Airworthiness Directives; The Boeing Company Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain The Boeing Company Model 737-8, 737-9, and 737-8200 airplanes. This proposed AD was prompted by a report of a non- conforming installation of spoiler wire bundles that led to unintended spoiler motion, including one instance of spoiler hardover. Further investigation identified the potential for a hardover of more than one flight spoiler on the same wing, which can exceed full lateral control capability leading to loss of control of the airplane. This proposed AD would require a one-time inspection of the clearance between the spoiler control wire bundles and the adjacent structure, and applicable on-condition actions. The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Airbus Canada Limited Partnership (Type Certificate Previously Held by C Series Aircraft Limited Partnership (CSALP); Bombardier, Inc.) Airplanes
The FAA proposes to supersede Airworthiness Directive (AD) 2021-09-03, which applies to certain Airbus Canada Limited Partnership Model BD-500-1A10 and BD-500-1A11 airplanes. AD 2021-09-03 requires repetitive replacements of the emergency locator transmitter (ELT) antenna and repetitive inspections of the exterior fuselage skin around the ELT antenna attachment area. Since the FAA issued AD 2021-09-03, it has been reported that there was an in-service failure of an ELT antenna that occurred before the repetitive replacement interval required by AD 2021-09-03, and that a terminating action was developed. This proposed AD would continue to require the actions in AD 2021-09-03 and would require replacement of the ELT antenna with a new ELT antenna, inspection of the exterior fuselage skin around the ELT antenna attachment holes, and repair if necessary, as specified in a Transport Canada AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Airbus Helicopters Deutschland GmbH (AHD) Helicopters
The FAA proposes to supersede Airworthiness Directive (AD) 2021-11-17 and AD 2021-11-22, which apply to all Airbus Helicopters Deutschland GmbH (AHD) Model EC135P1, EC135P2, EC135P2+, EC135P3, EC135T1, EC135T2, EC135T2+, and EC135T3 helicopters. AD 2021-11-17 requires a one-time visual inspection of certain part-numbered main rotor actuators (MRAs). AD 2021-11-22 requires revising the life limits of certain parts and removing each part that has reached its life limit. Since the FAA issued those ADs, it was determined that repetitive inspections of the MRAs are necessary, new and more restrictive tasks and limitations have been issued, and that it is necessary to expand the applicability. This proposed AD would continue to require the actions required by AD 2021-11-17 and AD 2021-11-22, except this proposed AD would require changing the one-time MRA inspection to a repetitive inspection and incorporating other new and more restrictive tasks and limitations by revising the airworthiness limitations section (ALS) of the existing helicopter maintenance manual or instructions for continued airworthiness and the existing approved maintenance or inspection program, as applicable. This proposed AD would also expand the applicability by adding Model EC635T2+ helicopters. These actions are specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference. The FAA is proposing this AD to address the unsafe condition on these products.

This action withdraws the final rule published in the Federal Register on January 11, 2024, amending Very High Frequency Omnidirectional Range (VOR) Federal Airway V-4 in the vicinity of Burley, ID. Unanticipated issues affecting the completion of this action have made this withdrawal action necessary.
Airworthiness Directives; Embraer S.A. Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Embraer S.A. Model EMB-545 and EMB-550 airplanes. This proposed AD was prompted by occurrences of premature cracks in the outer layer of certain flight deck side windows caused by interference due to manufacturing tolerances. This proposed AD would require initial and repetitive inspections of the flight deck side windows and applicable corrective actions, and would prohibit the installation of affected flight deck side windows, as specified in an Ag[ecirc]ncia Nacional de Avia[ccedil][atilde]o Civil (ANAC) AD. The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Airbus Canada Limited Partnership (Type Certificate Previously Held by C Series Aircraft Limited Partnership (CSALP); Bombardier, Inc.) Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for all Airbus Canada Limited Partnership Model BD-500-1A10 and BD-500- 1A11 airplanes. This proposed AD was prompted by a report of multiple in-service failures of engine feed check valves, which have resulted in fuel imbalance conditions in flight. This proposed AD would require repetitive replacement of the left- and right-side engine feed check valves with new engine feed check valves, as specified in a Transport Canada AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.
Special Conditions: BETA Technologies Inc. Model H500A Electric Engines
This action proposes special conditions for BETA Technologies Inc. (BETA) Model H500A electric engines that operate using electrical technology installed on the aircraft, for use as an aircraft engine. These engines have a novel or unusual design feature when compared to the state of technology envisioned in the airworthiness standards applicable to aircraft engines. The design feature is the use of an electric motor, motor controller, and high-voltage systems as the primary source of propulsion for an aircraft. The applicable airworthiness regulations do not contain adequate or appropriate safety standards for this design feature. These proposed special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to that established by the existing airworthiness standards.
Amendment of Class E Airspace; Ebensburg, PA
This action amends the Class E airspace at Ebensburg, PA. This action is the result of an airspace review conducted as part of the decommissioning of the Revloc very high frequency omnidirectional range (VOR) as part of the VOR Minimum Operating Network (MON) Program. The geographic coordinates of the airport are also being updated to coincide with the FAA's aeronautical database. This action brings the airspace into compliance with FAA orders to support instrument flight rule (IFR) operations.

