Under Section 122(i) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Environmental Protection Agency (EPA) has entered into an Agreement for response cost at the Riverhills Battery Superfund Site (Site) located in Tampa, Hillsborough County, Florida, with Henry H. Black. EPA will consider public comments on settlement of response cost, paragraphs thirty-six (36) and thirty-seven (37), of the Agreement for April 15, 2005. EPA may withdraw from or modify the Agreement should such comments disclose facts or considerations which indicate the Agreement is inappropriate, improper, or inadequate. The Agency is announcing the availability of a Pesticide Registration Notice (PR Notice) entitled ``Labeling Statements on Products Used for Adult Mosquito Control.'' This PR Notice was issued by the Agency on insert date PR Notice was signed by the OD and is identified as PR Notice 2005-1. PR Notices are issued by the Office of Pesticide Programs (OPP) to inform pesticide registrants and other interested persons about important policies, procedures, and registration related decisions, and serve to provide guidance to pesticide registrants and OPP personnel. This particular PR Notice provides guidance to the registrant concerning EPA's policy on labeling statements for pesticide products used for wide-area applications to control adult mosquitoes. The specific label statements and label organization principles recommended in the draft Notice are intended to improve existing labels by clarifying language conveying environmental hazards posed by these products, as well as specific use directions and instructions to the applicators. The Agency believes that adoption of these recommendations will help pesticide users and pesticide enforcement officials to achieve more effective mosquito control and protection of public health, while ensuring that use of these products will not pose unreasonable risks to the environment.
Approval and Promulgation of Air Quality Implementation Plans; Maine; Control of Total Reduced Sulfur From Kraft Pulp Mills: Withdrawal of Direct Final Rule; and Correction

This document withdraws the direct final rule published in the Federal Register on March 1, 2005. 70 FR 9872. In that rule, we approved a revision to the State of Maine's plan for controlling total reduced sulfur (``TRS'') from kraft pulp mills under section 111(d) of the Clean Air Act (``CAA'') (the ``111(d) plan''). That revision extended the compliance date for brown stock washers to April 17, 2007. EPA stated in the direct final rule that if it received adverse comment by March 31, 2005, the rule would be withdrawn and not take effect. We are withdrawing the direct final rule today because we received an adverse comment concerning our approval to extend the compliance date for brown stock washers. EPA will address this comment and any others received concerning Maine's revision to its 111(d) plan in a subsequent final action based upon the proposed rule that was issued simultaneously with the direct final rule. 70 FR 9901. As explained in the direct final rule and the proposed rule, EPA will not institute a second comment period on this action. 70 FR 9874; 70 FR 9901. In addition, this document corrects a statement in the preamble of the direct final rule. In that preamble, the Agency inaccurately summarized the provisions of CAA section 111(d). This mistake has no bearing on the substance of EPA's proposed approval of Maine's revision to its 111(d) plan.

The Environmental Protection Agency (EPA) is proposing to correct a final rule that appeared in the Federal Register of March 2, 2005 (70 FR 10041). The document de-designated certain ocean dredged material disposal sites and designated new sites located off the mouth of the Columbia River near the states of Oregon and Washington. The coordinates for one of those sites, the Shallow Water site, contained a typographical error in the Overall Site Coordinates as published on page 10055 in Federal Register. This rule proposes to correct the typographical error.

Alabama has applied to EPA for Final authorization of the changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). EPA proposes to grant final authorization to Alabama for RCRA Clusters VIII through XII. In the ``Rules and Regulations'' section of this Federal Register, EPA is authorizing the changes by an immediate final rule. EPA did not make a proposal prior to the immediate final rule because we believe this action is not controversial and do not expect comments that oppose it. We have explained the reasons for this authorization in the preamble to the immediate final rule. Unless we get written comments which oppose this authorization during the comment period, the immediate final rule will become effective on the date it establishes, and we will not take further action on this proposal. If we get comments that oppose this action, we will withdraw the immediate final rule and it will not take effect. Alabama: Final Authorization of State Hazardous Waste Management Program Revision

EPA has determined that these changes satisfy all requirements needed to qualify for Final authorization, and is authorizing the State's changes through this immediate final action. EPA is publishing this rule to authorize the changes without a prior proposal because we believe this action is not controversial and do not expect comments that oppose it. Unless we get written comments which oppose this authorization during the comment period, the decision to authorize Alabama's changes to its hazardous waste program will take effect. If we get comments that oppose this action, we will publish a document in the Federal Register withdrawing this rule before it takes effect and a separate document in the proposed rules section of this Federal Register will serve as a proposal to authorize the changes.

