We, the U.S. Fish and Wildlife Service (USFWS), are extending the public comment period on documents related to the draft revised summer survey guidelines for the Indiana bat (Myotis sodalis) for an additional 30 days. We announced availability of these documents in our January 9, 2013, Federal Register notice, which opened a 30-day public comment period. If you have previously submitted comments, you do not need to resubmit them. We have already incorporated them in the public record and will fully consider them in our final USFWS guidelines. The draft guidelines were prepared by representatives of the U.S. Department of Agriculture's Forest Service, U.S. Department of Defense's Army Corps of Engineers, U.S. Department of the Interior's Geological Survey and USFWS, Kentucky Department of Fish and Wildlife Resources, New York State Department of Environmental Conservation, and the Indiana Department of Natural Resources. We, the U.S. Fish and Wildlife Service (Service), are announcing the availability of the following documents for review and comment by the public and Federal, Tribal, State, and local governments: Draft Greater Sage-grouse Umbrella Candidate Conservation Agreement with Assurances for Wyoming Ranch Management (Umbrella CCAA), and Draft Environment Assessment of the Greater Sage-grouse Umbrella Candidate Conservation Agreement with Assurances for Wyoming Ranch Management (EA). The Service and several State, Federal, and local partners prepared the draft Umbrella CCAA to provide Wyoming ranchers with the opportunity to voluntarily conserve greater sage-grouse and its habitat while carrying out their ranching activities. Ranchers may apply for an enhancement of survival permit under the Endangered Species Act of 1973, as amended (ESA), by agreeing to implement certain conservation measures in the Umbrella CCAA that apply to their properties. Pursuant to the National Environmental Policy Act, we also prepared a draft environmental assessment (EA) that analyzes the potential impacts to the human environment from the proposed Umbrella CCAA and alternatives to the action.

Notice of Intent To Prepare an Environmental Impact Statement for Personal Watercraft Use at Gulf Islands National Seashore, Florida and Mississippi

Pursuant to Section 102(2)(c) of the National Environmental Policy Act of 1969, 42 U.S.C. 4332(2)(C), the National Park Service (NPS) is preparing an Environmental Impact Statement (EIS) to analyze the impacts of Personal Watercraft (PWC) use at Gulf Islands National Seashore (GUIS). Personal Watercraft use emerged at GUIS in the 1980s and was permitted in units of the national park system under the same regulations as other motorized watercraft. However, on March 21, 2000, the NPS published a regulation governing PWC use within all units of the national park system (65 FR 15077, codified at 36 CFR 3.24). This regulation prohibits PWC use in all national park units unless the NPS determines that this type of water-based recreational activity is appropriate for the specific park unit based on the legislation establishing that park, the park's resources and values, other visitor uses of the area, and overall management objectives. In 2004, the NPS prepared an Environmental Assessment (EA) for a special regulation to allow continued PWC use at GUIS. The purpose of the EA was to evaluate a range of alternatives and strategies for the management of PWC use at GUIS to ensure the protection of park resources and values, while offering recreational opportunities as provided for in the GUIS enabling legislation, purpose, mission, and goals. A Finding of No Significant Impact (FONSI) was signed on January 25, 2006. The NPS published the final regulation for PWC use at GUIS in the Federal Register on May 4, 2006 (71 FR 26232). On May 15, 2008, a lawsuit was filed claiming that the PWC EA was deficient and violated NEPA, the NPS Organic Act, and the Administrative Procedure Act. On July 8, 2010, the U.S. District Court for the District of Columbia found that the impact analysis in the EA was inadequate. The court did not vacate the current PWC rule at GUIS, but remanded the case to the NPS ``so that it may have an opportunity to provide adequate reasoning for its conclusions.'' The special regulation remains in effect at GUIS and PWC are currently still allowed to operate under the restrictions identified in the park's special regulation. At this time, the NPS intends to address the deficiencies identified by the court by preparing an EIS for PWC use at GUIS, which will include supplemental documentation, impact analyses not present in the earlier EA, and may include additional alternatives.

We also announce the reopening of comment on the August 16, 2012, proposed designation of critical habitat for the six west Texas aquatic invertebrate species and the availability of a draft economic analysis of the proposed designation and amended required determinations in the proposed rule. We are reopening the comment period to allow all interested parties an opportunity to comment simultaneously on the proposed rules, the associated draft economic analysis, and the amended required determinations. Comments previously submitted need not be resubmitted, as they will be fully considered in preparation of the final rules.