This action amends the Class D and Class E airspace at Anderson, IN. This action is the result of an airspace review conducted as part of the decommissioning of the Muncie very high frequency omnidirectional range (VOR) as part of the VOR Minimum Operating Network (MON) Program. The name of the airport is also being updated to coincide with the FAA's aeronautical database. This action brings the airspace into compliance with FAA orders to support instrument flight rule (IFR) operations.

Seaway Regulations and Rules: Periodic Update, Various Categories
The Great Lakes St. Lawrence Seaway Development Corporation (GLS) and the St. Lawrence Seaway Management Corporation (SLSMC) of Canada, under international agreement, jointly publish and presently administer the St. Lawrence Seaway Regulations and Rules (Practices and Procedures in Canada) in their respective jurisdictions. Under agreement with the SLSMC, the GLS is amending the joint regulations by updating the regulations and rules in various categories. These changes are to clarify existing requirements in the regulations.

Agency Information Collection Activities: Requests for Comments; Clearance of Renewed Approval of Information Collection: Competition Plans, Passenger Facility Charges
In accordance with the Paperwork Reduction Act of 1995, FAA invites public comments about our intention to request the Office of Management and Budget (OMB) approval to renew an information collection. The Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on June 23, 2023 under docket number FAA-2020-0385. The collection involves information on the availability of airport gates and related facilities, leasing and sub-leasing arrangements, gate-use requirements, gate-assignment policy, financial constraints, airport controls over air- and ground-side capacity, and whether the airport intends to build or acquire gates that would be used as common facilities. The information to be collected is necessary because it is required by statute that a covered airport submits a written competition plan to the Secretary/Administrator in order to receive approval to impose a Passenger Facility Charge (PFC) or to receive a grant under the Airport Improvement Program (AIP) or Bipartisan Infrastructure Law (BIL).

Request for Information on the J3400 Connector and Potential Options for Performance-Based Charging Standards
The FHWA issued regulations establishing minimum standards and requirements for certain electric vehicle (EV) chargers. Subsequent to the publication of this final rule, the Society of Automotive Engineers (SAE) published a Technical Information Report for a new connector standard, known as J3400, which multiple automakers have announced an intention to adopt in the coming years. To ensure the effective implementation of programs that are subject to the minimum standards and requirements and to inform a potential update to the minimum standards, FHWA, in coordination with the Joint Office of Energy and Transportation, is seeking additional information in five areas: on the expectations surrounding market availability for J3400 within EVs and EV chargers; on the technical compatibility of J3400 with existing regulations and safety considerations; on considerations regarding challenges and benefits of the implementation of J3400 at charging stations; on market demands for the continued availability of Combined Charging System (CCS) and J1772 connectors; and potential options for performance-based standards that can reduce the need for future regulatory updates or changes as technology evolves.

