Notice of Public Hearings for the Undersea Warfare Training Range Draft Overseas Environmental Impact Statement/Environmental Impact Statement
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969 and regulations implemented by the Council on Environmental Quality (40 CFR parts 1500-1508), and Executive Order (EO) 12114, Environmental Effects Abroad of Major Federal Actions, the Department of the Navy (Navy) has prepared and filed with the U.S. Environmental Protection Agency a Draft Overseas Environmental Impact Statement/Environmental Impact Statement (OEIS/EIS) on September 12, 2008. The National Marine Fisheries Service (NMFS) is a Cooperating Agency for the OEIS/EIS. The Draft OEIS/EIS evaluates the potential environmental impacts of the construction and operation of an Undersea Warfare Training Range (USWTR) associated with Navy Atlantic Fleet training activities. The construction of the proposed USWTR would entail the instrumentation of a 500-square nautical mile (NM\2\) area of the sea floor with undersea cables and sensor nodes, connected to the shore via a single trunk cable. The western edge of the range would be located approximately 50 NM off the coast of Jacksonville, FL. The USWTR would allow ships, submarines, and aircraft to perform anti-submarine warfare (ASW) training in littoral, or near shore, waters. A Notice of Intent (NOI) for the OEIS/EIS was published in the Federal Register on May 13, 1996 (Federal Register, Volume 61, No. 93, pp 22028). A Revised NOI for this Draft OEIS/EIS and Notice of Request for Public Scoping Comments were published in the Federal Register on September 21, 2007 (Federal Register, Volume 72, No. 183, pp 54015-54016). The Navy will conduct four public hearings to receive oral and written comments on the Draft OEIS/EIS. Federal agencies, state agencies, local agencies, and interested individuals are invited to be present or represented at the public hearings. This notice announces the dates and locations of the public hearings for this Draft OEIS/EIS. Notice of Partially Closed Meeting of the Naval Research Advisory Committee
The Naval Research Advisory Committee (NRAC) will meet to brief the Assistant Secretary of the Navy; Research, Development and Acquisition (ASN (RD&A)) on the results of the committee's summer studies covering two topics: Undersea Maritime Domain Awareness (UMDA) and Disruptive Commercial Technologies (DCT). During the UMDA briefing, the committee will discuss classified information at the secret level from government organizations and proprietary information from commercial industry organizations. Discussions will focus on the exploitation of physical vulnerabilities and the tactical applications of known and emerging technologies. The Executive Session of this meeting will be closed to the public.

The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Notice of Public Hearing for the Draft Supplemental Environmental Impact Statement for Developing Homeport Facilities for Three Nimitz-Class Aircraft Carriers in Support of the U.S. Pacific Fleet
Pursuant to Section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969, as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations Parts 1500-1508 the U.S. Department of the Navy (Navy) has prepared and filed with the U.S. Environmental Protection Agency (EPA) a Draft Supplemental Environmental Impact Statement (SEIS) for Developing Homeport Facilities for Three Nimitz-Class (CVN) Aircraft Carriers in Support of the U.S. Pacific Fleet on August 8, 2008. The Draft SEIS has been prepared to update the analyses contained in the 1999 Final Environmental Impact Statement (the 1999 FEIS) for Developing Homeport Facilities for Three Nimitz-Class Aircraft Carriers in Support of the U.S. Pacific Fleet. The SEIS analyzes information that was not available at the time the 1999 FEIS was completed, and focuses on potentially significant new circumstances or information relevant to environmental conditions that have emerged since the 2000 Record of Decision (2000 ROD) for the 1999 FEIS. Information or circumstances that have not changed significantly since the 2000 ROD are not re-examined in the SEIS. A public hearing will be held to provide information and receive oral and written comments on the Draft SEIS. Federal, state, and local agencies and interested individuals are invited to be present or represented at the hearing.