Endangered and Threatened Wildlife and Plants; Removing the Island Night Lizard From the Federal List of Endangered and Threatened Wildlife

We, the U.S. Fish and Wildlife Service (Service), propose to remove the island night lizard (Xantusia riversiana) from the Federal List of Endangered and Threatened Wildlife. This action is based on a review of the best available scientific and commercial information, which indicates that the species no longer meets the definition of endangered species or threatened species under the Endangered Species Act of 1973, as amended (Act). This proposed rule, if made final, would remove the island night lizard as a threatened species from the List of Endangered and Threatened Wildlife. This document also constitutes our 12-month finding on a petition to remove the island night lizard from the Federal List of Endangered and Threatened Wildlife.

We, the U.S. Fish and Wildlife Service, propose to establish a nonessential experimental population (NEP) area for the North American wolverine (Gulo gulo luscus) in the Southern Rocky Mountains of Colorado, northern New Mexico, and southern Wyoming. The distinct population segment (DPS) of the North American wolverine occurring in the contiguous United States is proposed for Federal listing as a threatened species under the Endangered Species Act. We propose to establish the NEP area for the wolverine in the Southern Rockies portion of the DPS under section 10(j) of the Endangered Species Act, and to classify any wolverines introduced into the area as a nonessential experimental population within the Southern Rocky Mountains. This proposed rule provides a plan for establishing the NEP area and provides for allowable legal incidental taking of the wolverine within the defined NEP area. The proposed action would not result in reintroduction of the wolverine; rather, the NEP area designation would provide the regulatory assurances necessary to facilitate a State-led reintroduction effort, should the state of Colorado determine to reintroduce the wolverine. The best available data indicate that reintroduction of the wolverine into the Southern Rocky Mountains is biologically feasible and will promote conservation of the species.
Endangered and Threatened Wildlife and Plants; Threatened Status for the Distinct Population Segment of the North American Wolverine Occurring in the Contiguous United States

We, the U.S. Fish and Wildlife Service, propose to list the distinct population segment of the North American wolverine occurring in the contiguous United States, as a threatened species under the Endangered Species Act. If we finalize this rule as proposed, it would extend the Act's protections to this species. The effect of this regulation is to add the distinct population segment of the North American wolverine occurring in the contiguous United States to the List of Endangered and Threatened Wildlife in our regulations. We also propose a special rule under section 4(d) of the Act to apply the specific prohibitions of the Act necessary to protect the wolverine. We find that critical habitat is not determinable at this time. The Service seeks data and comments from the public on this proposed listing rule, the proposed special rule under section 4(d) of the Act, and our finding that the designation of critical habitat for the species is not determinable at this time.
Notice of Intent To Prepare a Draft Environmental Impact Statement for a General Conservation Plan for the American Burying Beetle for Pipelines and Well Field Development in Oklahoma and Texas

We, the U.S. Fish and Wildlife Service (Service), advise the public that we intend to prepare a draft environmental impact statement (EIS) to evaluate the impacts of, and alternatives to, the proposed General Conservation Plan (GCP) for incidental take of the federally listed American burying beetle (ABB) resulting from activities associated with construction, maintenance, operation, and repair of oil and gas pipelines, and related well field activities. Individual oil and gas companies would apply for an Endangered Species Act 10(a)(1)(B) permit and agree to implement the approved GCP. A GCP is a conservation plan suitable for the needs of a local area where the NEPA requirements and permit issuance criteria are met. After approval of the GCP, individuals apply for a permit for incidental take associated with activities covered in the GCP and agree to comply with the terms and conditions of the GCP. We notice these permit applications and request comments from the public.
Boundary Revision of Minuteman Missile National Historic Site

Notice is hereby given that, pursuant to Section 3(f)(2)(B) of the Act of November 29, 1999 (Pub. L. 106-115, 113 Stat. 1540-1543), the boundary of Minuteman Missile National Historic Site in the State of South Dakota is modified to include two parcels containing approximately 28.65 acres of unimproved land more specifically identified below. The property is owned by the United States of America and presently administered by the United States Forest Service. Through a General Management Plan dated July 2, 2009, the National Park Service determined that these parcels are the appropriate location for a visitor facility and administrative site. The boundary revision is depicted on Map No. 406/80,011A, dated January 14, 2011.