Airworthiness Directives; Dassault Aviation Airplanes
The FAA proposes to supersede Airworthiness Directive (AD) 2022-02-10, which applies to certain Dassault Aviation Model FALCON 7X, FALCON 900EX, and FALCON 2000EX airplanes. AD 2022-02-10 requires replacement of certain titanium screws. Since the FAA issued AD 2022- 02-10, affected parts have been found in other areas of certain Falcon 7X airplanes as well as in additional Falcon 7X airplanes. This proposed AD would continue to require the actions in AD 2022-02-10, add other locations for screw replacement, and revise the applicability, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.
FHWA Adoption of Cyber Security Evaluation Tool
Following coordination with the U.S. Department of Homeland Security, FHWA announces its proposal to adopt the Cyber Security Evaluation Tool (CSET) as a voluntary tool transportation authorities can use to assist in identifying, detecting, protecting against, responding to, and recovering from cyber incidents. The FHWA requests comments on its proposal.
Airworthiness Directives; Bombardier, Inc., Airplanes
The FAA is adopting a new airworthiness directive (AD) for certain Bombardier, Inc., Model BD-700-1A10 and BD-700-1A11 airplanes. This AD was prompted by a determination that a certain nondestructive test (NDT) procedure associated with a certain airworthiness limitation for inspecting the inboard, mid, and outboard flap metallic end ribs does not contain all of the necessary instructions. This AD requires a revision to the existing maintenance or inspection program to require using a revised NDT procedure when performing an airworthiness limitation task. This AD also prohibits the use of earlier revisions of that NDT procedure. The FAA is issuing this AD to address the unsafe condition on these products.

Amendment of VOR Federal Airways V-78 and V-171; Darwin, MN
This action amends Very High Frequency Omnidirectional Range (VOR) Federal Airways V-78 and V-171 in the vicinity of Darwin, MN. The amendments are due to the planned decommissioning of the VOR portion of the Darwin, MN (DWN), VOR/Tactical Air Navigation (VORTAC) navigational aid (NAVAID). The Darwin VOR is being decommissioned as part of the FAA's VOR Minimum Operational Network (MON) program.
Amendment of Class B Airspace Description; Cincinnati/Northern Kentucky International Airport, KY
This action amends the Cincinnati/Northern Kentucky International Airport, KY, Class B airspace area description by making editorial changes to three sub-area shelf boundaries of the Class B airspace from using the Cincinnati, KY, Very High Frequency Omnidirectional Range/Tactical Air Navigation (VORTAC) to a reference point. The reference point uses the same geographic coordinates as the Cincinnati VORTAC location listed in the existing description. Additionally, this action also removes the airport name from the airspace designation to comply with FAA regulatory guidance, updates the Airport Reference Point (ARP) geographic coordinates for the Cincinnati/Northern Kentucky International Airport to match the FAA National Airspace System Resource (NASR) database, and changes the Class B airspace center point from the Cincinnati/Northern Kentucky International Airport to ``Point of Origin''. The point of origin uses the same geographic coordinates as the Cincinnati/Northern Kentucky International Airport listed in the existing description. Finally, this action makes minor edits to the sub-area descriptions for clarity and readability. These changes are editorial only and do not alter the current boundaries, altitudes, ATC procedures, or operating requirements for the Cincinnati/Northern Kentucky International Airport Class B airspace.
Railroad Safety Advisory Committee; Notice of Meeting
FRA announces the sixty-sixth meeting of the Railroad Safety Advisory Committee (RSAC or Committee), a Federal Advisory Committee that provides advice and recommendations to FRA on railroad safety matters through a consensus process. The meeting's focus will be potential safety improvements in response to the February 3, 2023, freight train derailment in East Palestine, Ohio.
Airworthiness Directives; Austro Engine GmbH Engines
The FAA is adopting a new airworthiness directive (AD) for certain Austro Engine GmbH Model E4 and E4P engines. This AD was prompted by reports of engine failures and the determination that certain batches of cap screws, installed on the inner main bearing positions of the engine, were manufactured at the lower end of the material strength tolerance. This AD requires replacing certain cap screws with a part eligible for installation and prohibits installing certain cap screws on any inner main bearing position of any engine. This AD also prohibits installing certain engine cores on any engine unless certain requirements are met. The FAA is issuing this AD to address the unsafe condition on these products.
Agency Information Collection Activities: Requests for Comments; Clearance of a Renewed Approval of Information Collection: Protection of Voluntarily Submitted Information
In accordance with the Paperwork Reduction Act of 1995, FAA invites public comments about our intention to request the Office of Management and Budget (OMB) approval to renew an information collection. The Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on June 23, 2023. The collection involves protection of voluntarily submitted information. Part 193 of the Federal Aviation Administration (FAA) regulations provides that certain information submitted to the FAA on a voluntary basis is not to be disclosed. This part implements a statutory provision. The purpose of part 193 is to encourage the aviation community to voluntarily share information with the FAA so that the agency may work cooperatively with industry to identify modifications to rules, policies, and procedures needed to improve safety, security, and efficiency of the National Airspace System (NAS). The information collection associated with part 193 also supports the Department of Transportation's Strategic Goal of Safety and Security.

