Migratory Bird Hunting; Proposed Frameworks for Late-Season Migratory Bird Hunting Regulations
The Fish and Wildlife Service (hereinafter Service or we) is proposing to establish the 2013-14 late-season hunting regulations for certain migratory game birds. We annually prescribe frameworks, or outer limits, for dates and times when hunting may occur and the number of birds that may be taken and possessed in late seasons. These frameworks are necessary to allow State selections of seasons and limits and to allow recreational harvest at levels compatible with population and habitat conditions.

We, the U.S. Fish and Wildlife Service (Service), determine endangered species status for the Austin blind salamander (Eurycea waterlooensis) and threatened species status for Jollyville Plateau salamander (Eurycea tonkawae) under the Endangered Species Act of 1973 (Act), as amended. The effect of this regulation is to conserve these salamander species and their habitats under the Act. This final rule implements the Federal protections provided by the Act for these species.
Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for the Austin Blind and Jollyville Plateau Salamanders
We, the U.S. Fish and Wildlife Service, designate critical habitat for the Austin blind salamander (Eurycea waterlooensis) and Jollyville Plateau salamander (Eurycea tonkawae) under the Endangered Species Act. In total, approximately 4,451 acres (ac) (1,801 hectares (ha)) in Travis and Williamson Counties, Texas, fall within the boundaries of the critical habitat designation. The effect of this regulation is to conserve the Austin blind and Jollyville Plateau salamanders' habitat under the Endangered Species Act.
Endangered and Threatened Wildlife and Plants; 6-Month Extension of Final Determination for the Listing of the Georgetown Salamander and Salado Salamander
We, the U.S. Fish and Wildlife Service (Service), announce a 6-month extension of the final determination of whether to list the Georgetown salamander (Eurycea naufragia) and Salado salamander (Eurycea chisholmensis) as endangered or threatened species, and we reopen the comment period on the proposed rule to list these species. We are taking this action based on our finding that there is substantial disagreement regarding the sufficiency or accuracy of the available data relevant to our determination regarding the proposed listing rule, making it necessary to solicit additional information by reopening the comment period for 30 days.
Iowa Wetland Management District, 35 Counties in North-Central and Northwest Iowa; Environmental Assessment and Draft Comprehensive Conservation Plan

Endangered and Threatened Wildlife and Plants; Initiation of a 5-Year Review of Nine Northeastern Species
We, the U.S. Fish and Wildlife Service (Service), are initiating 5-year reviews under the Endangered Species Act (Act), as amended, for nine northeastern species. We will review the following endangered species: Peter's Mountain mallow, Jesup's milk-vetch, James spinymussel, sandplain gerardia, harperella, American chaffseed, and rough rabbitsfoot. We will also review the threatened northeastern beach tiger beetle and Virginia spiraea. A 5-year review is based on the best scientific and commercial data available at the time of the review. We are requesting submission of any such information that has become available since the previous 5-year review for each species.
South Farallon Islands Invasive House Mouse Eradication Project; Farallon National Wildlife Refuge, California; Environmental Impact Statement
We, the U.S. Fish and Wildlife Service (Service), announce the availability of a draft environmental impact statement (EIS) for a proposed project to eradicate non-native, invasive house mice from the South Farallon Islands, part of the Farallon National Wildlife Refuge off the coast of California. The draft EIS, which we prepared in accordance with the National Environmental Policy Act of 1969 (NEPA), describes the alternatives identified to address the problem of invasive house mice on the South Farallon Islands.

