2016 Preliminary Fee Rate and Fingerprint Fees

Notice is hereby given, pursuant to 25 CFR 514.2, that the National Indian Gaming Commission has adopted its 2016 preliminary annual fee rates of 0.00% for tier 1 and 0.062% (.00062) for tier 2. While the rate for tier 1 remains the same, tier 2 decreases from 0.065% to 0.062%. The tier 2 preliminary annual fee rate represents the lowest fee rate adopted by the Commission in the last five years. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the 2016 preliminary fee rate on Class II revenues shall be 0.031% (.00031) which is one-half of the annual fee rate. The preliminary fee rates being adopted here are effective March 1, 2016 and will remain in effect until new rates are adopted. Pursuant to 25 CFR 514.16, the National Indian Gaming Commission has also adopted its fingerprint processing fees of $21 per card effective March 1, 2016.

The Bureau of Land Management (BLM) proposes to amend existing regulations that establish the procedures used to prepare, revise, or amend land use plans pursuant to the Federal Land Policy and Management Act (FLPMA). The proposed rule would enable the BLM to more readily address landscape-scale resource issues, such as wildfire, habitat connectivity, or the demand for renewable and non-renewable energy sources and to respond more effectively to environmental and social changes. The proposed rule would further emphasize the role of science in the planning process and the importance of evaluating the resource, environmental, ecological, social, and economic conditions at the onset of planning. The proposed rule would affirm the important role of other Federal agencies, State and local governments, Indian tribes, and the public during the planning process, and would enhance opportunities for public involvement and transparency during the preparation of resource management plans. Finally, the proposed rule would make revisions to clarify existing text and use plain language to improve the readability of the planning regulations.

The National Park Service proposes to amend its special regulations for Golden Gate National Recreation Area regarding dog walking. The rule would apply to 22 locations within the park and would designate areas within these locations for on-leash and regulated (i.e., voice and sight control) off-leash dog walking. Areas in these 22 locations that are not designated as open to dogs would be closed to dogs, except for service animals in accordance with National Park Service regulations. The rule would modify and, in some circumstances, relax the National Park System-wide pet regulations for these 22 locations. To the extent not modified by this rule, dog walking in all NPS-managed areas within the park would continue to be regulated under National Park System-wide pet regulations.

Notice is hereby given of the availability for public review of the draft U.S. Geological Survey report, ``Guidelines for Determining Flood Flow Frequency'', commonly known as Bulletin 17B. This report was drafted under the auspices of the Hydrologic Frequency Analysis Work Group (HFAWG), which operates under the supervision of the Advisory Committee on Water Information's (ACWI) Subcommittee on Hydrology (SOH). Public review and comment is sought under the HFAWG Terms of Reference and the USGS peer review plan for the report (URL: https://www.usgs.gov/peer_review/docs/guidelines_for_determini ng_flood- flow_frequency.pdf). The ACWI was established under the authority of the Office of Management and Budget Memorandum 92-01 and the Federal Advisory Committee Act. The purpose of the ACWI is to provide a forum for water- information users and professionals to advise the Federal Government about activities and plans which may improve the effectiveness of meeting the Nation's water information needs. It has been 33 years since the last revision of Bulletin 17B in March 1982. At that time, it was recognized that continued investigation and improvements of flood frequency analysis techniques were needed. In fact, Bulletin 17B included a list of areas where additional research was recommended by the Work Group in 1982. The SOH's HFAWG has done extensive work during the last few years to update the Bulletin. The draft report resulting from that process is now available for public review and comment. The Board also addresses customary and traditional use determinations during the applicable cycle. When final, the resulting rulemaking will replace the existing subsistence fish and shellfish taking regulations. We, the U.S. Fish and Wildlife Service (Service), determine threatened species status under the Endangered Species Act of 1973 (Act), as amended, for Hesperocyparis abramsiana (=Cupressus abramsiana) (Santa Cruz cypress), a plant species found in Santa Cruz and San Mateo Counties in west-central California. We also finalize the correction to the scientific name of Santa Cruz cypress on the List of Endangered and Threatened Plants. The effect of this regulation will be to change the listing status of Santa Cruz cypress from an endangered species to a threatened species on the List of Endangered and Threatened Plants.
