Proposal To Exempt Area Sources Subject to NESHAP From Federal and State Operating Permit Programs

The EPA is proposing to exempt permanently from the title V operating permit program five categories of nonmajor (area) sources subject to national emission standards for hazardous air pollutants (NESHAP). The EPA is proposing to make a finding for these categories, consistent with the Clean Air Act requirement for making such an exemption, that compliance with Title V permitting requirements is impracticable, infeasible, or unnecessarily burdensome on the categories. The five source categories are dry cleaners, halogenated solvent degreasers, chrome electroplaters, ethylene oxide (EO) sterilizers and secondary aluminum smelters. The EPA is proposing to decline making such a finding for a sixth category, area sources subject to the secondary lead smelter NESHAP. A previous deferral from permitting for these six categories expired on December 9, 2004, subjecting all such sources to the title V program unless and until EPA finalizes an exemption for a category.

This document proposes to revoke specific tolerances for residues of the herbicide alachlor, insecticides carbaryl, diazinon, disulfoton, and pirimiphos-methyl, and fungicide vinclozolin. Some of these specific tolerances correspond to commodities either no longer considered to be significant livestock feed items or which have registration restrictions against feeding to livestock. Other tolerances are associated with food registrations that EPA canceled or for which the Agency deleted food uses following requests for voluntary cancellation or use deletion by the registrants. EPA expects to determine whether any individuals or groups want to support these tolerances. The regulatory actions proposed in this document contribute toward the Agency's tolerance reassessment requirements of the Federal Food, Drug, and Cosmetic Act (FFDCA) section 408(q), as amended by the Food Quality Protection Act (FQPA) of 1996. By law, EPA is required by August 2006 to reassess the tolerances in existence on August 2, 1996. The regulatory actions proposed in this document pertain to the proposed revocation of 15 tolerances and tolerance exemptions of which 9 would be counted as tolerance reassessments toward the August, 2006 review deadline.
North Carolina: Final Authorization of State Hazardous Waste Management Program Revision

North Carolina has applied to EPA for Final authorization of the changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). EPA has determined that these changes satisfy all requirements needed to qualify for Final authorization, and is authorizing the State's changes through this immediate final action. EPA is publishing this rule to authorize the changes without a prior proposal because we believe this action is not controversial and do not expect comments that oppose it. Unless we get written comments which oppose this authorization during the comment period, the decision to authorize North Carolina's changes to their hazardous waste program will take effect. If we get comments that oppose this action, we will publish a document in the Federal Register withdrawing this rule before it takes effect and a separate document in the proposed rules section of this Federal Register will serve as a proposal to authorize the changes.
North Carolina: Final Authorization of State Hazardous Waste Management Program Revisions

North Carolina has applied to EPA for Final authorization of the changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). EPA proposes to grant final authorization to North Carolina. In the ``Rules and Regulations'' section of this Federal Register, EPA is authorizing the changes by an immediate final rule. EPA did not make a proposal prior to the immediate final rule because we believe this action is not controversial and do not expect comments that oppose it. We have explained the reasons for this authorization in the preamble to the immediate final rule. Unless we get written comments which oppose this authorization during the comment period, the immediate final rule will become effective on the date it establishes, and we will not take further action on this proposal. If we get comments that oppose this action, we will withdraw the immediate final rule and it will not take effect. We will then respond to public comments in a later final rule based on this proposal. You may not have another opportunity for comment. If you want to comment on this action, you must do so at this time.
Thiophanate-methyl; Pesticide Tolerances for Emergency Exemptions

This regulation establishes time-limited tolerances for combined residues of thiophanate-methyl and its metabolite methyl 2- benzimidazoyl carbamate (MBC) in or on cotton and cotton, gin byproducts. This action is in response to EPA's granting of an emergency exemption under section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide on cotton. This regulation establishes a maximum permissible level for residues of thiophanate-methyl in these feed commodities. These tolerances will expire and are revoked on December 31, 2007.

These revisions concern volatile organic compound (VOC) emissions from polystyrene foam molding operations. We are proposing to approve Maricopa County Rule 358 to regulate these emission sources for purposes of reasonably available control technology under the Clean Air Act as amended in 1990 (CAA or the Act). We are taking comments on this proposal and plan to follow with a final action.

Specifically, the Administrator has partially granted and partially denied three petitions submitted by the New York Public Interest Research Group (NYPIRG) to object to the state operating permits issued to Bristol-Myers Squibb Co. Inc., Eastman Kodak Co., Kodak Park Facility, and Eastman Kodak Co., Kodak Power and Steam Generation Plant. Pursuant to section 505(b)(2) of the Clean Air Act (Act), petitioner may seek judicial review of those portions of the petitions which EPA denied in the United States Court of Appeals for the appropriate circuit. National Drinking Water Advisory Council's Water Security Working Group Teleconference Announcement

The Environmental Protection Agency (EPA) announces the second public teleconference of the Water Security Working Group (WSWG) of the National Drinking Water Advisory Council (NDWAC), which was established under the Safe Drinking Water Act. The purpose of this teleconference call is to provide an opportunity for the WSWG members to continue deliberations on their draft report and recommendations on features of active and effective security programs for the water sector (drinking water and wastewater utilities), including incentives to encourage broad adoption of active and effective security programs and measures to track the performance of water security programs. The teleconference will be open to the public by advance registration; an opportunity for public comment will be provided during that time. WSWG findings and recommendations will be provided to the NDWAC for their consideration. The WSWG anticipates providing findings and recommendations to the NDWAC in spring 2005. The WSWG has met in-person four times and had one previous public teleconference. One additional in-person meeting of the WSWG and one additional public teleconference are planned and will be announced in the near future.