In total, approximately 3,351 hectares (8,283 acres) in Miami-Dade and Monroe Counties, Florida, fall within the boundaries of the proposed critical habitat designation for the Florida leafwing butterfly, and approximately 3,748 hectares (9,261 acres) in Miami-Dade and Monroe Counties, Florida, fall within the boundaries of the proposed critical habitat designation for the Bartram's scrub-hairstreak butterfly.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition to List the Rattlesnake-Master Borer Moth (Papaipema eryngii) as an Endangered or Threatened Species
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the rattlesnake-master borer moth (Papaipema eryngii) as an endangered or a threatened species under the Endangered Species Act of 1973, as amended (Act). After review of the best available scientific and commercial information, we find that listing the rattlesnake-master borer moth is warranted. Currently, however, listing the rattlesnake-master borer moth is precluded by higher priority actions to amend the Lists of Endangered and Threatened Wildlife and Plants. Upon publication of this 12-month petition finding, we will add the rattlesnake-master borer moth to our candidate species list. We will develop a proposed rule to list the rattlesnake- master borer moth as our priorities allow. In any interim period, we will address the status of the candidate taxon through our annual Candidate Notice of Review (CNOR).

Gierisch mallow is a plant species found in Mohave County, Arizona, and Washington County, Utah. This final rule implements the Federal protections provided by the Act for this species. The effect of this regulation is to add this species to the List of Endangered and Threatened Plants.

We, the U.S. Fish and Wildlife Service (Service), intend to prepare a Comprehensive Conservation Plan (CCP) and an Environmental Impact Statement (EIS) for the Rocky Mountain Arsenal National Wildlife Refuge in Commerce City, Colorado. The Service also intends to prepare a CCP and an Environmental Assessment for the Two Ponds National Wildlife Refuge in Arvada, Colorado. These refuges are currently being managed under Comprehensive Management Plans developed in the mid-1990s and as part of the Rocky Mountain Arsenal National Wildlife Refuge Complex. We provide this notice in compliance with our CCP policy to advise other Federal and State agencies, Tribes, and the public of our intentions, and to obtain suggestions and information on the scope of issues to consider in the planning process of revising the management plans for these refuges.

We, the U.S. Fish and Wildlife Service, propose to designate critical habitat for Graham's beardtongue (Penstemon grahamii) and White River beardtongue (Penstemon scariosus var. albifluvis) under the Endangered Species Act of 1973, as amended (Act). We are proposing approximately 27,502 hectares (67,959 acres) for designation as critical habitat for Graham's beardtongue in Duchesne and Uintah Counties in Utah and Rio Blanco County in Colorado. We are proposing approximately 6,036 hectares (14,914 acres) for designation as critical habitat for White River beardtongue in Duchesne and Uintah Counties in Utah and Rio Blanco County in Colorado. If we finalize this rule as proposed, it will extend the Act's protections to these species' critical habitats.

We, the U.S. Fish and Wildlife Service (Service), propose to designate critical habitat for the sharpnose shiner (Notropis oxyrhynchus) and smalleye shiner (N. buccula) under the Endangered Species Act of 1973, as amended (Act). In total, approximately 1,002 river kilometers (623 river miles) of river segments occupied by the species in Baylor, Crosby, Fisher, Garza, Haskell, Kent, King, Knox, Stonewall, Throckmorton, and Young Counties in the upper Brazos River basin of Texas fall within the boundaries of the proposed critical habitat. If we finalize this rule as proposed, it would extend the Act's protections to these species' critical habitat.

In total, approximately 2,011 acres (814 hectares) in Plumas, Lassen, and Sierra Counties in northeastern California and Washoe and Douglas Counties in northwestern Nevada fall within the boundaries of the proposed critical habitat designation. If we finalize this rule as proposed, it would extend the Act's protections to this species' critical habitat. The effect of this regulation is to designate critical habitat for Ivesia webberi under the Act.

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the plant Potentilla basaltica (Soldier Meadow cinquefoil) as an endangered or threatened species. After review of the best available scientific information, we find that listing Potentilla basaltica as an endangered or threatened species under the Endangered Species Act (Act) is no longer warranted, and, therefore, we are removing this species from the candidate list. We propose to list the plant Ivesia webberi (Webber's ivesia) as a threatened species under the Act. If finalized, the effect of this regulation would be to add Ivesia webberi to the List of Endangered and Threatened Plants and extend the Act's protections to this species. Elsewhere in today's Federal Register, we propose to designate critical habitat under the Act for Ivesia webberi.

