The U.S. Environmental Protection Agency's (EPA) Risk Assessment Forum (RAF) announces the availability of a final report, ``Guidance on Selecting Age Groups for Monitoring and Assessing Childhood Exposures to Environmental Contaminants'' (EPA/630/P-03/003F, November 2005). The purpose of this document is to complement existing EPA guidance and experience to assist Agency risk assessors in improving the accuracy and consistency of children's exposure assessments. The document describes a set of age groupings that can be used and, when necessary, adapted for purposes of designing monitoring studies and conducting risk assessments focused on children.
Notice of Extension of Comment Period on the Nanotechnology White Paper External Review Draft

EPA issued a notice in the Federal Register of December 21, 2005 (70 FR 75812) concerning the availability of the Nanotechnology White Paper External Review Draft and requested comments on the draft be received by January 31, 2006 in order to be shared with an external review panel. This notice is extending the period for comments received from the public to be shared with the external review panel for their consideration from January 31, 2006 to March 1, 2006. Comments received beyond that time will be considered by EPA. The U.S. Environmental Protection Agency is submitting the Nanotechnology White Paper External Review Draft for independent external peer review, which will be conducted in the March timeframe. Following the expert review, EPA will issue a final white paper on nanotechnology in early 2006. Air Quality: Revision to Definition of Volatile Organic Compounds-Exclusion of HFE-7300

This action proposes to revise EPA's definition of volatile organic compounds (VOC) for purposes of preparing State implementation plans (SIPs) to attain the national ambient air quality standards (NAAQS) for ozone under title I of the Clean Air Act (CAA). This proposed revision would add 1,1,1,2,2,3,4,5,5,5-decafluoro-3-methoxy-4- trifluoromethyl-pentane [also known as HFE-7300 or L-14787 or C2F5CF(OCH3)CF(CF3)2 ] to the list of compounds excluded from the definition of VOC on the basis that this compound makes a negligible contribution to tropospheric ozone formation. If you use or produce HFE-7300 and are subject to EPA regulations limiting the use of VOC in your product, limiting the VOC emissions from your facility, or otherwise controlling your use of VOC for purposes related to attaining the ozone NAAQS, then you will not count HFE-7300 as a VOC in determining whether you meet these regulatory obligations. This action may also affect whether HFE- 7300 is considered as a VOC for State regulatory purposes, depending on whether the State relies on EPA's definition of VOC. As a result, if you are subject to certain Federal regulations limiting emissions of VOCs, your emissions of HFE-7300 may not be regulated for some purposes.
Transition to New or Revised Particulate Matter (PM); National Ambient Air Quality Standards (NAAQS)

The EPA recently issued a notice of proposed revisions to the national ambient air quality standards (NAAQS) for particulate matter (PM). EPA will take final action on the proposal by September 27, 2006. This notice provides advance notice of key issues for consideration in the development of potentially new or revised policies and/or regulations to implement revisions to the NAAQS for PM recognizing that no final decision has been made concerning whether or how to revise the PM NAAQS. The EPA is posing a number of questions related to the transition from the current to potentially revised PM2.5 standards, as well as the transition from the current PM10 standards to potentially new PM10-2.5 standards. In this ANPR, EPA is soliciting comment on the Agency's preferred approaches to revocation of the 1997 PM2.5 standards once any new 2006 PM2.5 standards would be in place, and also approaches to revocation of the 24-hour PM10 standard in areas where it would remain after promulgation of any new PM10-2.5 standards. The EPA is also highlighting and providing preliminary thinking on how to address some of the key New Source Review (NSR) issues related to the new PM10-2.5 standards, and the transition from PM10 standards to PM10-2.5 standards. Finally, EPA is requesting comment on potential timeframes for designations, attainment demonstrations and State Implementation Plan (SIP) submittals and attainment dates for both any new PM2.5 and PM10-2.5 standards.
Export Notification; Proposed Change to Reporting Requirements

EPA is proposing amendments to the Toxic Substances Control Act (TSCA) section 12(b) export notification regulations at subpart D of 40 CFR part 707. One amendment would change the current annual notification requirement to a one-time requirement for exporters of chemical substances or mixtures (hereinafter referred to as ``chemicals'') for which certain actions have been taken under TSCA. Relatedly, for the same TSCA actions, EPA is proposing to change the current requirement that the Agency notify foreign governments annually after the Agency's receipt of export notifications from exporters to a requirement that the Agency notify foreign governments once after it receives the first export notification from an exporter. EPA is also proposing de minimis concentration levels below which notification would not be required for the export of any chemical for which export notification under TSCA section 12(b) is otherwise required, proposing other minor amendments (to update the EPA addresses to which export notifications must be sent, to indicate that a single export notification may refer to more than one section of TSCA where the exported chemical is the subject of multiple TSCA actions, and to correct an error), and clarifying exporters' and EPA's obligations where an export notification-triggering action is taken with respect to a chemical previously or currently subject to export notification due to the existence of a previous triggering action.

