Federal Highway Administration March 2024 – Federal Register Recent Federal Regulation Documents

The FHWA has forwarded the information collection request described in this notice to the Office of Management and Budget (OMB) for a renewal of information collection. We published a Federal Register Notice with a 60-day public comment period on this information collection on January 22, 2024. We are required to publish this notice in the Federal Register per the Paperwork Reduction Act of 1995.

FHWA and Nevada Department of Transportation (NDOT) are issuing this Notice of Intent (NOI) to solicit comments and advise the public, agencies, and stakeholders that FHWA will prepare an Environmental Impact Statement (EIS) for transportation improvements to a section of Interstate 11 (I-11)/U.S. Highway 95 (US 95)/U.S. Highway 93 (US 93) in the City of Las Vegas, Clark County, Nevada. The project is referred to as the Downtown Access Project. This NOI contains a summary of information as required in the Council on Environmental Quality (CEQ) regulations for implementing the National Environmental Policy Act (NEPA). This NOI should be reviewed together with the Additional Project Information document, which contains additional important details about the proposed project. Persons and agencies who may be interested in or affected by the proposed project are encouraged to comment on the information in this NOI and the Additional Project Information document. All comments received in response to this NOI will be considered and any information presented herein, including the preliminary purpose and need, preliminary alternatives, and identified impacts, may be revised in consideration of the comments.

The FHWA invites public comments about our intention to request the Office of Management and Budget's (OMB) approval for a new information collection, which is summarized below under SUPPLEMENTARY INFORMATION. We are required to publish this notice in the Federal Register by the Paperwork Reduction Act of 1995.

The FHWA is establishing metrics for the purpose of evaluating the effectiveness and impacts of projects under the Promoting Resilient Operations for Transformative, Efficient, and Cost-Saving Transportation (PROTECT) Discretionary Grant Program. The FHWA will select a representative sample of projects to evaluate using these metrics. This notice fulfills FHWA's requirement to publish the proposed metrics in the Federal Register for public comment.

The FHWA is proposing to discontinue its general waiver of Buy America requirements for manufactured products and in doing so require FHWA recipients to start applying Buy America requirements to manufactured products. The FHWA is also proposing standards for applying Buy America to manufactured products should the waiver be discontinued. The proposed standards for applying Buy America to manufactured products are consistent with the Office of Management and Budget's (OMB) guidance implementing the Build America, Buy America Act (BABA) provisions of the Infrastructure Investment and Jobs Act (also known as the Bipartisan Infrastructure Law (BIL)).

The FHWA is issuing this notice to advise other Federal, State, and local agencies, Tribes, and the public that a Revised Supplemental Environmental Assessment (RSEA) and Finding of No Significant Impact (FONSI) have been prepared in accordance with the National Environmental Policy Act for the proposed Interstate-5 (I-5) Rose Quarter Improvement Project to improve safety and operations on I- 5 between Interstate-84 and Interstate-405 in the Rose Quarter District of downtown Portland, Oregon.

Following coordination with the U.S. Department of Homeland Security, FHWA announces its proposal to adopt the Cyber Security Evaluation Tool (CSET) as a voluntary tool transportation authorities can use to assist in identifying, detecting, protecting against, responding to, and recovering from cyber incidents. The FHWA requests comments on its proposal.