Notice of Establishment of the Advisory Council on Wildlife Trafficking
The Secretary of the Interior (Secretary), after consultation with the Co-Chairs of the Presidential Task Force on Wildlife Trafficking (Task Force), is announcing the establishment of the Advisory Council on Wildlife Trafficking (Council) under the Federal Advisory Committee Act. The Council will make recommendations to the Task Force and provide it with ongoing advice and assistance. We, the U.S. Fish and Wildlife Service (Service), determine endangered species status under the Endangered Species Act of 1973 (Act), as amended, for diamond darter (Crystallaria cincotta), a fish species from Kentucky, Indiana, Ohio, Tennessee, and West Virginia. The effect of this regulation will be to add this species to the Lists of Endangered and Threatened Wildlife.

The U.S. Fish and Wildlife Service (hereinafter Service or we) is proposing to establish the 2013-14 early-season hunting regulations for certain migratory game birds. We annually prescribe frameworks, or outer limits, for dates and times when hunting may occur and the maximum number of birds that may be taken and possessed in early seasons. Early seasons may open as early as September 1, and include seasons in Alaska, Hawaii, Puerto Rico, and the U.S. Virgin Islands. These frameworks are necessary to allow State selections of specific final seasons and limits and to allow recreational harvest at levels compatible with population status and habitat conditions. This proposed rule also provides the final regulatory alternatives for the 2013-14 duck hunting seasons.
Endangered and Threatened Wildlife and Plants; Reclassification of Acmispon dendroideus
We, the U.S. Fish and Wildlife Service (Service), are reclassifying Acmispon dendroideus var. traskiae (San Clemente Island lotus) and Castilleja grisea (San Clemente Island paintbrush) from endangered to threatened. The endangered designation no longer correctly reflects the status of these plants due to substantial improvement in their status. This action is based on a review of the best available scientific and commercial data, which indicate that the ongoing threats are not of sufficient imminence, intensity, or magnitude to indicate that A. d. var. traskiae and C. grisea are presently in danger of extinction across their ranges. While both taxa will continue to be impacted by military training activities and land use, erosion, nonnative plants, and fire, the significant increase in abundance (number of occurrences) of both taxa reduces the severity and magnitude of threats and the likelihood that any one event would affect all occurrences of either taxon. Additionally, the Department of the Navy (Navy) is implementing conservation actions through their Integrated Natural Resources Management Plan and has successfully reduced threats impacting both taxa and their habitat.

Draft Environmental Assessment and Proposed Cross Valley Transmission Line Habitat Conservation Plan, Tulare County, California
We, the U.S. Fish and Wildlife Service (Service), have prepared a draft environmental assessment (EA) under the National Environmental Policy Act of 1969, as amended (NEPA), in response to an application from Southern California Edison (the Applicant) for an incidental take permit (ITP) pursuant to section 10(a)(1)(B) of the Endangered Species Act of 1973, as amended (Act). The application addresses the proposed incidental take (take) of 13 proposed Covered Species within a 3,385-acre Permit Area during a proposed permit term of 30 years. The Applicant has prepared the draft Cross Valley Transmission Line Habitat Conservation Plan (Cross Valley Line HCP) (HCP) to describe and implement a conservation plan that will minimize and mitigate environmental effects associated with the construction, operation, and maintenance of the Cross Valley Loop Transmission Line, an electrical transmission project in central Tulare County, California. We also announce a 45-day public comment period on the permit application, including the draft EA and the proposed HCP. We request data, comments, new information, or suggestions from the public, other concerned governmental agencies, the scientific community, Tribes, industry, or any other interested party.