Record of Decision for the Final Environmental Impact Statement for the Shock Trial of USS MESA VERDE (LPD 19)
The Department of Navy (Navy), pursuant to Section 102(2)(C) of the National Environmental Policy Act (NEPA) of 1969, 42 United States Code (U.S.C.) 4321 et seq.; the regulations implementing NEPA issued by the Council on Environmental Quality (CEQ), 40 Code of Federal Regulations (CFR) Parts 1500-1508; Navy regulations implementing NEPA procedures (31 CFR 775); and Presidential Executive Order 12114, hereby announces its decision to conduct a shock trial for USS MESA VERDE in the area of the Atlantic Ocean offshore of Naval Station Mayport, Jacksonville, Florida during the summer 2008 (June 21- September 20). NEPA establishes the procedures Federal agencies must follow in analyzing environmental impacts of major Federal actions within the United States (U.S.) and its territories. Presidential Executive Order 12114 establishes the procedures Federal agencies must follow when environmental impacts of major Federal actions occur outside the U.S. or its territories including the global commons. The Navy is the lead agency for the proposed action with cooperation from the National Marine Fisheries Service (NMFS), who agreed to be a cooperating agency for the Environmental Impact Statement. USS MESA VERDE will undergo a shock trial in a manner consistent with the proposed action ``Alternative Offshore Shock Trial Locations'' as described in the Final Environmental Impact Statement (EIS). The Final EIS analyzed in detail three alternative offshore areas (Norfolk, Virginia; Mayport, Florida; and Pensacola, Florida) during all four seasons. The No-action alternative was also analyzed in the Final EIS. The preferred alternative is to conduct a shock trial offshore of Mayport implementing protective measures (also referred to as mitigation measures) to minimize risk to marine mammals and sea turtles. Although all three test areas meet minimal operational requirements, there is considerable variability between the locations in terms of marine species presence and status (e.g., threatened or endangered), as well as differences with respect to potential impacts to species (i.e., mortality, injury, and acoustic harassment). USS MESA VERDE will be subjected to a series of up to four 10,000-pound explosive charge detonations sometime between June 21, 2008 and September 20, 2008, conducted at a rate of one per week to allow time to perform detailed inspections of the ship's systems. Potential risk of impacts to marine mammals and sea turtles in summer is highest offshore of Norfolk and Pensacola and lowest offshore of Mayport. The Norfolk and Mayport locations are not considered environmentally acceptable during October through April due to the migratory patterns and presence (abundance) of the North Atlantic right whale. Endangered marine species are not likely to be adversely affected by the preferred alternative to conduct the proposed shock trial offshore of Mayport in the summer. All other aspects of the three test areas are similar. Based on the Navy's overseas deployment requirements for the ship class and, in particular, the availability of the ship, conducting the shock trial offshore of Mayport will meet the project purpose and need, satisfy operational requirements, and minimize environmental impacts. This Record of Decision leaves the selection of primary and secondary test sites within the Mayport test area to be made based on pre-detonation aerial surveys for marine mammal and sea turtle presence. This will ensure that the final test site selected for the shock trial poses the least possible risk to the marine environment.

Payments of Amounts Due Mentally Incompetent Members of the Naval Service
The Department of the Navy is amending its rules to update existing sections relating to the authority and procedures to designate trustees for Navy and Marine Corps service members who have been determined to be mentally incompetent pursuant to 37 U.S.C. Chapter 11. The proposed amendments will comport with current policy reflected in Chapter XIV of the Manual of the Judge Advocate General (JAGMAN).
Record of Decision for Hawaii Range Complex
The Department of the Navy (Navy), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to support and conduct current and emerging Department of Defense (DoD) training and research, development, test, and evaluation (RDT&E) activities in the Hawaii Range Complex (HRC), and upgrade or modernize range complex capabilities to enhance and sustain training and RDT&E. The Navy considered applicable Executive Orders, including an analysis of the environmental effects of its actions outside the United States or its territories under the provisions of Executive Order 12114 (Environmental Effects Abroad of Major Federal Actions) and the requirements of Executive Order 12898 (Federal Actions to Address Environmental Justice in Minority Populations and Low Income Populations). The proposed action will be accomplished as set out in Alternative 3, described in the Final Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/OEIS) as the preferred alternative. Implementation of the preferred alternative could begin immediately. Because the Navy is required by section 5062 of Title 10 of the United States Code to organize, train, equip, and maintain combat-ready forces, ongoing training and RDT&E activities within the HRC will continue at current levels in the event that the proposed action is not implemented.