Under the Federal Advisory Committee Act, Public Law 92-463, EPA gives notice of a public teleconference of the National Advisory Council for Environmental Policy and Technology (NACEPT) Environmental Technology Subcommittee. The Environmental Technology Subcommittee was formed to assist EPA in evaluating its current and potential role in the development and commercialization of environmental technologies by suggesting how to optimize existing EPA programs to facilitate the development of sustainable private sector technologies, and by suggesting alternative approaches to achieving these goals. The teleconference is being held to discuss any final revisions to the Subcommittee's first report before it is forwarded to the NACEPT Council for review. Due to extending circumstances, this meeting is being scheduled on short notice.
Notice of Intent To Prepare an Environmental Impact Statement for the Designation of an Ocean Dredged Material Disposal Site (ODMDS) Off Gulfport, MS

Ongoing needs for ocean disposal of dredged material and the proposed improvements to the Federal Gulfport Harbor navigation channel have resulted in the need for the designation of a new ODMDS off Gulfport, Mississippi. Gulfport Harbor is located in Harrison County, Mississippi, on Mississippi Sound about equidistant (80 miles) from New Orleans, Louisiana, and Mobile, Alabama. There are currently two existing U.S. EPA-designated ODMDSs located east and west of the Federal channel; however, these sites will not provide sufficient capacity to accommodate the anticipated disposal needs of the upcoming improvements at Gulfport Harbor. Need for Action: The Corps, Mobile District has requested that U.S. EPA designate a new ODMDS off Gulfport, Mississippi for the disposal of dredged material from the Gulfport Harbor area, when ocean disposal of dredged material is the preferred disposal alternative. An EIS is required to provide the necessary information to evaluate alternatives and designate the preferred ODMDS. Alternatives: ``No action'' alternative. The no action alternative is defined as not designating an ocean disposal site. Additional alternatives under consideration include: Nearshore Area Disposal Site; Mid-shelf Area Disposal Site; and a Deepwater Area Disposal Site. Scoping: Scoping will be accomplished by correspondence with affected Federal, State, and local agencies, and with anticipated interested parties. Appropriate Federal, State, and local entities will be invited to participate as a cooperating agency. Estimated Date of Release: It is anticipated that the Draft EIS will be made available for public review in spring 2006. Responsible Official: J.I. Palmer, Jr., Regional Administrator, Region 4.

Boscalid; Pesticide Tolerance

This regulation establishes tolerances for residues of boscalid, 3-pyridinecarboxamide, 2-chloro-N-(4'-chloro [1,1'-biphenyl]- 2-yl) in or on banana (imported), celery, and spinach. In addition, existing tolerances are being increased on almond hulls. Finally, the existing lettuce exception listed for the indirect or inadvertent residues in vegetables, leafy, group 4, is being revised to include celery and spinach, as well as lettuce. BASF requested the tolerances on almonds and bananas, and Interregional Research Project 4 (IR-4) has proposed group tolerances on vegetable, leafy, except brassica, Group 4 (to include celery and spinach), under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA).
Lindane and Other Hexachlorocyclohexane (HCH) Isomers Risk Assessment; Notice of Availability and Solicitation of Risk Reduction Options

This notice announces the availability of EPA's risk assessment for the organochlorine pesticide lindane, gamma hexachlorocyclohexane (HCH) and the other HCH isomers, and opens a public comment period on these documents. In addition, this notice solicits public comment on risk reduction options for lindane and the other HCH isomers. This action follows up on issues discussed in the July 2002 Lindane RED, in public comments EPA received on that decision document and in the draft North American Regional Action Plan (NARAP) on Lindane and other HCH Isomers.

This regulation establishes an increase in tolerances for the sum of the residues of imazethapyr and its metabolites, CL 288511, (2- [4,5-dihydro-4-methyl-4-(1-methylethyl)-5-oxo-1H-imidazol-2-y l]-5-(1- hydroxyethyl)-3-pyridine carboxylic acid), and CL 182704, (5-[1-(beta- D-glucopyranosyloxy)ethyl]-2-[4,5-dihydro-4-methyl-4-(1-methy lethyl)-5- oxo-1H-imidazol-2-yl]-3-pyridinecarboxylic acid), applied as its acid or ammonium salt in or on rice grain at 0.3 ppm, rice straw at 0.4 ppm, and imazethapyr and its metabolite, CL 288511 in or on crayfish at 0.15 ppm. BASF Corporation requested the tolerances for rice grain and rice straw under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), because of a requested increase in the use rate of imazethapyr in rice. In addition, this regulation increases the tolerance on crayfish from 0.10 ppm to 0.15 ppm due to exposure of crayfish raised in rice fields to imazethapyr.