Approval and Promulgation of Implementation Plans and Designation of Areas for Air Quality Planning Purposes; Arizona

EPA is proposing to approve the Arizona Department of Environmental Quality's submittals of revisions to the Arizona state implementation plan that include substitution of the clean fuel fleet program requirement with the cleaner burning gasoline program, adoption of the serious area 1-hour ozone plan, and adoption of the 1-hour ozone maintenance plan for the Phoenix (Arizona) metropolitan 1-hour ozone nonattainment area. We are also proposing to approve Arizona's request to redesignate the Phoenix metropolitan 1-hour ozone nonattainment area from nonattainment to attainment. EPA proposes these actions pursuant to those provisions of the Clean Air Act that obligate the agency to take action on submittals of revisions to state implementation plans and requests for redesignation. In addition, under section 107 of the Clean Air Act, we are proposing to revise the boundary of the Phoenix metropolitan 1-hour ozone nonattainment area to exclude the Gila River Indian Reservation. EPA is proposing this last action consistent with the Federal trust responsibility to the Tribes and for the purpose of relieving the Agency or the Gila River Indian Community of the need to promulgate and implement plans and measures for the Community that are not needed for attainment or maintenance of the 1-hour or 8-hour ozone national ambient air quality standard.

Request for Proposals; Environmental Education Training Program

A brief synopsis of no more than two pages identifying: 1. The institution requesting funding and its key partners (where the applicant is a consortium of institutions); 2. The goals, objectives, outputs, and outcomes of the program by the end of years one, two, and three; 3. How the proposed program builds on existing national efforts and programs; 4. The estimated number of education professionals to be reached as well as the expected demographics of the audiences reached; and 5. How the funds will be used. (b) Mission Statement: A statement of the short (first year) and long-term (three to five year) goals, objectives, and expected outcomes of the program. Include a discussion about the needs of the environmental education and education communities and how these needs will be met. (c) Management and Implementation Plan: A detailed plan of how the project will be managed and implemented in the first year of the program (plus a summary of the project in the second and third years). The plan must: (1) Identify the proposed training and long-term support; (2) discuss how these activities build on existing national efforts and programs; (3) identify all key outputs and outcomes of the project consistent with section II.F.; (4) describe the major responsibilities, qualifications, expertise, and abilities of the Program Director, Program Manager, and key staff as well as key partners where the applicant is a consortium to effectively manage and implement the program; and (5) include a matrix or table identifying all key goals, objectives, outputs, and outcomes, as well as a schedule for conducting and completing these outputs and outcomes during the first year. EPA will consider information provided by the applicant and may consider information from other sources, including Agency files, in evaluating programmatic capability. (d) Evaluation Plan: A detailed plan on how the effectiveness of the program will be evaluated. It is important that the applicant demonstrate how the outputs and outcomes of their program will meet the goals of the program as well as the needs of the environmental education and education communities. The evaluation must be conducted by an institution that has appropriate credentials and expertise in evaluating education programs and is independent of the applicant and key partners where the applicant is a consortium. (e) Appendices: Attachments to the work plan containing information on the budget, qualifications and experience of key personnel, and letters of commitment from key partners. Budget: A statement describing how funds will be used in the first year, including budget milestones for each major proposed output and a timetable showing the month/year of completion. Estimates must include the allocation of funding for all major outputs. Include indirect costs as well as a statement on the relative effectiveness of the program in terms of the ratio of indirect to direct costs. Key Personnel and Letters of Commitment: Include brief resumes of no more than three pages each for the Program Director, Program Manager, key staff, and key partners where the applicant is a consortium with major responsibilities for managing and implementing the program. Resumes should describe educational, administrative, management, and professional qualifications and experience. C. How Should the Application be Submitted? The applicant must submit one original and two copies of the application (a signed SF 424, SF 424A, and a work plan). To help ensure the applications are readable and can be reproduced, please adhere to the following guidelines. Applications should not be bound. They should be on white paper with page numbers. Work plans must be limited to 20 pages (not including the appendices). Evaluators will not read work plans beyond the 20th page. A ``page'' refers to one side of a single- spaced typed page. If we do not receive any adverse comments in response to these direct final and proposed rules, we do not contemplate taking any further action in relation to this proposed rule. If EPA receives adverse comments, we will withdraw the direct final rule and will respond to all public comments in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period on this action. Any parties interested in commenting on this action should do so at this time.

On or about September 13, 2004, Plaintiffs filed deadline suits to compel the Administrator to respond to petitions seeking EPA's objection to Title V operating permits issued by the Illinois Environmental Protection Agency for five electrical generating stations of the Midwest Generation Company known as the Fisk Generating Station, the Crawford Generating Station, the Joliet Generating Station, the Will County Generating Station, and the Waukegan Generating Station in the State of Illinois. Under the terms of the proposed consent decree, three deadlines are established for responding to Title V veto petitions ranging from March 25, 2005 to September 23, 2005.