The barred owl, a species recently established in western North America, is displacing the northern spotted owl and threatening its viability. The Final EIS analyzes a no-action alternative and eight action alternatives to experimentally determine if removing barred owls will benefit northern spotted owl populations and to test the feasibility and efficiency of barred owl removal as a management tool. The action alternatives vary by the number and location of study areas, the type of experimental design, duration of study, and method of barred owl removal.
Sonny Bono Salton Sea National Wildlife Refuge Complex (Sonny Bono Salton Sea National Wildlife Refuge and Coachella Valley National Wildlife Refuge), Imperial and Riverside Counties, CA; Draft Comprehensive Conservation Plan and Environmental Assessment
We, the U.S. Fish and Wildlife Service (Service), announce the availability of a Draft Comprehensive Conservation Plan (CCP) and Environmental Assessment (EA) for the Sonny Bono Salton Sea National Wildlife Refuge (NWR) Complex, which includes the Sonny Bono Salton Sea NWR and the Coachella Valley NWR. The Draft CCP/EA, prepared under the National Wildlife Refuge System Improvement Act of 1997, and in accordance with the National Environmental Policy Act of 1969, describes how the Service proposes to manage the two Refuges for the next 15 years. A hunt plan, draft compatibility determinations for existing public uses, a draft predator management plan, and a draft integrated pest management plan are also available for review and public comment with the Draft CCP/EA.
Final Candidate Conservation Agreement with Assurances, Final Environmental Assessment, and Finding of No Significant Impact; Rio Grande Cutthroat Trout, New Mexico and Colorado
We, the U.S. Fish and Wildlife Service (Service), make available the final Candidate Conservation Agreement with Assurances (CCAA) for the Rio Grande cutthroat trout (Oncorhynchus clarki virginialis) in New Mexico and Colorado, as well as the final environmental assessment (EA) and the draft Finding of No Significant Impact (FONSI) under the National Environmental Policy Act of 1969 (NEPA). Vermejo Park, LLC d/b/a Vermejo Park Ranch applied for an enhancement of survival permit pursuant to the Endangered Species Act of 1973, as amended (Act). The permit application included a draft CCAA between the Service and Vermejo Park Ranch for the Rio Grande cutthroat trout in Taos County, New Mexico, and Costilla County, Colorado. Our decision is to authorize the issuance of an enhancement of survival permit to Vermejo Park Ranch for implementation of the CCAA (Preferred Alternative described below).
Endangered and Threatened Wildlife and Plants; Endangered Status for the Sierra Nevada Yellow-Legged Frog and the Northern Distinct Population Segment of the Mountain Yellow-Legged Frog, and Threatened Status for the Yosemite Toad
We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the public comment period on our April 25, 2013, proposed rule to list the Sierra Nevada yellow-legged frog and the northern distinct population segment (DPS) (populations that occur north of the Tehachapi Mountains) of the mountain yellow-legged frog as endangered species, and the Yosemite toad as a threatened species. We are also reopening the public comment period on our April 25, 2013, proposed rule to designate critical habitat for these species. The 60-day comment period for both proposed rules ended on June 24, 2013. This notice announces reopening of the comment periods to allow all interested parties an additional opportunity to comment on the proposed rules and to submit information on the status of the species and proposed critical habitat. We will consider all comments and information provided by the public during these comment periods in preparation of a final determination on our proposed listings and designation of critical habitat. Accordingly, the final decisions may differ from our proposals. If you submitted comments previously, you do not need to resubmit them because we have already incorporated them into the public record and will fully consider them in preparation of the final rules.
Endangered and Threatened Wildlife and Plants; 6-Month Extension of Final Determinations on the Proposed Endangered Status and Proposed Designation of Critical Habitat for Gunnison Sage-Grouse
We, the U.S. Fish and Wildlife Service (Service), announce a 6-month extension of the final determination of whether to list the Gunnison sage-grouse (Centrocercus minimus) as endangered and designate critical habitat, and announce the reopening of the comment period on the proposed rules to list the species and to designate critical habitat. We are taking this action based on our finding that there is substantial disagreement regarding the sufficiency and accuracy of the available data relevant to our determinations regarding the proposed listing rule, making it necessary to solicit additional information by reopening the comment period for 45 days. Comments previously submitted need not be resubmitted as they are already incorporated into the public record and will be fully considered in the final rules.