EPA is taking direct final action to revise the waste treatment standard for 1,3-phenylenediamine (1,3-PDA) for a biosludge generated at DuPont's Chambers Works facility in Deepwater, New Jersey. This variance is necessary because the facility is unable to measure compliance with the 1,3-PDA land disposal restrictions treatment standard in its multisource leachate treatment biosludge matrix. As a practical matter, therefore, the facility cannot fully document compliance with the requirements of the treatment standard. For the same reason, EPA cannot ascertain compliance for this constituent. Furthermore, faced with the inability to demonstrate treatment residual content through analytical testing for this constituent, this facility faces potential curtailment of 1,3-PDA production operations. This site-specific variance will provide alternative technology treatment standards for 1,3-PDA in multisource leachate that do not require analysis of the biosludge matrix to determine whether the numerical treatment standard is being met, thus ensuring that treatment reflecting performance of the Best Demonstrated Available Technology occurs and that threats to human health and the environment from land disposal of the waste are minimized.

In the ``Rules and Regulations'' section of the Federal Register, we are revising the 1,3-PDA multisource leachate (F039) treatment standard for the DuPont Chambers Works facility in Deepwater, New Jersey without prior proposal because we view the revision as noncontroversial and anticipate no adverse comment. We have explained our reasons for this approach in the preamble to the direct final rule. If we receive adverse comment on this revision, however, we will withdraw the direct final action for that portion of the variance and it will not take effect. We will address all public comments in a subsequent final rule based on this proposed rule. We will not institute a second comment period on this action. Any parties interested in commenting on any amendment must do so at this time.

Establishment of Human Studies Review Board

As required by section 9(a)(2) of the Federal Advisory Committee Act, the United States Environmental Protection Agency (EPA or Agency) is giving notice that it is establishing the Human Studies Review Board (HSRB). The purpose of this Board is to provide advice and recommendations to EPA on issues related to the scientific and ethical review of human subjects research. EPA has determined that this advisory committee is in the public interest and will assist the Agency in performing its duties as directed in the 2006 EPA Appropriations Act. Further, the Agency included the establishment of such a Board in a final rule for protection of subjects in human research. The Agency is publishing, in a separate Federal Register notice, the final rule that strengthens the protections for subjects in human research, including a provision addressing the establishment and operation of the HSRB. In addition, in a report requested by the Agency, the National Academy of Sciences recommended that EPA establish such a Board. See: ``Department of Interior, Environment, and Related Agencies Appropriations Act, 2006,'' Public Law 109-54; and ``Intentional Human Dosing Studies for EPA Regulatory Purposes,'' Washington, DC: National Academy Press. 2004. Balanced membership will be driven by a number of considerations characterized by: inclusion of the necessary areas of technical expertise, different scientific perspectives within each technical discipline, and the collective breadth of experience needed to address the Agency's charge. Protections for Subjects in Human Research

With this final rule, EPA bans research for pesticides involving intentional exposure of human subjects, when the subjects are pregnant women or children. The rule further strengthens existing protections for subjects in research conducted or supported by EPA, by prohibiting such research if it would involve intentional exposure of human subjects who are pregnant women or children. The rule also extends new protections to adult subjects in research for pesticides conducted by others who intend to submit the research to EPA, when it involves intentional exposure of human subjects who are non-pregnant adults, and creates a new, independent Human Studies Review Board to advise the Agency on the ethical and scientific issues arising in such research. This final rule focuses on third-party intentional dosing human studies for pesticides and sets the stage for further Agency actions. In addition, in order to display the OMB control number for the information collection requirements contained in this final rule, EPA is amending the table of OMB approval numbers for EPA regulations that appears in 40 CFR part 9.
Approval and Promulgation of Implementation Plans; Wisconsin; General and Registration Permit Programs

EPA is taking final action to approve revisions to the Wisconsin State Implementation Plan (SIP) submitted by the State of Wisconsin on July 28, 2005. These revisions include General and Registration permit programs that provide for the issuance of general and registration permits as part of the State's construction permit and operation permit programs. In addition, these permit programs may include the regulation of hazardous air pollutants (HAPs) which may be regulated under section 112 of the Clean Air Act (the Act). Thus, EPA is also approving Wisconsin's general and registration permit program under section 112(l) of the Act. These SIP revisions also contain changes to definitions related to Wisconsin's air permit program, as well as a minor technical change to provide correct references to the updated chapter NR 445, which was inadvertently omitted in the processing of that rule package. Additionally, these revisions clarify an existing construction permit exemption and operation permit exemption for certain grain storage and drying operations. This clarification is necessary to ensure that column dryers and rack dryers are included in the exemption criteria.
Protection of Stratospheric Ozone: The 2006 Critical Use Exemption From the Phaseout of Methyl Bromide

