Department of the Navy 2015 – Federal Register Recent Federal Regulation Documents

The Secretary of the Navy (SECNAV) Advisory Panel will meet 8:15 a.m. to 4:00 p.m. to review ways to establish a culture of innovation in the Department of the Navy. This meeting is opened to the public.

The Department of the Navy (DoN) reaffirms its August 15, 2012, Record of Decision to employ up to four Surveillance Towed Array Sensor System Low Frequency Active (SURTASS LFA) sonar systems with certain geographical restrictions and mitigation monitoring designed to reduce potential adverse effects on the marine environment, including operating LFA sonar systems in the waters in which the Hawaiian Islands Stock Complex of common bottlenose dolphins could occur. The August 15, 2012, Record of Decision implemented the preferred alternative, Alternative 2, identified in the 2012 Final Supplemental Environmental Impact Statement (FSEIS)/Supplemental Overseas Environmental Impact Statement (SOEIS) for SURTASS LFA sonar. Following litigation challenging the adequacy of the 2012 FSEIS/ FSOEIS, the District Court for the Northern District of California determined that the DoN failed to use the best available data when it determined potential impacts from the employment of SURTASS LFA sonar systems on one stock of common bottlenose dolphins in Hawaiian waters rather than the more current information that shows five stocks of common bottlenose dolphins in Hawaiian waters. Accordingly, DoN prepared a narrowly-tailored FSEIS/SOEIS to remedy this deficiency. The National Marine Fisheries Service was a cooperating agency in accordance with 40 CFR 1501.6 for the development of the narrowly- tailored FSEIS/FSOEIS.

The U.S. Marine Corps proposes to alter the system of records, M05100-6, entitled ``MCB Camp Lejeune Historic Drinking Water Notification Registry'' in its inventory of record systems subject to the Privacy Act of 1974, as amended. This system is used to obtain and maintain contact information of people who may have been exposed to contaminated drinking water at Marine Corps Base Camp Lejeune or persons interested in the issue. Information is used to notify, update, or correspond with registrants.

The Department of the Navy hereby gives notice of its intent to grant an exclusive license to Vivinostics LLC of Gainesville, FL. The proposed license is a revocable, nonassignable, exclusive license to practice the inventions embodied in U.S. Pat. No. 7,128,714: NON- CONTACT WAVEFORM MONITOR; U.S. Pat. No. 8,177,721: REMOTE BLOOD PRESSURE WAVEFORM SENSING METHOD; and, U.S. Pat. No. 8,444,568 REMOTE BLOOD PRESSURE WAVEFORM SENSING METHOD throughout the United States, the District of Columbia, the Commonwealth of Puerto Rico, and all other United States territories and possessions. The Secretary of the Navy has an ownership interest in these inventions.

The U.S. Marine Corps proposes to alter the system of records, MMC00010, entitled ``Marine Corps Marathon Automated Support System'' in its inventory of record systems subject to the Privacy Act of 1974, as amended. This system will be used to collect information to register, acknowledge and promote participation in Marine Corps race events. The primary user of the collected information is the Marine Corps Marathon Office. Information is used to plan, organize, coordinate and execute the events and communicate with the runners and volunteers before, during and after the event to include publication of finisher results, finisher certificates and race photographs, videos and motion pictures. Data and photographs, videotape, motion pictures and other recordings may be used by the Marine Corps Marathon Office and its select sponsors for surveys, publications on Web sites, race programs and promotions, newspaper articles, newsletters and other race marketing purposes and runner enhancements.

The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary, into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The executive session of this meeting from 11:00 a.m. to 12:00 p.m. on March 2, 2015, will address new, pending, administrative and minor disciplinary infractions and non-judicial punishments involving the Midshipmen attending the U.S. Naval Academy to include, but not limited to, individual honor or conduct violations within the Brigade, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. For this reason, the executive session of this meeting will be closed to the public.

Pursuant to Section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969 and regulations implemented by the Council on Environmental Quality (40 Code of Federal Regulations (CFR) parts 1500- 1508), the Department of the Navy (DoN) has prepared and filed with the U.S. Environmental Protection Agency a Draft Environmental Impact Statement (EIS) to assess the potential environmental impacts of ongoing and proposed military training activities within the FRTC EIS Study Area. The Bureau of Land Management is a cooperating agency for this EIS. With the filing of the Draft EIS, the DoN is initiating a 46-day public comment period beginning on January 23, 2015 and ending on March 9, 2015 and has scheduled a public meeting to inform the public and receive comments on the accuracy and adequacy of the Draft EIS. This notice announces the date and location of the public meeting and provides supplementary information about the environmental planning effort. Dates and Addresses: The DoN will hold a public meeting to inform the public about the proposed action and alternatives under consideration and to provide an opportunity for the public to comment on the accuracy and adequacy of the environmental analysis presented in the Draft EIS. Federal, state, and local agencies and officials, Native American Indian Tribes and Nations, and interested organizations and individuals are encouraged to provide comments in person at the public meeting or in writing during the public review period. A public meeting will be held between 5:00 p.m. and 7:00 p.m. on Thursday, February 19, 2015, at the Churchill County Commission Chambers, 155 North Taylor Street, Fallon, Nevada 89406. The public meeting will be an open house session with informational poster stations staffed by DoN representatives. A brief DoN presentation will be given at 5:30 p.m. Attendees will be able to submit oral and written comments during the public meeting. Oral comments from the public will be recorded by a certified court reporter. Equal weight will be given to oral and written statements.
