This final rule confirms the determination NHTSA announced in the notice of proposed rulemaking (NPRM) that the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (Inflation Adjustment Act or 2015 Act) does not apply to the civil penalty rate applicable to automobile manufacturers that fail to meet applicable corporate average fuel economy (CAFE) standards and are unable to offset such a deficit with compliance credits. In addition, this final rule is finalizing the agency's determination that even if the Inflation Adjustment Act applies, increasing the CAFE civil penalty rate would have a negative economic impact, and therefore, in accordance with the Energy Policy and Conservation Act of 1975 (EPCA) and the Energy Independence and Security Act of 2007 (EISA), the current CAFE civil penalty rate of $5.50 should be retained, instead of increasing to $14 in model year 2019.

In response to petitions for rulemaking from the American Trucking Associations (ATA) and the Natural Gas Vehicles for America (NGVAmerica), NHTSA is proposing to amend the visual inspection labeling requirement in Federal Motor Vehicle Safety Standard (FMVSS) No. 304, ``Compressed natural gas fuel container integrity,'' to state that CNG fuel containers used on heavy vehicles should be inspected at least once every 12 months. NHTSA is proposing this change because CNG heavy vehicles are typically used in high-mileage commercial fleet operations and following the current mileage-based inspection interval on the label means conducting multiple visual inspections per year. NHTSA has tentatively concluded multiple visual inspections per year based solely on mileage would not improve vehicle safety for these high-mileage CNG heavy vehicles, and could potentially reduce safety. Because the current periodic visual inspection interval is intended for light vehicles and is consistent with the operation of these vehicles, no change is proposed to the periodic visual inspection interval for CNG fuel containers on light vehicles.

On January 2, 2019, TK Holdings Inc. (Takata) filed a defect information report (DIR), in which it determined that a defect existed in certain passenger-side air bag inflators that it manufactured, including passenger inflators that it supplied to General Motors, LLC (GM) for use in certain GMT900 vehicles. GM has petitioned the Agency for a decision that, because of differences in inflator design and vehicle integration, the equipment defect determined to exist by Takata is inconsequential as it relates to motor vehicle safety in the GMT900 vehicles, and that GM should therefore be relieved of its notification and remedy obligations. This notice serves to make the public aware of GM's pending request to the agency and the period for public comment. It does not address GM's substantive claims, nor legal arguments or interpretations asserted by GM.

This final rule announces NHTSA's determination that there are no new model year 2018 light duty truck lines subject to the parts- marking requirements of the Federal motor vehicle theft prevention standard. The agency determined no new models were high-theft or had major parts that are interchangeable with a majority of the covered major parts of passenger car or multipurpose passenger vehicle lines. This final rule also identifies those vehicle lines that have been granted an exemption from the parts-marking requirements because they are equipped with antitheft devices determined to meet certain criteria.

This notice sets forth the reasons for the denial of a petition submitted on August 6, 2014, by Mr. Donald Friedman to the National Highway Traffic Safety Administration's (NHTSA) Office of Defects Investigation (ODI). The petition requests that the agency commence a proceeding to determine the existence of a defect related to motor vehicle safety with respect to the rollover crash performance of the model year (MY) 2010 Chevrolet Tahoe and similarly constructed General Motors (GM) vehicles. The petition alleges that the rollover side curtain air bag system in these vehicles is defectively designed and can allow second and third row occupants to be ejected in rollover crashes. In addition, the petition alleges that the side window glass, rear seat belts, and roof structure are defectively designed. After examination of the petition and available data relating to the rollover crash performance of the subject vehicles, NHTSA does not believe that a safety-related defect currently exists in the design of the rollover side curtain air bags in the MY 2010 Chevrolet Tahoe and other similarly designed Chevrolet Tahoe and GMC Yukon vehicles. The agency has accordingly denied the petition. The petition is hereinafter identified as DP15-004.

NHTSA is seeking public comment on the near- and long-term challenges of testing and verifying compliance with existing crash avoidance (100-series) Federal Motor Vehicle Safety Standards (FMVSSs) for Automated Driving System-Dedicated Vehicles (ADS-DVs) that lack traditional manual controls necessary for a human driver to maneuver the vehicle and other features intended to facilitate operation of a vehicle by a human driver, but that are otherwise traditional vehicles with typical seating configurations. This document seeks comments on the suitability of various approaches that could be used to address compliance verification challenges that exist for crash avoidance standards that either require a manual control; or specify the use of manual controls in a compliance test procedure. NHTSA's long-term goal is to use what the agency learns from this ANPRM, as well as the agency's other research efforts, to develop a proposal to amend the crash avoidance FMVSSs in ways that address these and other compliance challenges with a continued focus on safety. This ANPRM builds on NHTSA's efforts to identify and address regulatory barriers to ADS technologies, including the request for comments (RFC) on this topic in January 2018. NHTSA intends to issue two additional documents to remove barriers in the crashworthiness FMVSSs (200-series standards) and address issues in the FMVSSs pertaining to telltales, indicators, and warnings in ADS-DVs.