Specifically, EPA is authorizing uses that will qualify for the 2006 critical use exemption, and the amount of methyl bromide that may be produced, imported, or made available from inventory for those uses in 2006. Certain New Chemicals; Receipt and Status Information

Section 5 of the Toxic Substances Control Act (TSCA) requires any person who intends to manufacture (defined by statute to include import) a new chemical (i.e., a chemical not on the TSCA Inventory) to notify EPA and comply with the statutory provisions pertaining to the manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of TSCA, EPA is required to publish a notice of receipt of a premanufacture notice (PMN) or an application for a test marketing exemption (TME), and to publish periodic status reports on the chemicals under review and the receipt of notices of commencement to manufacture those chemicals. This status report, which covers the period from January 1, 2006 thru January 13, 2006, consists of the PMNs pending or expired, and the notices of commencement to manufacture a new chemical that the Agency has received under TSCA section 5 during this time period.

Approval and Promulgation of Air Quality Implementation Plans; Maine; Nitrogen Oxides Exemption Request for Northern Maine

EPA is approving a request for an exemption from the requirements for the control of nitrogen oxide (NOX) emissions contained in section 182(f) of the Clean Air Act (CAA or Act) for northern Maine (specifically Aroostook, Franklin, Oxford, Penobscot, Piscataquis, Somerset, Washington, and portions of Hancock and Waldo Counties). This exemption request, submitted by the State of Maine, is based on a demonstration that NOX emissions in the exemption area are not impacting Maine's ozone nonattainment areas or other ozone nonattainment areas in the Ozone Transport Region (OTR) during times when elevated ozone levels are monitored in those areas. As such, additional reductions in NOX emissions from this area beyond what the state regulations already provide for are not necessary for future attainment in any of Maine's ozone nonattainment areas or any other ozone nonattainment area in the OTR. Thus, as provided for in section 182(f)(2), additional NOX reductions in these areas constitute excess reductions, and EPA will waive them.

This updated statement replaces the 2002 Position Statement on EMS signed by Administrator Whitman and reflects EPA's experiences to date with the promotion of voluntary EMSs as well as our continued commitment to be a leader in this area. The Position Statement explains EPA's policy on EMSs and the Agency's intent to continue to promote the voluntary wide- spread use of EMSs across a range of organizations and settings. EPA encourages organizations to implement EMSs that result in improved environmental performance and compliance, cost-savings, pollution prevention through source reduction, and continual improvement.

EPA is soliciting comment on the Minnesota Pollution Control Agency's (MPCA's) use of informing the public of upcoming rulemakings and public hearings via the internet as opposed to the past practice of using the newspaper or some other widely accessible printed media. Comments received may impact EPA's approval of the following requests made by the MPCA. The EPA is proposing to approve a revision to the Minnesota State Implementation Plan (SIP) that will establish, pursuant to regulations on public hearings, an alternative public participation process for certain SIP revisions. On December 7, 2005, the Minnesota Pollution Control Agency (MPCA) submitted a request to change certain procedures involving the public hearing and notification process as it applies to SIPs. Minnesota held a public hearing on this SIP revision request on November 17, 2005. In its request, the MPCA has identified a number of types of SIP revisions that are noncontroversial and for which the public has historically shown little or no interest. For this limited number of SIP revisions, the MPCA would, if approved, offer the opportunity for a public hearing, but would not hold a hearing if one was not requested. The EPA agrees that the SIP types that have been identified by the MPCA have historically been noncontroversial and that offering the public the opportunity to request a public hearing rather than holding one automatically does not limit or curtail the public participation process. Also, EPA is proposing to approve, pursuant to regulations on public hearings, a revision to the Minnesota SIP that provides that SIP revisions for which a public hearing was held at the time of the MPCA rulemaking, and where such public hearing met all the criteria necessary for a SIP public hearing, including, as discussed in this proposal, effective electronic notice, and the public was notified that the rule would be submitted as a SIP revision, no separate public hearing for SIP purposes would be held. MPCA included this revision to the Minnesota SIP in its December 7, 2005 request to EPA to revise certain provisions involving the SIP public hearing and notification process, and, correspondingly, included this revision in the public hearing which MPCA held on November 17, 2005. EPA agrees that a public hearing held at the time of the MPCA rulemaking, which meets the criteria for a SIP public hearing, including notice requirements, precludes the need for a separate public hearing for SIP purposes.