The FAA is adopting a new airworthiness directive (AD) for all MHI RJ Aviation ULC (Type Certificate Previously Held by Bombardier, Inc.) Model CL-600-2C10 (Regional Jet Series 700, 701 & 702), CL-600- 2C11 (Regional Jet Series 550), CL-600-2D15 (Regional Jet Series 705), CL-600-2D24 (Regional Jet Series 900), and CL-600-2E25 (Regional Jet Series 1000) airplanes. This AD was prompted by a determination that new or more restrictive airworthiness limitations are necessary. This AD requires revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations. The FAA is issuing this AD to address the unsafe condition on these products.
Modification of Class D Airspace & Establishment of Class E Airspace; Camp Pohakuloa, HI
This action modifies the Class D airspace and establishes Class E airspace extending upward from 700 feet above the surface at Bradshaw Army Airfield, Camp Pohakuloa, HI. Additionally, this action updates the airport's Class D airspace legal description. These actions support the safety and management of instrument flight rules (IFR) and visual flight rules (VFR) operations at the airport.
Amendment of United States Area Navigation (RNAV) Routes; Eastern United States
This action amends United States Area Navigation (RNAV) Routes Q-33 and Q-66 in the eastern United States. The FAA is taking this action to support the Little Rock, AR (LIT), Very High Frequency Omnidirectional Range/Tactical Air Navigation (VORTAC) Relocation Project and continued Next Generation Air Transportation System (NextGen) efforts providing a modern RNAV route structure to improve the efficiency of the National Airspace System (NAS).

This AD was prompted by a report of a separated tail rotor (T/R) blade due to a crack which was caused by intergranular corrosion. This AD requires repetitively inspecting certain part- numbered T/R blades for a crack and, depending on the results, removing any cracked T/R blade from service. This AD also prohibits installing certain T/R blades on any helicopter unless certain requirements are met. These actions are specified in a European Union Aviation Safety Agency (EASA) emergency AD, which is incorporated by reference. The FAA is issuing this AD to address the unsafe condition on these products.

On September 19, 2023, FRA published a public notice in Docket Number FRA-2018-0041 announcing that on July 1, 2023, Port Authority Trans-Hudson Corporation (Petitioner) submitted a petition seeking renewal of a waiver. In this notice, FRA is announcing a public hearing to allow interested persons the opportunity to provide comments on the petition. Coastwise Endorsement Eligibility Determination for a Foreign-Built Vessel: Blue Angel (Sail); Invitation for Public Comments
The Secretary of Transportation, as represented by the Maritime Administration (MARAD), is authorized to issue coastwise endorsement eligibility determinations for foreign-built vessels which will carry no more than twelve passengers for hire. A request for such a determination has been received by MARAD. Hazardous Materials: Adoption of Miscellaneous Petitions and Updating Regulatory Requirements
PHMSA amends the Hazardous Materials Regulations (HMR) to update, clarify, improve the safety of, or streamline various regulatory requirements. Specifically, this rulemaking responds to 18 petitions for rulemaking submitted by the regulated community between May 2018 and October 2020 that requests PHMSA address a variety of provisions, including but not limited to those addressing packaging, hazard communication, and the incorporation by reference of certain documents. These revisions maintain or enhance the existing high level of safety under the HMR while providing clarity and appropriate regulatory flexibility in the transport of hazardous materials.
Airworthiness Directives; Bombardier, Inc., Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Bombardier, Inc., Model BD-700-1A10 and BD-700-1A11 airplanes. This proposed AD was prompted by a determination that new or more restrictive airworthiness limitations for certain brake accumulators are necessary. This proposed AD would require revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations. This proposed AD would also require determining the accumulated landings on the affected brake accumulators. The FAA is proposing this AD to address the unsafe condition on these products.
Standard Instrument Approach Procedures, and Takeoff Minimums and Obstacle Departure Procedures; Miscellaneous Amendments
This rule amends, suspends, or removes Standard Instrument Approach Procedures (SIAPs) and associated Takeoff Minimums and Obstacle Departure Procedures for operations at certain airports. These regulatory actions are needed because of the adoption of new or revised criteria, or because of changes occurring in the National Airspace System, such as the commissioning of new navigational facilities, adding new obstacles, or changing air traffic requirements. These changes are designed to provide for the safe and efficient use of the navigable airspace and to promote safe flight operations under instrument flight rules at the affected airports.