This proposal is being issued pursuant to the Fixing America's Surface Transportation (FAST) Act which requires the Secretary of Transportation (Secretary) to extend the period of time manufacturers of motor vehicles, tires and child restraint systems must retain records concerning defects and malfunctions that may be related to motor vehicle safety under the National Traffic and Motor Vehicle Safety Act (Safety Act). Section 24403 of the FAST Act directs the Secretary to issue a rule increasing the time of record retention to a period not less than ten years, instead of five years as presently required under the regulatory provisions. Pursuant to its delegated authority, NHTSA is proposing to update our regulations in accordance with this mandate. This proposed update is not intended to change the scope of the existing rule, other than as specifically described in this notice, but is intended to aid in efficiently and effectively improving the agency's ability to identify safety defects and noncompliances.

This action withdraws the notice of proposed rulemaking (NPRM) published in the Federal Register on April 16, 2012, proposing amendments to Federal Motor Vehicle Safety Standard FMVSS No. 124, Accelerator Control Systems. The NPRM proposed to make two amendments to the standard: add a new brake-throttle override (BTO) requirement to address unintended acceleration situations and amend the return-to-idle requirements to include electronic throttle control (ETC) systems. After further analysis of the comments received and other considerations, the agency has decided to withdraw the rulemaking proposal because: the widespread adoption of the BTO system makes FMVSS changes unnecessary and a broader understanding of safe design of vehicle electronic control systems is needed to make an informed decision on regulating return-to-idle on ETC systems.

Autoliv, Inc. has determined that certain seat belt assemblies sold as replacement parts for use in certain 2016-2017 model year vehicles do not fully comply with FMVSS No. 209, Seat Belt Assemblies. The petitioners have requested that NHTSA deem the subject noncompliances inconsequential to motor vehicle safety and based on an agency review and analysis, NHTSA denies the petitioners' request for an inconsequentiality determination. BMW and Jaguar are therefore obligated to provide notification of, and a free remedy for, that noncompliance.

In accordance with the Privacy Act of 1974, the National Highway Traffic Safety Administration (NHTSA) proposes to update, reissue, and rename a previously published Department of Transportation (DOT) system of records titled, ``Department of TransportationDOT/ NHTSA 415 Artemis/Vehicle Owner Complaint Information.'' This system of records allows NHTSA to collect and retain complaints, letters communicating vehicle or equipment concerns, and supporting documentation which may include photos, videos, police accident reports, repair invoices or medical information (collectively, ``vehicle owner questionnaires'' or ``VOQs'') submitted by or on behalf of vehicle or equipment owners and lessees (consumers). NHTSA updated the notice with regards to: System Name to Vehicle Owner Questionnaire (VOQ) System to appropriately identify the specific records maintained in the Artemis system covered by the Privacy Act; System Location to include NHTSA's current address and the location of the Federal disaster recovery facility in Stennis, MS; System Managers to update the name and contact information for the system's current points of contact; Authority for Maintenance of the System to reflect the system's underlying authority; Purposes to provide clarity and facilitate understanding of NHTSA investigation and recall processes; Categories of Records to provide greater clarity of the type of records and information included in the system; Record Source Categories to provide additional information about the mechanisms used by NHTSA for collecting records in the system; and Routine Uses to modify an existing routine use to permit sharing of records with manufacturers named in VOQs earlier in NHTSA's investigation and recall processes than permitted under the previously published system of records notice (SORN), unless a consumer ``opts-out'' at the time of collection, and to provide additional details and clarification about NTHSA referrals of complaints to other agencies; and Policies and Practices for Storage, Retrieval, Retention and Disposal of Records, respectively, to provide additional information about the location of the system, methods of retrieval, individuals permitted to retrieve records, and to specify the applicable NARA record retention schedule; Administration, Technical and Physical Safeguards to detail the privacy-risk mitigating controls applicable to the system. Based on the results of the agency's review of available information and analysis of the technically substantive comments on the proposal, NHTSA is unable to conclude at this time that harmonizing FMVSS No. 205 with GTR No. 6 would increase safety.
