approvals while EPA establishes a baseline approval.

This notice announces receipt by EPA of a request from the registrant Syngenta Crop Protection, Inc., to cancel all remaining pyridate product registrations. The request would terminate the last pyridate products registered for use in the United States. The last remaining pyridate products registered under FIFRA Section 3 were cancelled in 2004 for failure to pay the required annual maintenance fee (See Unit II for Federal Register cite), but there are several FIFRA 24(c) Special Local Needs registrations (for weed control on mint) that are still active. Syngenta Crop Protection, Inc., the registrant for all of the currently registered FIFRA 24(c) products, has requested cancellation of all of the remaining pyridate 24(c) products. EPA intends to grant this request at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the request, or unless the registrant withdraws their request within this period. Upon acceptance of this request, any sale, distribution, or use of products listed in this notice will be permitted only if such sale, distribution, or use is consistent with the terms as described in the final order.
Approval and Promulgation of Air Quality Implementation Plans; State of Utah; State Implementation Plan Corrections
Document Number: E7-7201
Type: Rule
Date: 2007-04-18
Agency: Environmental Protection Agency
When EPA approved Utah's Rule Recodification on February 14, 2006, we inadvertently incorporated by reference rules into the State Implementation Plan (SIP). When EPA approved Utah's Continuous Emission Monitoring Program on May 15, 2003, we inadvertently failed to remove the older version of the Continuous Emission Monitoring Program rule from the SIP. When EPA approved Revisions to the Utah Administrative Code on November 1, 2006, we inadvertently incorporated by reference incorrect state rules. Finally, when EPA approved Carbon Monoxide provisions for Provo, we inadvertently failed to remove the older version of Control Measures For Area and Point SourcesCarbon MonoxideProvo. EPA is correcting these errors with this document.
Approval and Promulgation of Implementation Plans; Revisions to the Nevada State Implementation Plan; Stationary Source Permits
Document Number: E7-7285
Type: Proposed Rule
Date: 2007-04-17
Agency: Environmental Protection Agency
EPA is proposing, under the Clean Air Act, approval of certain revisions to the applicable state implementation plan for the State of Nevada and full disapproval of certain other revisions. These revisions involve State rules governing applications for, and issuance of, permits for stationary sources, but not including review and permitting of major sources and major modifications under parts C and D of title I of the Clean Air Act. These revisions involve submittal of certain new or amended State rules and requests by the State for rescission of certain existing rules from the state implementation plan. The rescission requests for which we propose approval are contingent upon receipt of public notice and hearing documentation from the State. EPA is proposing this action under the Clean Air Act obligation to take action on State submittals of revisions to state implementation plans. The intended effect is to update the rules governing permitting in the applicable state implementation plan and to rescind unnecessary provisions from the applicable plan. EPA is taking comments on this proposal and plans to follow with a final action.