Section 5 of the Toxic Substances Control Act (TSCA) requires any person who intends to manufacture (defined by statute to include import) a new chemical (i.e., a chemical not on the TSCA Inventory) to notify EPA and comply with the statutory provisions pertaining to the manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of TSCA, EPA is required to publish a notice of receipt of a premanufacture notice (PMN) or an application for a test marketing exemption (TME), and to publish periodic status reports on the chemicals under review and the receipt of notices of commencement to manufacture those chemicals. This status report, which covers the period from January 20, 2005 to February 18, 2005, consists of the PMNs and TMEs, both pending or expired, and the notices of commencement to manufacture a new chemical that the Agency has received under TSCA section 5 during this time period.

Due to the receipt of adverse comments the EPA is withdrawing the January 19, 2005 (70 FR 2954), direct final rule approving a revision to Ohio's Oxides of Nitrogen (NOX) State Implementation Plan (SIP). The State of Ohio submitted this revision as a change to the SIP for NOX on June 28, 2004. In the direct final rule, EPA stated that if adverse comments were submitted by February 19, 2005, the rule would be withdrawn and not take effect. On February 18, 2005, EPA received a comment from a citizen and from the State of Ohio. EPA believes the comments are adverse and, therefore, EPA is withdrawing the direct final rule. EPA will address the comments in a subsequent final action based upon the proposed action also published on January 19, 2005 (70 FR 2992). EPA will not institute a second comment period on this action.

EPA proposes to update and revise its data requirements for the registration of conventional pesticide products. These data requirements and those already codified in part 158 of title 40 of the Code of Federal Regulations (CFR), are intended to provide EPA with data and other information necessary for the registration of a conventional pesticide chemical. Since the data requirements in part 158 were first codified in 1984, information needed to support the registration of a pesticide chemical has evolved as the general scientific understanding of the potential hazards posed by pesticides has grown. Over the years, updated data requirements were developed by EPA using a process that involved public participation and extensive involvement by the scientific community, including peer review by the FIFRA Scientific Advisory Panel (SAP). Most of the data requirements contained in this proposal have been applied on a case-by-case basis to support individual applications, or imposed via Data Call-In (DCI) on all registrants of similar products. Although the data requirements imposed have progressed as scientific understanding and concerns have evolved, the codified data requirements have not been updated to keep pace. This proposal involves changes to the codified data requirements that pertain to product chemistry, toxicology, residue chemistry, applicator exposure, post-application exposure, nontarget terrestrial and aquatic organisms, nontarget plant protection, and environmental fate. Coupled with updating data requirements, EPA proposes to add a few new studies, reformat the requirements, and revise its general procedures and policies associated with data submission. By codifying existing data requirements which are currently applied on a case-by- case basis, the pesticide industry, along with other partners in the regulated community, attain a better understanding and are better prepared for the pesticide registration process. This proposed rule does not apply to the data requirements for the registration of antimicrobial pesticide products; inert ingredients for pesticide products; spray drift, product performance (efficacy); or biochemical, and microbial pesticides.

The Environmental Protection Agency (EPA, or ``we'') is announcing an inspection for the week of February 28, 2005, at the Idaho National Engineering and Environmental Laboratory (INEEL) Advanced Mixed Waste Treatment Project (AMWTP). With this notice, we also announce availability of Department of Energy (DOE) documents in the EPA Docket, and solicit public comments on these documents for a period of 30 days. The following DOE documents, entitled ``INEEL Advanced Mixed Waste Treatment Project Certification Plan for Contact-Handled Transuranic Waste, MP-TRUW-8.1, Revision 7'' and ``INEEL Advanced Mixed Waste Treatment Project Quality Assurance Project Plan, MP-TRUW-8.2, Revision 3,'' are available for public review in the public dockets listed in the ADDRESSES section. EPA is approving the Maricopa Association of Governments (MAG) serious area carbon monoxide (CO) state implementation plan (SIP) for the Maricopa County CO nonattainment area, also referred to as ``the metropolitan Phoenix area'', as meeting the Clean Air Act (CAA) requirements for serious CO nonattainment areas. We are also approving the MAG CO Redesignation Request and Maintenance Plan for the Maricopa County CO nonattainment area as meeting CAA requirements for redesignation requests and maintenance plans. In addition, we are making a boundary change under Section 107 of the CAA to take the Gila River Indian Community (GRIC) out of the Maricopa County maintenance area. The portion of the Gila River Indian Community which is currently in the Maricopa County CO nonattainment area will be ``unclassifiable/ attainment'' for CO, and will not be subject to the MAG CO Redesignation Request and Maintenance Plan.

