The U.S. Environmental Protection Agency (EPA) is announcing the availability of the final ``Nanotechnology White Paper'' (EPA/100/ B-07/001, February 2007). The purpose of the White Paper is to inform EPA management of the science issues and needs associated with nanotechnology, to support related EPA program office needs, and to communicate these nanotechnology science issues to stakeholders and the public. Nanotechnology is the understanding and control of matter at dimensions of roughly 1 to 100 nanometers, where unique phenomena enable novel applications. Encompassing nanoscale science, engineering and technology, nanotechnology involves imaging, measuring, modeling and manipulating matter at this length scale. At the nanoscale, the physical, chemical and biological properties of materials may differ in fundamental and valuable ways from the properties of individual atoms and molecules or bulk matter. Nanotechnology presents new opportunities to improve how we measure, monitor, manage and minimize contaminants in the environment. New generations of nanomaterials will evolve and with them new and possibly unforeseen environmental issues. The White Paper provides a basic description of nanotechnology, why EPA is interested in it, potential environmental benefits of nanotechnology, risk assessment issues specific to nanotechnology, and a discussion of responsible development of nanotechnology and the Agency's statutory mandates. The paper then provides an extensive review of research needs for both environmental applications and implications of nanotechnology. To help EPA focus on priorities for the near term, the paper concludes with staff recommendations for addressing science issues and research needs, and includes prioritized research needs within most risk assessment topic areas (e.g., human health effects research, fate and transport research). In addition, the White Paper includes as Appendix C ``EPA's Nanotechnology Research Framework.'' The Nanotechnology Research Framework outlines how EPA will strategically focus its own research program to provide key information on potential environmental impacts from human or ecological exposure to nanomaterials in a manner that complements other federal, academic, and private-sector research activities. The Framework was developed by a cross agency team as a follow-up effort to the White Paper. The White Paper and Framework note the importance of complementing EPA's own research program by collaborating with other researchers.

The EPA is proposing to approve revisions to the State Implementation Plan (SIP) for the Albuquerque/Bernalillo County, New Mexico, area that were submitted to EPA by the Governor of New Mexico on May 24, 2006. The proposed revisions modify the Prevention of Significant Deterioration and Nonattainment New Source Review (NNSR) regulations in the SIP. They were submitted to make the area's PSD and NNSR rules consistent with Federal NNSR and PSD revised regulations, which were promulgated by EPA on December 31, 2002 (67 Federal Register (FR) 80186) and reconsidered with minor changes on November 7, 2003 (68 FR 63021) (collectively, these Federal actions are called the ``2002 New Source Review (NSR) Reform Rules''). The revisions include provisions for baseline emissions calculations, an actual-to-projected-actual methodology for calculating emissions changes, options for plantwide applicability limits (PALs), and recordkeeping and reporting requirements. We are proposing to approve these revisions pursuant to section 110, part C, and part D of the Federal Clean Air Act (Act).

In accordance with Section 122(i) of the Comprehensive Environmental Response, Compensation, and Liability Act, as amended (``CERCLA''), 42 U.S.C. 9622(i), notice is hereby given of a proposed administrative settlement for recovery of past response costs concerning the Plantation Heat Treatment Superfund Site in North Providence, Rhode Island, with the following settling party: Theta Properties, Inc. The settlement requires the settling party to pay $175,000 to the Hazardous Substance Superfund. The settlement includes a covenant not to sue the settling party pursuant to Section 107(a) of CERCLA, 42 U.S.C. 9607(a). For thirty (30) days following the date of publication of this notice, the Agency will receive written comments relating to the settlement. The Agency will consider all comments received and may modify or withdraw its consent to the settlement if comments received disclose facts or considerations which indicate that the settlement is inappropriate, improper, or inadequate. EPA is proposing to amend the new source performance standards (NSPS) for electric utility steam generating units and industrial- commercial-institutional steam generating units. On February 27, 2006, EPA promulgated amendments to the NSPS for steam generating units. EPA is proposing to amend specific provisions in the NSPS for steam generating units to resolve issues and questions raised by petitioners for reconsideration of the promulgated amendments, and to correct technical and editorial errors that have been identified since promulgation. In addition, the proposed rule would update the grammatical style of the four NSPS steam generating unit subparts to be consistent across all of the subparts.
Outer Continental Shelf Air Regulations Consistency Update for Alaska