The VACAPES Study Area does not include any dry land. However, it does include the area from the mean high tide line east (seaward) to the 3nm boundary of the states of Delaware, Maryland, Virginia, and North Carolina. This 3-nm state boundary also serves as the western boundary of the VACAPES OPAREA. The VACAPES Study Area also includes 420 nm\2\ of the lower Chesapeake Bay. A Notice of Intent (NOI) for the EIS/OEIS was published in the Federal Register on December 8, 2006 (Federal Register Volume 71, No. 236, pp 71143-71145). Notice of Intent To Prepare a Supplemental Environmental Impact Statement (SEIS) for Use of Pinecastle Training Range, Florida
Pursuant to Section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969, and the regulations implemented by the Council on Environmental Quality (40 CFR Parts 1500-1508), the Department of the Navy (DON) announces its intent to prepare a SEIS on the use of Pinecastle Training Range in Florida. The SEIS supplements the FEIS for ``Renewal of Authorization to Use Pinecastle Range, Ocala National Forest, Florida'' dated January 2002. The Record of Decision for the FEIS for ``Renewal of Authorization to Use Pinecastle Range, Ocala National Forest, Florida'' was dated March 29, 2002 and published in the Federal Register on April 10, 2002 (67 FR 17418). Pursuant to 40 CFR 1502.9, a SEIS is being prepared for the limited purpose of supplementing the 2002 FEIS to analyze new information regarding Range Compatibility Zones (RCZs) and to assess the effectiveness of existing mitigation measures to determine if any additional mitigation measures or a modification to the governing range Operating Plan are warranted. After completion of the 2002 FEIS, a new safety modeling program was adopted by the Navy. This new modeling program, SAFERANGE, when applied to current training operations, indicates that the Range Compatibility Zones, formerly referred to as Range Safety Zones, are larger than previously modeled. Impacts associated with this significant new information are the focus of the SEIS. The new RCZs could affect the following counties in Florida: Marion, Lake, Volusia, and Putnam. The SEIS will analyze the environmental effects resulting from the revised RCZs and the effectiveness of existing mitigation measures to determine if additional actions or modifications to the range Operating Plan are necessary to maintain public safety and ensure range sustainability. The SEIS will also evaluate past, present and reasonably foreseeable future land use proposals and forestry actions from a cumulative impacts perspective. The SEIS will not propose any changes to the Fleet's Training and Readiness Program. The targets, ordnance, method of delivery (air-to- ground), and volume of munitions utilized at Pinecastle for military training are not changing, and, therefore, will not be re-analyzed in the SEIS. The Navy is also initiating a public scoping period for the SEIS with this announcement. Public input is requested to ensure the scope of the SEIS analysis incorporates public concerns and affords the public an input in the decision-making process. Pursuant to section (102)(2)(c) of the National Environmental Policy Act of 1969, and the regulations implemented by the Council on Environmental Quality (40 CFR parts 1500-1508), the Department of the Navy (Navy) announces its intent to prepare an Environmental Impact Statement (EIS) to evaluate the potential environmental impacts associated with the construction and operation of a proposed new Explosives Handling Wharf (EHW) located adjacent to, but separate from, the existing EHW on Hood Canal, NBK-Bangor, WA, to support TRIDENT submarines. The proposed action consists of in-water and land-based construction and infrastructure enhancements including a covered ordnance operations area, a support building on the wharf, and a warping wharf. As part of the Navy's sea-based strategic deterrence mission, the Navy Strategic Systems Programs (SSP) directs research, development, manufacturing, test, evaluation, and operational support of the TRIDENT Fleet Ballistic Missile program. SSP is the Action Proponent and the Navy is the lead agency for this project. The Navy will hold a public scoping meeting for the purpose of further identifying the scope of issues to be addressed in the EIS. Federal, State, and local agencies and the public are invited to participate in the scoping process for the EIS. Comments are being solicited to help identify significant issues or concerns related to the proposed action, determine the scope of issues to be addressed in the EIS, and identify and refine alternatives to the proposed action. The Navy will conduct a public scoping meeting to receive oral and/ or written comments on environmental concerns that should be addressed in the EIS. The public scoping meeting will be conducted in English and will be arranged in an informal, open house format. Attendees will be asked to sign in and will be directed to various stations manned by Navy representatives and technical staff assigned to provide information and answer questions. Several large display boards will be located throughout the meeting location to assist attendees in understanding the project and the alternatives. A comment table, supplied with comment sheets, will be placed in an easily accessible and comfortable location. Fact sheets about the project and alternatives will be available to participants.

Section 4332(2)(c), the regulations of the Council on Environmental Quality (CEQ) for Implementing the Procedural Provisions of (40 CFR parts 1500-1508) and the Department of the Navy (DON) NEPA regulation (32 CFR part 775), the DON announces its decision to implement 2005 Base Realignment and Closure (BRAC) Actions at the National Naval Medical Center (NNMC) in Bethesda, MD. The implementation of BRAC 2005 at NNMC will be accomplished as set out in the Preferred Alternative and described in the Final Environmental Impact Statement (Final EIS).
Notice of Closed Meetings of the Naval Research Advisory Committee
The Naval Research Advisory Committee (NRAC) will meet to discuss classified information from government organizations and proprietary information from commercial organizations. With the exception of participants' registration and introduction/welcoming remarks on Monday, June 16, 2008, all sessions of the meeting will be devoted to briefings, discussions and technical examination of information related to the study of undersea maritime domain awareness technologies and disruptive commercial technologies to U.S. Navy and U.S. Marine combat operations. Discussions will focus on the exploitation of physical vulnerabilities and the tactical applications of known and emerging technologies. Each session will examine vulnerabilities of individuals and systems, and how the enemy is exploiting these vulnerabilities. The sessions will also include proprietary information regarding technology applications and systems under development in the private sector between competing companies. The sessions will also focus on the assessment of the emerging concepts of operations in each of these areas and evaluate appropriate options in such areas as: training, S&T funding allocation, technology monitoring, and progress assessments; and probable time frames for transformation and implementation. The sessions will also identify, review, and assess challenges with the utilization and fielding of various technology applications.