Fenbuconazole; Time-Limited Pesticide Tolerance

This regulation establishes a time-limited tolerance for the combined residues of fenbuconazole [alpha-[2-(4-chlorophenyl)-ethyl]- alpha-phenyl-3-(1H-1,2,4-triazole)-1-propanenitrile] and its metabolites cis- andtrans-5-(4-chlorophenyl)-dihydro-3-phenyl-3-(1H- 1,2,4-triazole-1-ylmethyl)-2-3H-furanone, expressed as fenbuconazole in or on bananas (whole fruit); pecans; and stone fruit crop group (except plums and prunes). Dow AgroSciences, LLC requested this tolerance under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA). The tolerance will expire on December 31, 2008.

EPA requests public comment on a petition, dated December 17, 2004, from the States of California, the Commonwealth of Massachusetts, Connecticut, and New York, available in docket identification (ID) number OPP-2005-0050, requesting that the Agency modify or revoke all tolerances for the pesticides alachlor, chlorothalonil, methomyl, metribuzin, and thiodicarb. The petitioner States request this action to obtain what they believe would be proper application of the additional ten-fold safety factor for the protection of infants and children as provided by the Food Quality Protection Act (FQPA).

Today's action postpones until June 12, 2006, the requirement to obtain National Pollutant Discharge Elimination System (NPDES) storm water permit coverage for oil and gas construction activity that disturbs one to five acres of land. This is the second postponement promulgated by EPA for these activities. This postponement will allow the Agency additional time to complete its analysis of the issues raised by stakeholders about storm water runoff from construction activities at oil and gas sites and of practices and methods for controlling these storm water discharges to mitigate impacts on water quality, as appropriate. Within six months of today's action, EPA intends to publish a notice of proposed rulemaking in the Federal Register for addressing these discharges and to invite public comments.

EPA has received a specific exemption request from the California Department of Pesticide Regulation to use the pesticide Spiromesifen (CAS No.283594-90-1) to treat up to 7,000 acres of pepper to control potato psyllid. The Applicant proposes the use of a new chemical which has not been registered by the EPA. EPA is soliciting public comment before making the decision whether or not to grant the exemption.

The U.S. Environmental Protection Agency (EPA) is announcing that the Oak Ridge Institute of Science and Education (ORISE), Department of Energy, under an Interagency Agreement with EPA, will organize and conduct a workshop to seek expert opinion on the research needs related to the mode of action of the inhalation carcinogenicity of naphthalene. Meeting participants will be provided with the ``Final Report on the External Peer Review for the IRIS Reassessment of the Inhalation Carcinogenicity of Naphthalene (August 2004),'' the external review draft document entitled, ``Toxicological Review of Naphthalene: In Support of Summary Information on the Integrated Risk Information System (IRIS)'' (NCEA-S-1707), and a list of recent naphthalene publications. Members of the public may attend as observers. EPA will consider the comments and recommendations from the expert panel in determining a future course of action for assessing potential health risks associated with naphthalene exposure.

Idaho: Incorporation by Reference of Approved State Hazardous Waste Management Program

The Resource Conservation and Recovery Act, as amended (RCRA), allows EPA to authorize State hazardous waste management programs if EPA finds that such programs are equivalent and consistent with the Federal program and provide adequate enforcement of compliance. Title 40 of the Code of Federal Regulations (CFR) part 272 is used by EPA to codify its decision to authorize individual State programs and incorporates by reference those provisions of the State statutes and regulations that are subject to EPA's inspection and enforcement authorities as authorized provisions of the State's program. This final rule revises the codification of the Idaho authorized program.
