Notice of Rail Energy Transportation Advisory Committee Meeting
Notice is hereby given of a meeting of the Rail Energy Transportation Advisory Committee (RETAC), pursuant to section 10(a)(2) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C., App. 2).
R.J. Corman Railroad Company/Pennsylvania Lines Inc.-Construction and Operation Exemption-In Clearfield County, PA
On May 20, 2008, R.J. Corman Railroad Company/Pennsylvania Lines Inc. (RJCP) filed a petition with the Surface Transportation Board (Board) pursuant to 49 U.S.C. 10502 for authority to construct and operate an abandoned 10.8-mile rail line between Wallaceton Junction and Winburne in Clearfield County, Pennsylvania (the Western Segment) and to reactivate a connecting 9.3-mile line between Winburne and Gorton in Clearfield and Centre Counties, Pennsylvania (the Eastern Segment) that is currently being used for interim trail use, subject to the possible restoration of rail service (rail banking) pursuant to the Trails Act, 16 U.S.C. 1247(d). In total, the proposed project would involve the construction, rebuilding, and operation of approximately 20 miles of the former Beech Creek Rail Line to serve a new quarry, landfill, and industrial park being developed by Resource Recovery, LLC, near Gorton, Pennsylvania.\1\
Notice of Rail Energy Transportation Advisory Committee Vacancies
The Surface Transportation Board (Board), hereby gives notice of two vacancies on the Board's Rail Energy Transportation Advisory Committee (RETAC): (1) A representative of a Class II or III railroad and (2) a representative of a biofuel refiner, processor, or distributor, or biofuel feedstock grower or provider. The Board is soliciting suggestions for candidates to fill those vacancies.
Alaska Railroad Corporation-Construction and Operation Exemption-a Rail Line Extension to Port MacKenzie, AK
The Alaska Railroad Corporation (ARRC or Applicant) petitioned the Surface Transportation Board (Board) pursuant to 49 U.S.C. 10502 for authority to construct and operate a new rail line from Matanuska- Susitna Borough's (MSB) Port MacKenzie to ARRC's existing main line between Wasilla and north of Willow, Alaska. The project would involve the construction and operation of approximately 30 to 45 miles of new rail to the main line track. Figure 1 shows ARRC's existing track and the proposed rail line extension from Port MacKenzie to ARRC's existing main line (All figures are available for viewing on the Board's Web site at https://www.stb.dot.gov by going to ``Environmental Matters,'' then selecting ``Key Cases'' in the dropdown; and then when the next page appears, clicking ``Alaska RailroadPort MacKenzie Rail Extension).
Clean Truck Coalition, LLC, et al.-Pooling Application
By application filed on June 3, 2009, certain participating motor carriers (Applicants) in the Clean Truck Coalition, LLC (CTC), a California limited liability corporation, jointly request approval of a pooling agreement under 49 U.S.C. 14302 and 49 CFR 1184.1, et seq. Applicants propose to pool and/or divide specialized clean truck equipment and corresponding traffic, as necessary, and to use collective purchasing options through a central buying mechanism for fuel, equipment, and materials to manage operations costs. As a result of the agreement, Applicants would be part of the Clean Trucks Program (program), an environmental program aimed at reducing air pollution caused by the trucks used to transport cargo to and from the harbor facilities of the Ports of Los Angeles and Long Beach, CA (the Ports). The program is sponsored through the San Pedro Bay Ports Clean Air Action Plan (the Plan),\1\ and provides grants and financial incentives that allow selected trucking companies to replace older, high-polluting trucks with newer, cleaner trucks. The Plan defines the relevant market as shipments transported to and from the Ports using clean trucks. The outbound deliveries generally would be to designated rail and truck container yards, nearby distribution facilities, and other regional service points. Inbound shipments would represent traffic moving in the reverse direction. Applicants would continue to conduct their own transportation operations serving the Ports and augment their present service from a separate to a joint regionalized service.
BNSF Railway Company-Temporary Trackage Rights Exemption-Union Pacific Railroad Company
Under 49 U.S.C. 10502, the Board revokes the class exemption as it pertains to the trackage rights described in STB Finance Docket No. 35238 \1\ to permit the trackage rights to expire at midnight on December 31, 2009, in accordance with the agreement of the parties, subject to the employee protective conditions set forth in Oregon Short Line R. Co.AbandonmentGoshen, 360 I.C.C. 91 (1979).
Quarterly Rail Cost Adjustment Factor
The Board has approved the third quarter 2009 rail cost adjustment factor (RCAF) and cost index filed by the Association of American Railroads. The third quarter 2009 RCAF (Unadjusted) is 0.938. The third quarter 2009 RCAF (Adjusted) is 0.426. The third quarter 2009 RCAF-5 is 0.403.
Arizona Eastern Railway, Inc.-Construction Exemption-in Graham County, AZ
The Board grants an exemption, under 49 U.S.C. 10502, from the prior approval requirements of 49 U.S.C. 10901 for Arizona Eastern Railway, Inc. (AZER) to construct a 12.1-mile rail line in Graham County, AZ, beginning at milepost 1133.5 at Safford, AZ, where it would connect with AZER's existing line and proceed 12.1 miles across the Gila River to the Safford Regional Airport and the Freeport-McMoRan, Inc. Dos Pobres Mine in Safford.