EPA is finalizing the updates of the Outer Continental Shelf (``OCS'') Air Regulations proposed in the Federal Register on August 22, 2006. Requirements applying to OCS sources located within 25 miles of States' seaward boundaries must be updated periodically to remain consistent with the requirements of the corresponding onshore area (``COA''), as mandated by section 328(a)(1) of the Clean Air Act (``the Act''). The portion of the OCS air regulations that is being updated pertains to the requirements for OCS sources in the State of Alaska. The intended effect of approving the OCS requirements for the State of Alaska is to regulate emissions from OCS sources in accordance with the requirements onshore. The change to the existing requirements discussed below is incorporated by reference into the Code of Federal Regulations and is listed in the appendix to the OCS air regulations.

This order constitutes final action on the four (4) petitions submitted by Georgia Center for Law in the Public Interest (GCLPI or the Petitioner), on behalf of the Sierra Club, Georgia Public Interest Research Group, and Coosa River Basin Initiative. The rule establishes the requirements for obtaining an administrative update to an existing permit, temporary permit or a general permit, and for filling notifications and maintaining records of changes not otherwise subject to the permit requirements of this rule. The rule establishes public participation requirements as well as procedures for the transfer, suspension and revocation of permits. EPA is approving these revisions to West Virginia's SIP in accordance with the requirements of the Clean Air Act. In the Final Rules section of this Federal Register, EPA is approving the State's SIP submittal as a direct final rule without prior proposal because the Agency views this as a noncontroversial submittal and anticipates no adverse comments. A more detailed description of the state submittal and EPA's evaluation are included in a Technical Support Document (TSD) prepared in support of this rulemaking action. A copy of the TSD is available, upon request, from the EPA Regional Office listed in the ADDRESSES section of this document. If no adverse comments are received in response to this action, no further activity is contemplated. If EPA receives adverse comments, the direct final rule will be withdrawn and all public comments received will be addressed in a subsequent final rule based on this proposed rule. The EPA is reopening the comment period that originally ended on January 19, 2007. The reopened comment period will close on March 20, 2007. The EPA is reopening the comment period because of the number of requests we received in a timely manner.

This notice announces EPA's intention to modify certain risk mitigation measures that were imposed as a result of the 2005 Reregistration Eligibility Decision (RED) for the pesticide ethofumesate, and opens a public comment period on these changes. EPA conducted this reassessment of the ethofumesate RED in response to new dermal absorption data submitted by the technical registrant, Bayer CropScience, Inc. These data allowed the Agency to modify its original assumption of 100% dermal absorption to 27% and thus modify the ethofumesate label requirements including: removing the 9-day re-entry interval for maintenance activity and adjusting the existing harvest prohibition for sod from 16 days to 3 days.

This regulation establishes a time-limited tolerance for combined residues of the insecticide avermectin B1 and its delta-8,9-isomer in or on bulb onions. This action is in response to EPA's granting of an emergency exemption under section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing use of this pesticide on bulb onions. This regulation establishes a maximum permissible level for residues of avermectin in this food commodity. The tolerance expires and is revoked on December 31, 2009.

