The FHWA is issuing this notice to advise the public that it is rescinding two Notices of Intent (NOI) to prepare an Environmental Impact Statement (EIS) for a proposal to construct the extension of State Route 241 to Interstate 5 (I-5) in southern Orange County and northern San Diego County. The FHWA published the initial NOI in the Federal Register on February 20, 2001 and a supplemental NOI in the Federal Register on March 14, 2001. These rescissions are due in part to the U.S. Secretary of Commerce's December 2008 decision upholding the California Coastal Commission's (CCC) objection to the Foothill/ Eastern Transportation Corridor Agency's (TCA) consistency determination for the proposed project. This NOI rescinds both NOIs.

MAP-21 Section 1306 Financial Penalties Guidance

The Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA) are issuing joint guidance on the implementation of the financial penalty provisions contained in Section 1306 of the Moving Ahead for Progress in the 21st Century Act (MAP-21). The financial penalty provisions require Federal agencies of jurisdiction (Reviewing Agency) to render a decision on a permit, license, or other approval related to a transportation project within 180 days from the later of the date FHWA or FTA issue a Record of Decision or Finding of No Significant Impacts for a project, or the date on which an application for a permit, license, or approval for the project is complete. If the Reviewing Agency does not render a decision by the 180-day deadline, it is subject to a rescission of funds of $10,000 or $20,000 per week until the Reviewing Agency renders a decision. The FHWA and FTA have the authority to grant ``no-fault'' certifications if the Reviewing Agency's failure to decide was due to circumstances beyond its control. The purpose of this notice of proposed rulemaking (NPRM) is to propose changes to Highway Safety Improvement Program (HSIP) regulations to address provisions in the Moving Ahead for Progress in the 21st Century Act (MAP-21) as well as to incorporate clarifications to better explain existing regulatory language. Specifically, this rule proposes to amend DOT's regulations to address MAP-21 provisions that removed the requirement for States to prepare a Transparency Report, removed the High Risk Rural Roads set-aside, and removed the 10 percent flexibility provision for States to use safety funding in accordance with federal law. This rule also proposes to amend DOT's regulations to address a MAP-21 provision that requires DOT to establish a subset of roadway data elements that are useful to the inventory of roadway safety, and to ensure that States adopt and use the subset. Finally, this rule proposes to address MAP-21 provisions that add State Strategic Highway Safety Plan update requirements and require States to develop HSIP performance targets. The proposed changes are intended to clarify the regulation for the development, implementation, and evaluation of highway safety improvement programs that are administered in each State.

This notice is a Request for Information (RFI) and comments that will be used to help refine the plans for one or more pilot deployments, which combines connected vehicle and mobile device technologies innovations to improve traveler mobility and system productivity, while reducing environmental impacts and enhancing safety. The FHWA anticipates a procurement action for one or more pilot deployment concepts in 2015. The FHWA is issuing this RFI in collaboration with, and on behalf of, other agencies within the DOT, specifically the Federal Transit Administration, the Federal Motor Carrier Safety Administration, National Highway Traffic Safety Administration (NHTSA), and the Office of the Assistant Secretary for Research and Technology. National Performance Management Measures; Highway Safety Improvement Program

Section 1203 of the Moving Ahead for Progress in the 21st Century Act (MAP-21) declared that performance management will transform the Federal-aid highway program and refocus it on national transportation goals, increase accountability and transparency of the Federal-aid highway program, and improve project decision making through performance-based planning and programming. Section 1203 of MAP-21 identifies national transportation goals and requires the Secretary to promulgate a rulemaking to establish performance measures and standards in specified Federal-aid highway program areas. This NPRM proposes to establish measures for State departments of transportation (State DOT) to use to carry out the Highway Safety Improvement Program (HSIP) and to assess serious injuries and fatalities per vehicle mile traveled, and the number of serious injuries and fatalities. The HSIP is a core Federal-aid highway program with the purpose of achieving a significant reduction in fatalities and serious injuries on all public roads, including non-State-owned public roads and roads on tribal lands.

The FHWA values public input in the development of the model contracts, and seeks continuing input. The FHWA is extending the deadline and comment period for the Designation of the highway Primary Freight Network (PFN) notice, which was published on November 19, 2013, at 78 FR 69520. On December 11, 2013, the FHWA published a notice to extend the comment period at 78 FR 75442. The revised comment period is set to close on January 17, 2014. The extension is based on input received from DOT stakeholders that the January 17 closing date does not provide sufficient time for submission of comments to the docket. The FHWA agrees that the deadline and the comment period should be extended. Therefore, the closing date for submission of comments is extended to February 15, 2014, which will provide others interested in commenting additional time to submit comments to the docket.

This notice provides information regarding the FHWA's finding that a partial Buy America waiver is appropriate for the obligation of Federal-aid funds for 112 State requests regarding specific vehicle projects (including sedans, vans, pickups, SUVs, trucks, buses, and equipment, such as backhoes, street sweepers, tractors and low emission locomotives), including projects to retrofit vehicles with individual vehicle components, so long as they are assembled in the United States. The FHWA's Buy America requirements provide that 100 percent of all steel and iron comprising a predominantly steel and iron product that is permanently incorporated into a project must be domestically manufactured. With respect to vehicles, manufacturers typically assemble these products with many different components and subcomponents containing steel and iron. As a result, vehicles are typically referred to as being made where the final product rolls off the assembly line for delivery into the marketplace. The FHWA is unaware of any vehicle that is comprised of 100 percent domestically produced steel and iron, resulting in a need for a partial Buy America waiver for these projects to proceed.

The FHWA is extending the application period for the Integrated Corridor Management Deployment Planning Grants, which was issued through a notice on November 1, 2013, at 78 FR 65751. The original application period is set to close on December 31, 2013. The extension is based on input received from DOT stakeholders that the December 31 closing date does not provide sufficient time for submission of applications. The FHWA agrees that the application period should be extended. Therefore, the closing date for applications is extended to January 17, 2014.

FHWA is issuing this Revised NOI to advise the public of a change to the environmental review process for the proposed realignment of State Route (SR) 95 in Mohave County, Arizona. FHWA and the project sponsor, the Arizona Department of Transportation (ADOT), intend to use a tiered process to facilitate project decision-making. This notice revises the NOI that was published in the Federal Register on June 1, 2007. The proposed tiering approach will allow FHWA and ADOT to identify potential corridors and to broadly evaluate a range of potential environmental impacts and mitigation approaches in Tier 1. The Tier 1 analysis will utilize as appropriate technical data obtained thus far in the environmental review process. Subsequently, in Tier 2, the agencies will evaluate project-level, site-specific impacts, and required mitigation and commitments.