EPA has received a specific exemption request from the Oregon Department of Agriculture to use the pesticide quinoclamine (CAS No. 2797-51-5) to treat up to 600 acres of ornamental plants grown in containers in commercial greenhouses to control liverwort. The Applicant proposes the use of a new chemical which has not been registered by the EPA. EPA is soliciting public comment before making the decision whether or not to grant the exemption.
Tris (2-ethylhexyl) Phosphate; Exemption from the Requirement of a Tolerance

This regulation establishes an exemption from the requirement of a tolerance for residues of tris (2-ethylhexyl) phosphate (TEHP, CAS Reg. No. 78-42-2) when used as an inert ingredient in pesticide formulations with the active ingredients pinoxaden, clodinafop- propargyl, and tralkoxydium, with no more than two applications per season when applied to wheat and barley up to the pre-boot stage (prior to formation of edible grain). Syngenta Crop Protection, LLC submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of TEHP.
Standards of Performance for New Stationary Sources and Emission Guidelines for Existing Sources: Hospital/Medical/Infectious Waste Incinerators

On September 15, 1997, EPA adopted new source performance standards (NSPS) and emission guidelines for hospital/medical/ infectious waste incinerators (HMIWI). The NSPS and emission guidelines were established under sections 111 and 129 of the Clean Air Act (CAA). On November 14, 1997, the Sierra Club and the Natural Resources Defense Council (Sierra Club) filed suit in the U.S. Court of Appeals for the District of Columbia Circuit (the Court) challenging EPA's methodology for adopting the regulations. On March 2, 1999, the Court issued its opinion. The Court remanded the rule to EPA for further explanation of the Agency's reasoning in determining the minimum regulatory ``floors'' for new and existing HMIWI. The Court did not vacate the regulations, so the NSPS and emission guidelines remained in effect during the remand and were fully implemented by September 2002. This action provides EPA's proposed response to the questions raised in the Court's remand. Section 129(a)(5) of the CAA requires EPA to review and, if appropriate, revise the NSPS and emission guidelines every 5 years. In this action, EPA also is proposing our response to this 5-year review, which would revise the emission limits in the NSPS and emission guidelines to reflect the levels of performance actually achieved by the emission controls installed to meet the emission limits set forth in the September 15, 1997, NSPS and emission guidelines.

EPA invites public comment on its proposal to approve numerous revisions to the State of Alaska Implementation Plan. The Commissioner of the Alaska Department of Environmental Conservation (ADEC) submitted two requests to EPA dated May 6, 2005 and June 30, 2006 to revise certain sections of ADEC's air quality regulations. The revisions were submitted in accordance with the requirements of section 110 of the Clean Air Act (hereinafter the Act or CAA). Although EPA proposes to approve most of the submitted revisions, EPA proposes not to approve in this rulemaking a number of submitted rule provisions which are inappropriate for EPA approval.

Pesticide Registration Review; New Dockets Opened for Review and Comment

EPA has established registration review dockets for the pesticides listed in the table in Unit III.A. With this document, EPA is opening the public comment period for these registration reviews. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration reviews. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment. This document also announces the Agency's intent not to open a registration review docket for sulfosate. This pesticide does not currently have any active federally registered pesticide products and is not, therefore, scheduled for review under the registration review program.
Withdrawal of Direct Final Rule

Because EPA has received adverse comments, the Agency is withdrawing the direct final rule excepting from the definitions of ``pesticide chemical'' and ``pesticide chemical residue'' under section 201(q) of the Federal Food, Drug and Cosmetic Act (FFDCA) food packaging (e.g., paper and paperboard, coatings, adhesives, and polymers) that is treated with a pesticide. The rule was published on December 6, 2006 (71 FR 70667) (FRL-8084-2). We stated in that direct final rule that if EPA received adverse comment by January 5, 2007, the Agency would publish a timely withdrawal in the Federal Register. We subsequently received adverse comment on that direct final rule and are therefore withdrawing the rule. EPA may issue a notice of proposed rulemaking in a future edition of the Federal Register to initiate action to repromulgate the rule provisions that are being withdrawn today. In any such action, EPA would address the adverse comments it received on the direct final rule.
